Giving vengeance a voice in court

"A criminal trial should be a cool-headed assessment of evidence, not a chance for victims to vent their distress.

It is hard to remember a reform to the UK’s criminal-justice system which was not geared towards giving victims a ‘voice’ or ‘presence’ in the courtroom. This week, yet another victim-centred reform was announced, one which would allow for victim-impact statements to be read out in court by victims or their relatives. Victim’s minister Dominic Green said that the reforms would ‘give victims a real say in proceedings’."

While we can, as human beings, acknowledge and pay due deference to the hardship of a criminal trial, particularly for the victims of the crimes under consideration, we must keep the central purpose of this ancient social ritual at the forefront of our minds. We cannot allow a victim-centred approach to justice to turn our courtrooms from the hopefully objective and impartial arbiters of the social will, into the organs of state-sanctioned revenge."

Internet child abuse [sic] 'clampdown' by new UK-US agency

"Police Minister Damian Green Damian Green will co-chair a new cross-border agency that fights against online child abuse. [sic]

Criminals who trade in child abuse images [sic]  are to be targeted in a new British-American task force.

Police Minister Damian Green will fly to the US later to formalise arrangements for the new body.

The agency will be co-chaired by Mr Green and US Attorney General Eric Holder.

Mr Green said: "Child abuse and exploitation online are not restricted by borders and our efforts to combat them should not be either."

"This agreement will only strengthen our ability to crack down on this sickening [sic] crime."

He went on: "British and American parents rightly expect us to do all we can to protect our children and that is why I want to agree to a much closer working relationship in this area.

Mr Green will sign a memorandum of understanding between the two countries in the next few days."

"The Sun on Sunday reported that as part of the trip Mr Green will meet senior figures within the FBI, Homeland Security and other law enforcement agencies."

New Powers for Tighter Restrictions on Sex Offenders

"Measures to give greater powers for the police to protect the vulnerable from sexual predators [sic] were announced today by Policing and Criminal Justice Minister Damian Green.

The proposals, tabled in the Antisocial Behaviour, Crime and Policing Bill, will strengthen existing powers by making it easier to restrict the movement and activities of anyone who poses a risk of sexual harm to children and adults – not just people who have been convicted of sexual offences. They also build on Nicola Blackwood MP’s amendment to the Bill.

The two new orders will replace existing powers and the threshold for risk will be lowered to cover any case of sexual harm [sic], not just cases of serious sexual harm.

The new orders are:

Sexual Harm Prevention Orders can be applied to anyone convicted or cautioned for a sexual [sic] or violent offence, including where offences are committed overseas. They will replace Sexual Offences Prevention Orders and Foreign Travel Orders;

and

Sexual Risk Orders can be applied to any individual who poses a risk of sexual harm in the UK or abroad, even if they have never been convicted. They will replace the Risk of Sexual Harm Order.

Both powers can place a range of restrictions on individuals depending on the nature of the case, such as limiting their internet use, preventing them from being alone with a child under 16, or preventing travel abroad.

The new Sexual Harm Prevention Order can be made by a court on conviction, or if the police or National Crime Agency (NCA) apply to a Magistrates’ Court. The order lasts a minimum of five years and has no maximum duration. The new Sexual Risk Order can be made if the police or NCA apply to a Magistrates’ Court regarding a person who poses a risk of sexual harm [sic]. It lasts a minimum of two years and has no maximum duration.

The government’s measures take into account the findings of an Association of Chief Police Officers-commissioned report into the use and effectiveness of civil orders, and following consultation with front-line professionals including the police, the courts, and the Child Exploitation and Online Protection Centre [defunct].

Policing and Criminal Justice Minister Damian Green said:

“The UK has some [sic] of the toughest powers [most draconian] in the world to deal with sex offenders [sic].

“Today, we are going even further by giving police and National Crime Agency officers the power to place greater restrictions on any person they judge to be a risk. Our proposals support the Childhood Lost campaign to tighten the law on sex offenders [sic] and make it easier for police to monitor them.

“This is part of ongoing work by the Home Office led National Group to look at how the police and other agencies can better identify and deal with sexual offending [sic], ensuring victims are at the heart of the criminal justice system.”

Other measures in the Bill include provisions on anti-social behaviour, extradition, forced marriage, firearms and dangerous dogs."

New powers to restrict potential [i.e. not] sex offenders

"'Very worrying'

Richard Atkinson, who chairs the criminal law committee of the Law Society, told BBC Radio 4's PM programme he was concerned about the move.

"Of course, a great deal of stigma is attached to anyone who has such an order made and if the process of obtaining these orders is less than that is needed for a conviction then that's a very worrying departure from our normal standards," he said."

Sexual Risk orders: something liberals should be worried about?

MPs approve measures to prevent child sexual abuse

"The government has lent its support to a campaign led by backbenchers to introduce new powers to prevent the sexual abuse of children.

Before the main debate on the Anti-social Behaviour, Crime and Policing Bill got underway, several objections were raised to the timetabling of the bill. Labour forced a division on the programme motion, but lost the vote 227 to 294 .

An amendment was tabled at report stage of the bill on 14 October 2013 to enable courts to issue a "child sexual abuse prevention order"."

Criminals to be named and shamed by Home Office

"Mugshots of convicted criminals are to be published on a Government website in a move to name and shame offenders.

Members of the public will be able to enter their postcode and see a “rogues’ gallery” of local convicts who have recently been handed jail terms.

The service, called “In The Dock”, will be introduced gradually on the police.uk website from the end of this month.

Ministers hope it will boost confidence in the criminal justice system, while also drawing a line under recent cases where police have declined to issue photographs of criminals or suspects because of human rights laws or concerns over privacy.

Victims of crime will have the opportunity to give their view on whether their attacker’s mugshot should be publicised.

Publishing photographs of convicted paedophiles [sic] and sex offenders has not been ruled out, a Home Office spokesman said, but each offender will be dealt with on a case-by-case basis.

Initially, the new service will feature offenders from West Yorkshire Police, which already publishes the mugshots on its website, but ministers expect other forces to follow suit.

Damian Green, the police minister, said: “When someone breaks into your home or robs your local shop, you want to see them properly punished and held to account for their actions.

“So we will be placing mugshots of convicted criminals on our trailblazing crime mapping website so that justice is seen to be done in the truest sense."
