Feds Worry Defendant in Forced Decryption Case Will Forget Passwords

"Federal prosecutors are urging a federal judge to demand a Wisconsin man immediately decrypt several hard drives they believe contain child pornography.

The authorities have been litigating the constitutionality of the decryption issue for months, and want the suspect, Jeffrey Feldman, to decrypt the drives before he forgets the passwords. Federal prosecutors say Feldman can, even after decrypting, continue litigating his claim that the Fifth Amendment protects him from having to unlock at least seven hard drives in the case."

Fifth Amendment shields child porn suspect from decrypting hard drives

"Judge says forcing man to unlock files would amount to self-incrimination.

A federal judge refused to compel a Wisconsin suspect to decrypt the contents of several hard drives because doing so would violate the man's Fifth Amendment right against self-incrimination. Judge William E. Callahan's Friday ruling ultimately labeled the issue a "close call."

Courts have wrestled with how to apply the Fifth Amendment to encrypted hard drives for several years. According to past rulings, forcing a defendant to decrypt a hard drive isn't necessarily self-incriminating, but forcing a defendant to decrypt a hard drive can amount to self-incrimination if the government can't otherwise show that the defendant has the password for the drive. In that case, forced decryption amounts to a forced confession that the defendant owns the drive."

Citing hunt for pedophiles, Dutch government to make refusing to help decrypt computer a crime

"AMSTERDAM - The Dutch government says it is planning to make it a crime for a suspect in a child sex abuse or terrorism case to refuse to help decrypt a computer when ordered to do so by prosecutors.

In February, a U.S. appeals court found that forcing a suspect to surrender access to his computer can violate his constitutional rights not to incriminate himself.

Justice Minister Ivo Opstelten said Wednesday the real issue is obstruction of justice, and he said comparable laws exist in England and Sweden."
