Paedophiles [not] to be treated as terrorists [well, that's a promotion then !!!] under new crackdown

"PM moves to close loophole [sic] that allows sexual predators [sic] to produce and possess 'manuals' [sic] to help them [sic] commit crimes

David Cameron said: 'I want to ensure we do everything we can to protect children.' [hahahaha - you tool]

Paedophiles [not] will be handed the same treatment as terrorists [employed by MI5/6?] under a crackdown on child abuse [sic] to be included in the Queen's speech.

David Cameron said he wanted to close a loophole [sic] that allows sexual predators to produce and possess "manuals" giving tips on how to identify victims, groom them, and evade capture [sic].

In future, they will face the same kind of sanctions as extremists who download guides to bomb-making [because, that is so effective, against actual terrorism].

The issue came to light after GCHQ and the National Crime Agency found online examples of the guides in the chaotic [?] part of cyberspace known as the "dark web""

The war on paedos: grooming the public’s fears

"The interweaving of the narrative of terrorism with that of paedophilia is driven by a tendency to attach campaigns and causes to the cause of child protection. Since its inception in September 2001, the war on terror has always been far too distant and abstract to capture the imagination of the British and European public. However, perceptions about the threat of stranger-danger to children are very different. Paedophilia has emerged as an all-purpose focus of dread, which is why policymakers tend to interpret threats through the idiom of child protection.

There are many reasons why Western governments have proved so inept at containing the appeal of radical jihadist movements. The tendency to infantilise potential terrorist recruits and to treat their inculcation as akin to being groomed by a paedophile indicates that at least some counter-terrorist officials have become lost in their own fantasy world. It is likely that this war on paedophilia will be just as pointless and ineffective as the one waged against Islamist groomers. Common sense looks likely to be the main casualty of this war, and the professional demonologist its main beneficiary."

Paedophiles to be treated like terrorists

"Even somewhat overbroad legislation against “how to” manuals ought not to impact Heretic TOC legally, as this blog definitely does not incite law-breaking. Indirectly, though, it would have a very chilling effect. What worries me far more is the potential for yet another measure, because they never stop coming, do they? And what would it look like, this further laceration in our slow death by a thousand cuts? Now that we are to be firmly yoked together with terrorism it’s obvious, isn’t it?

Glorifying terrorism was made illegal by the Terrorism Act 2006. So logically the next step would be to ban the glorification of paedophilia – a “crime” that could well be framed to include saying anything whatever in its favour. This could spell trouble for Heretic TOC, and possibly for any advocacy aimed at lowering the age of consent, even by only a year. Now, that would really be a scary prospect for democracy."

New sentencing guideline gives greater focus to impact [when there are none?] of sex offences [sic] on victims [when there are none?]

"The Sentencing Council has published a new sentencing guideline for sexual offences [sic] which will help ensure appropriate and consistent sentences for sex offenders [sic] .

The guideline covers more than 50 offences including rape, child sex offences, indecent images of children [N.B. not the same], trafficking and voyeurism, and brings significant changes to how offences are considered by the courts.

It marks a step forward in how courts take into account the impact [when none?] of sex offences [sic] on victims. As well as physical harm, the new approach will reflect more fully the psychological and longer term effects on the victim, enabling courts to take into account the true extent of what the victim has been through [because this cannot be proven].

The guideline also takes an expanded approach to how courts assess offenders, looking at the full context of offending behaviour and motivation in committing any offence. This means giving more significant emphasis to important aspects like grooming activity by both individuals and gangs, the targeting of vulnerable victims such as those in care and offenders’ abuse of trust and positions of power or status so that these are clearly reflected in sentence levels.

The guideline makes it clear that victims are not responsible for what has happened to them. [not 'responsible in law', but, often, participatory] This is particularly emphasised in relation to offences committed against children. In the previous guideline there were child sex offences labelled as involving ‘ostensible consent’ – that is, where a child over 13 has apparently agreed [apparently?] to sexual activity. The Council believes that this is the wrong way of looking at these offences [you mean, as the truth? - BTW, who are you to decide what is 'wrong' or 'right', in this context?] as children do not consent to their own abuse [abuse - you mean pleasure? Of course, many (likely to be the majority) consent to their participation]. The new guideline therefore looks more at the offender’s actions and behaviour towards the victim.

The new guideline also brings increases in sentencing starting points and sentencing ranges for some offences. For example, in relation to rape, the new guideline allows top category sentences with a starting point of 15 years. The previous guideline only allowed sentences with this starting point for multiple rapes. Sentences of 20 years and above are also now recommended for campaigns of rape. In addition, the worst cases of assault by penetration can now receive the same sentences as rape.

The guideline simplifies the system for assessing indecent images of children which will make analysis of imagery much easier when evidence is being compiled against someone being prosecuted. The new guideline moves away from concentrating on just the number of images [which it never did] and gives more emphasis to what the offender is doing with the images – possessing, distributing or creating – to help assess the offending behaviour and appropriate sentence level.

The guideline also takes account the increased use of technology in offending since the previous guideline was issued in 2004. In relation to many of the offences, a new aggravating factor in the guideline is of recording the crime ['taking', yes? Not 'making'] as filming and photographing victims has become more common since the previous guideline was produced.

Due to the growth in online offending, the Council has ensured that guidelines, such as for sexual activity with a child, cover offending committed remotely such as via webcam. It also takes into account aspects like offenders lying about their age, grooming via social media or asking children to share indecent photos of themselves. Factors like the encryption of imagery and recording of an offence, which is increasingly common, will also increase sentence length.

While the guideline covers the ways these crimes are committed today, it remains flexible enough to deal with future technological evolution.

Public protection is central to the guideline which reinforces the importance of proper punishment and the prevention of reoffending, either through significant custodial sentences or rigorous treatment programmes that will address the offender’s behaviour.

This is the largest and most complex guideline the Council has produced and it was created after a very substantial period of consultation with criminal justice professionals and research with victims and judges. It was also subject to a public consultation, and responses were received from a very wide range of people including groups representing victims, judges, magistrates, lawyers, the police, NGOs, the Government, academics, medical practitioners as well as the wider public. The Council has made many changes to the guideline as a result of their views, for example, to the factors that should be considered in relation to harm and culpability, sentence levels and mitigating factors. Changes include:

>allowing proper consideration of the vulnerability of the victim such as through age or disability or a background of physical or emotional abuse;

>broadening the wording of various aggravating factors to ensure they cover the great range of offending, for example in relation to abuse of trust where an offender has abused the trust that may come with status or image;

>ensuring good character can now be an aggravating factor [what???!!!] when it has facilitated an offence – such as when it leads a child to trust the offender, makes it harder for them to report an offence or be believed; and

>adding various new aggravating factors. In relation to exploitation offences, ‘threats of exposure’ to family or others is now included to cover situations where this is used as a further means of controlling victims.

Chairman of the Sentencing Council, Lord Justice Treacy [Establishment Stooge] said:

“This guideline will make real changes to the way offenders are sentenced for these very serious, sensitive and complex offences. It will help judges and magistrates sentence in a way which protects our communities from this kind of offending and the suffering it causes.

“We have taken on board the views of victims, criminal justice professionals and the wider public to produce an approach to sentencing which people can understand and have confidence in. This approach will enable sentences that reflect what the victim has been through and take in a full profile of what the offender has done, such as grooming victims or abusing trust.

“No one wants more people falling victim to offenders who come before the courts, and public protection is central to this guideline, whether this is by jailing offenders or, where appropriate, imposing a rigorous treatment order and other restrictions to prevent reoffending.”

National Policing Lead for Violence and Public Protection Chief Constable David Whatton said:

“The new guidelines from the Sentencing Council show how well the Council listened during its consultation. The guidelines complement the new CPS and College of Policing guidance and are indicative of the move across the criminal justice system to ensure that police, prosecutors and judges take a victim-centred approach when dealing with sexual offences while still ensuring the integrity of the justice system.

“Across the justice system, changes have been made to ensure that the alleged offenders’ behaviour and the context and circumstances of the incident are scrutinised, rather than the credibility of the victim. These changes are intended to ensure that across the board our response to sexual offenders is robust and victims get the support they need. The new Sentencing Council guidelines will ensure offenders who are brought to justice are dealt with appropriately.”

Barnardo’s deputy director of strategy Alison Worsley, said:

“It is difficult to imagine the torment experienced by the vulnerable victims of crimes such as these. The publication of this new sentencing guideline will help to ensure the focus is on the perpetrator and not the victim.

"As the guideline emphasises, it is plain wrong to imply in any way that the experiences of sexually exploited children are something they bring on themselves. Barnardo’s Remember They are Children campaign showed that no child can ever truly agree to their own abuse. “If we are to turn the tide in the fight against these awful crimes it is vital that victims feel they will be taken seriously and dealt with sensitively at all levels of the justice system.”

The guideline will come into force in courts in England and Wales in April 2014 and replace existing guidance which was issued by the Sentencing Council’s predecessor body following the Sexual Offences Act 2003. Sentencing levels for sexual offences have been increasing since the Act, and existing sentencing guideline, came into force, and the new guideline reflects these increases. They do not include any reductions in sentences from current sentencing. [what a surprise, there is the unaccountable mission creep]

The new guideline covers 54 very varied offences and aims to ensure appropriate sentences are given for the wide spectrum of offending that takes place. However, where judges feel that they are dealing with an exceptional case, they can sentence outside the guideline ranges and up to the maximum permitted by law.

They will apply to all adult offenders, regardless of when offences took place, so while offenders will be subject to the law at the time of the offence, the guideline will bring a modern [regressive] and victim-focused [not rights-focused] approach to how historic offenders are dealt with by the courts."

Sentencing Council launches new definitive guideline for sexual offences; 12 December 2013

"Today, the Sentencing Council is publishing a new guideline for judges and magistrates on the sentencing of sexual offences.

The new guideline, which has been issued following a public consultation [sham], will come into effect on 1 April 2014."

Why Have We Criminalized Love?

"Readers — It is downright BIZARRE that we have criminalized normal behavior that’s consensual. That’s what has happened to teens who have sex, write Shelly Snow, author of the blog With Justice for All:

Of course, anyone who is not lying, or has a modicum of knowledge and/or principles, knows, that these search terms would never bring up any potentially-illegal images, and have not been able to do so, for many years; knowing that, there is no intention, here or elsewhere, to do so. We do know, that they will be on 'the list'.

Bing, first. SafeSearch off. We could turn images off, but, we will take Microsoft's word for it, as a newbie will.

Web search ...

Much as before, now image/videos/news search ...

We have no idea what the 100,000 possible search terms could be !!!

Now, the zealots, profiteers and simpletons, will be jumping up-and-down, for joy, about that result (not that it stops anything, that really matters, of course).

However, the bonafide researcher and Libertarian should be very concerned, indeed.

Image searches lead, often more rapidly, to very valuable (re)sources ... for example, court documents, media reports, related cases and issues etc. etc. etc.

This is, of course, the (predicted and usual) danger of knee-jerk, blanket, censorship.

This is a private company, Microsoft, throwing the baby out with the bath water, for popularity and profit.

This is the false flag, which is (and has been, for a long time) to be used, for all topics, which are, or will be, deemed to be unacceptable, for our consumption.

This is where we are in 2013 ... and it has little to no point (as suggested), at all.

Next time, Google.

Online child safety [sic] – big things [sic] happening

"Pulling out the stops

Google and Microsoft have really pulled out the stops. This is a very impressive initiative. It is narrowing the spaces in which paedophiles [sic] and collectors of child abuse images [sic] can operate. The challenge now is to work out how to gauge the effectiveness of and learn from the various measures that are being put in place but I am sure there is a will so we can find a way.

The beginning of a new phase

This is unlikely to be the end of the story but there is no question we have reached an important milestone. There are still anxieties about the Darknet and the true extent to which it and the use of encryption may continue to frustrate law enforcement’s and everybody’s efforts. But we don’t always have to do the really hard stuff first. Dealing with the more open parts of the internet has to be a key priority precisely because it is so accessible and therefore has the greater potential to draw in new offenders. All the companies involved deserve a great deal of credit for their willingness to sail into these uncharted waters and so does Claire Perry MP and the Government as a whole for sticking with the issue in the way that they have. I await with interest to see how what is happening in the UK starts to roll out or impact other jurisdictions."

Laboring In The Shadows To Keep The Web Free Of Child Porn

"Internet search providers like Google and Microsoft are also investing in similar programs."

"The Microsoft system, known as PhotoDNA, was co-developed by a team at Dartmouth and has since been donated to the National Center for Missing and Exploited Children. Earlier this year, Twitter began using it to scan every photo that's uploaded to its site.

The program works by scanning known images of child pornography and giving them a unique signature that goes into a database. If that image appears on another site, it is instantly flagged and removed. Google has its own proprietary tagging system that works in a similar way.

But in order for an image to be identified as child pornography in the first place, a person has to review it. The people who do that work for tech companies are employed all over the world, and very little is known about them, says Sarah Roberts of Western University in Ontario, Canada."

Efforts to end child pornography have been ineffective

"In continuing this internet blockade against child pornography, Google has also proposed a solution, a database of “encrypted” child porn images that is said to enable some companies and law enforcement to further collaborate on detecting and removing these photos from the possession of predators.

Google uses technology known as “hashing,” which is similar to Facebook’s photo tagging capabilities.

The software allows the company to tag images with an identification code that is reported and blocked by other companies when locating a duplicate image elsewhere on the web.

Ironically, Google, which is in the business of making news and information widely available, is creating a content blockade."

We Told You, First They Came For The 'Sex Offenders'

October 9th, 2013

New Powers for Tighter Restrictions on Sex Offenders

"Measures to give greater powers for the police to protect the vulnerable from sexual predators [sic] were announced today by Policing and Criminal Justice Minister Damian Green.

The proposals, tabled in the Antisocial Behaviour, Crime and Policing Bill, will strengthen existing powers by making it easier to restrict the movement and activities of anyone who poses a risk of sexual harm to children and adults – not just people who have been convicted of sexual offences. They also build on Nicola Blackwood MP’s amendment to the Bill.

The two new orders will replace existing powers and the threshold for risk will be lowered to cover any case of sexual harm [sic], not just cases of serious sexual harm.

The new orders are:

Sexual Harm Prevention Orders can be applied to anyone convicted or cautioned for a sexual [sic] or violent offence, including where offences are committed overseas. They will replace Sexual Offences Prevention Orders and Foreign Travel Orders;

and

Sexual Risk Orders can be applied to any individual who poses a risk of sexual harm in the UK or abroad, even if they have never been convicted. They will replace the Risk of Sexual Harm Order.

Both powers can place a range of restrictions on individuals depending on the nature of the case, such as limiting their internet use, preventing them from being alone with a child under 16, or preventing travel abroad.

The new Sexual Harm Prevention Order can be made by a court on conviction, or if the police or National Crime Agency (NCA) apply to a Magistrates’ Court. The order lasts a minimum of five years and has no maximum duration. The new Sexual Risk Order can be made if the police or NCA apply to a Magistrates’ Court regarding a person who poses a risk of sexual harm [sic]. It lasts a minimum of two years and has no maximum duration.

The government’s measures take into account the findings of an Association of Chief Police Officers-commissioned report into the use and effectiveness of civil orders, and following consultation with front-line professionals including the police, the courts, and the Child Exploitation and Online Protection Centre [defunct].

Policing and Criminal Justice Minister Damian Green said:

“The UK has some [sic] of the toughest powers [most draconian] in the world to deal with sex offenders [sic].

“Today, we are going even further by giving police and National Crime Agency officers the power to place greater restrictions on any person they judge to be a risk. Our proposals support the Childhood Lost campaign to tighten the law on sex offenders [sic] and make it easier for police to monitor them.

“This is part of ongoing work by the Home Office led National Group to look at how the police and other agencies can better identify and deal with sexual offending [sic], ensuring victims are at the heart of the criminal justice system.”

Other measures in the Bill include provisions on anti-social behaviour, extradition, forced marriage, firearms and dangerous dogs."

New powers to restrict potential [i.e. not] sex offenders

"'Very worrying'

Richard Atkinson, who chairs the criminal law committee of the Law Society, told BBC Radio 4's PM programme he was concerned about the move.

"Of course, a great deal of stigma is attached to anyone who has such an order made and if the process of obtaining these orders is less than that is needed for a conviction then that's a very worrying departure from our normal standards," he said."

New Sexual Harm Prevention Orders have the potential to be a very powerful tool in protecting children

"Media Centre Home > Press Releases

The new two orders will replace existing powers and the threshold for risk will be lowered to cover any case of sexual harm, not just cases of serious sexual harm

National policing lead on child protection [dead CEOP] Peter Davies [how's the bullying situation going, Peter?] said:

“ACPO commissioned an independent [hahahaha] report into Civil Prevention Orders under the Sex Offences Act 2003, which reported in May 2013. The report [from your stooge, another Davies] found that the orders were too complex and ineffective in protecting children.

“The new Sexual Harm Prevention Orders proposed by the Policing Minister Damien Green MP build upon the findings of this report and amendments to the Crime and Policing Bill tabled by Nicola Blackwood MP [stooge].

“These new orders are potentially a very powerful [yup, for the Stasi], very useful new tool in the hands of law enforcement to prevent harm to children at the earliest opportunity.”"

It was say they are breaking the law [sic] and that the police have been alerted [have we got images turned on or off, constable?].

The system will be launched by the major internet providers Sky, Virgin, BT and TalkTalk, as part of the Government’s crackdown on child abuse. [sic]

The system will also carry a helpline number.

Additional analysts tasked with hunting down child porn sites [sic] will also be employed by the New Year as part of the new National Crime Agency.

David Cameron, the Prime Minister, has demanded action on tackling online child abuse [sic] in the wake of a number of high profile cases that have put its impact [sic] in to the spotlight.

Guess Who Is Next, On The Intelligence Satellite Feed?

Published on the 22 September 2013

Plan to satellite track sex offenders in Scotland

"The plans, which have received backing across the political spectrum, would see dangerous criminals [sic] tracked by satellite.

SATELLITE technology would be used to track sex offenders under Scottish Government plans to crack down on the most predatory and dangerous criminals [why are they not in prison, then, Kenny?].

A consultation launched tomorrow will also propose using the GPS tags to track domestic abuse and persistent offenders, and alcohol bracelets for people who commit crimes while drunk.

While many sex offenders, and other criminals, are already tagged, the move would see a major increase in how much of their movement is monitored.

Current radio frequency tags go off if someone leaves a certain area, such as their home, or goes somewhere they should not go within set times.

Using satellite technology and Google maps, police will be able to monitor a sex offender at all times, wherever they go. They will be able to observe patterns of movement to help build intelligence.

Writing in today’s Scotland on Sunday, justice secretary Kenny MacAskill said: “Satellite tracking can enable authorities to pinpoint an offender’s [ex-offender, Kenny, a 'free' person], that is exact location in real time, which has the potential to greatly assist how they are monitored. It also allows them to set up specific exclusion zones, preventing offenders [ex-offender, Kenny, a 'free' person] from entering potential risk [either there is a risk, or there is not - that is what 'risk' means] areas like high streets [!], schools and playgrounds. [paedocard played nicely]”

How a Law Aimed at Sex Offenders Could Feed into the Growing Surveillance State

"A new precedent for chilling 1st Amendment rights.

Last November, California voters overwhelmingly approved Proposition 35, the Californians Against Sexual Exploitation (CASE) Act. Like “tough on crime” anti-trafficking legislation around the country, Proposition 35 was presented as bolstering law enforcement's ability to fight human trafficking by introducing a bundle of new laws that, most prominently, increased penalties for those convicted of trafficking human labor, made prostitution a sex crime, and with less public attention, created a new requirement for registered sex offenders.

Under this last provision, all 73,000 registered sex offenders are required to submit their Internet service providers and "Internet identifiers” to their local police department within 24 hours of creating each new one, or face up to three years in jail. “Identifiers” include every name or username a registrant uses for any online activities he engages in, from posting a comment in a news outlet to shopping.

The day after Prop 35 was voted into law, the Electronic Frontier Foundation and the ACLU of Northern California filed a class action complaint on behalf of two anonymous registrants and the advocacy group, California Reform Sex Offender Laws, against the provision under question, claiming that it was unconstitutionally broad and would create a chilling effect on registrants’ free speech and associative rights. In response, the District Court immediately issued a temporary restraining order on Nov. 8, 2012, and eventually, a preliminary injunction on Jan. 11, 2013.

In his ruling, presiding judge Thelton E. Henderson agreed that the provision would chill the right of registrants to speak anonymously and stated that the “Court cannot simply presume the [government] will act in good faith and adhere to standards absent from the [statute's] face.”"

"Contrary to what the state suggests, there is little evidence that the Internet is used to facilitate sex crime or exploitation. According to a declaration submitted by David Finkelhor, the director of the Crimes against Children Research Center and professor of sociology at the University of New Hampshire, sex crimes against children facilitated by technology constitute only one percent of all sex crimes committed against children; and of those arrested for technology-facilitated crimes against youth, only four percent are registered sex offenders. Between 2000 and 2010, there was a 50 percent decline in all unwanted sexual solicitations on the Internet. These statistics were published by two studies, the Youth Internet Safety Survey and the National Juvenile Online Victimization, sponsored by the US Department of Justice Office of Juvenile Justice and Delinquent Prevention."

Sex Offender Scapegoats, Used To Justify Everyone's Loss Of Liberty

11 September 2013

New DNA database will have profiles of 1,000 sex offenders

"THE new DNA database will contain profiles of over 1,000 sex offenders.

It will allow the Gardai to match a DNA profile from a persona to an unidentified DNA crime scene profile – and also to quickly eliminate other suspects.

The new DNA database will also include past and present samples from crime scenes – in a move which may help to resolve unsolved cases.

It will operate using software supplied by the FBI at the Forensic Science Laboratory – which is based in Garda Headquarters in the Phoenix Park.

Justice Minister Alan Shatter said that the database would include all those on the sex offenders register once the legislation came into effect. There are currently 1,280 people on the sex offenders register.

Gardai will be allowed to take mouth swabs or hair follicles from convicted criminals and criminal suspects so that DNA profiles can be created and entered onto the database to check for possible matches against crime scene samples.

As well as sex offenders, most of the samples taken will be from suspects arrested in connection with serious offences carrying sentences of five years or more."

Some officials around the country say they’re struggling to handle an avalanche of monitoring alerts from electronic ankle bracelets.

Though the bracelets have been used to track offenders’ whereabouts for more than three decades, the monitoring alerts they’re struggling to track are often nothing more sinister than a dead battery, lost satellite contact or someone arriving home late from work.

The Associated Press asked hundreds of correctional agencies about their monitoring policies, and found how they handle alerts varies."

John Cooper QC And Prof. John Fitzpatrick, On Law - 2008

Battle of Ideas: Too Many Laws?

Speakers: John Cooper (00:05:34 to 00:18:04), Prof John Fitzpatrick (00:18:10 to 00:28:45).

Chair: Tessa Mayes

"In recent years British society has become increasingly litigious.

Both the government and the public increasingly turn to the law to resolve problems.

Prime Minister Gordon Brown has beaten even his predecessor's record, introducing 2,823 new laws during his first year in office. This is the highest record for law-making by anyone at Number 10, and 40% higher than the annual average created by Margaret Thatcher.

Meanwhile, disputes between neighbours, and often trivial harassment cases, are increasingly likely to come to court. This legalistic approach to social and political problems is causing disquiet, however. Critics question whether fines or imprisonment are always the answer to interpersonal problems.

Questions are being raised about the impact new laws are having on British justice, and the individuals' relationship to the state and to each other.

The use of the law for political ends is also said to be corrupting the criminal justice system, with the abolition of double jeopardy (so that the accused can now be tried twice), proposals to increase the detention without trial of terrorist suspects to 42 days and the rise of race and religious hate laws.

A drive to increase the conviction rate in cases such as rape, the increased prominence of the victim in harassment law and the trial process are also attracting criticism as well as support. Are we overburdening the law with social and political problems, and undermining it in the process?"

Jim Killock Plays It Diplomatically

"You don't want to criminalise people, unnecessarily ... you got be careful, when you criminalise people, if they're not doing harm to, to anyone else."

"Child abuse images [sic] ... which, we all [sic] agree, should be illegal, are illegal and must be combated."

Jim Killock, Executive Director

"Since joining Open Rights Group in January 2009, Jim has led campaigns against three strikes and the Digital Economy Act, the company Phorm and its plans to snoop on UK users, and against pervasive government Internet surveillance. He is working on data protection and privacy issues, as well as helping ORG to grow in size and breadth. He was named as one of the 50 most influential people on IP issues by Managing IP in 2012. In the same year ORG won Liberty's Human Rights Campaigner of Year award alongside 38 Degrees, for work on issues from copyright to the Snooper’s Charter."
