Consensual child sex ruling looms
"Kissing, hugging and cuddling - innocent acts between children or sexual acts which could lead to their being arrested?
The Constitutional Court is to hear a case on Thursday to confirm a court ruling that the law should not make it a criminal offence for children aged 12 to 15 to have consensual sex.
In January, Judge Pierre Rabie ruled in the Pretoria High Court, that certain sections of the Sexual Offences and Related Matters Amendment Act were invalid. His ruling had to go to the Constitutional Court to be confirmed and has been set down for Thursday.
It has been hailed as a victory for children’s rights as children would not be criminalised for normal activity.
The sections in question make it an offence for children 12 to 15 to engage in consensual sexual acts, including kissing and light petting."

Sex with girl below 18 is deemed rape
"With the government notifying rules under the Protection of Children from Sexual Offences Act 2012, any sexual encounter with a person below 18 will be deemed rape whether it is with or without consent.
Till now, sexual offences were covered under different Sections of the Indian Penal Code. The new law was passed in May 2012 to strengthen legal provisions for the protection of children from sexual abuse.
The act has precise definitions for different forms of sexual abuse. It provides for stringent punishment, graded according to the gravity of the offence, up to rigorous imprisonment for life for certain offences, and a fine. The amendment is in consonance with the country's commitments towards the Juvenile Justice Act, 2000."

Instead of disposing of a superfluous, largely powerless and discredited body, the government has given it a new lease of life, new powers and a stronger voice to criticise government. Not only has the coalition lost an opportunity to save the taxpayer £3million pa, it has - whilst almost certainly ensuring that the quango's budget will continue to grow - also generated additional, unquantified, cost to taxpayers by giving the OCC power to make new demands on the public sector in response to its findings."

As Jill Kirby asked in her incisive blog on Conservative Home yesterday, “Would Michael Gove, if acting alone, have appointed John Dunford (a vocal opponent of free schools) or succumbed so readily to the “children's rights” lobby? Wouldn't sheer common sense have informed him of the fallacy of assuming that one man (or woman) should have the power to speak for 11 million children?”"
