The Challenge For Andrew and Dr Powell

Here is the challenge, Dr Graham Powell (even though, you did turn to The Dark Side, which actually explains your back-peddling).

As Mr Wright's (and other) publications, continue to cause harassment, anxiety and distress, the endangering of lives and the wasting of much police time, it appears clarification and correction are now essential.

Even though ignorance is no defence, to many offences, we are reasonable people.

It should be made clear, Dr Oldfield has served his time (and more) and need not justify his position to anyone; none of us are defined by our past. However, it is obvious, that many people, simply, do not understand what the legal and societal issues are, in such cases.

Of course, many are, simply, dangerous, greedy and malicious - or a combination, thereof.

Well, it really is not that simple, it all depends on what you mean by 'sex offender'. This has been clarified, here.

There are graduations - really? - Excellent.

An unrepentant one. He is the man behind The OSC (Online Sex-Offender Community) the Twitter account and blog I wrote about earlier this week. He served 12 months in jail for downloading over 11,000 indecent images of children including babies in 2002. Though there are nests of pro-abuse activists online, Oldfield is isolated. He runs a “community” in name only. I am told by those who have studied this sick subculture that even some paedophiles consider him an embarrassment.

The pseudo-intellectual Oldfield is a former chemistry teacher. He styles himself as “Dr Nigel Leigh Oldfield” and has popped up several times on national radio and television. His most notable appearance was on Newsnight in 2007 pompously defending his repellent views. Over and over again he made excuses for viewing images of children being abused. He is the ugly agony uncle of the online child sexual abuse community giving tips on avoiding prosecution and defending the indefensible.

After I wrote about Oldfield and his activity on Twitter, he posted information about me on his latest blog. It is not the first he has run on the topic of defending child sex abuse. Previous sites have been shut down by ISPs. However, he currently has at least three up and running. A quick search also throws up numerous forum posts in which Oldfield defends child sexual exploitation. Here’s one example from a Google Group where he expresses disbelief that a convicted sex offender should be stopped from photographing children in the street. On YouTube, he has posted videos where he complains about the persecution of sex offenders, “isolated and poverty-stricken for no good reason”.

Now, on his OSC blog, where he obsessively documents media reports on child sexual abuse, he has posted: my picture, links to my Twitter account, my personal blog, my online CV and screen grabs of my original article shared on Facebook. The post assures me that I am “small fry” but that I can expect a “full and frank response – when we have finished with bigger and more essential issues”. Given his past record, I won’t pause to imagine what those could be. He’s certainly had time to boast about his renewed notoriety on yet another Google Group.

I don’t believe in naming and shaming sex offenders or in vigilante actions. I don't want these individuals pushed underground and out of sight. However, Oldfield names and shames himself. Across the internet, he is active in promoting abuse and attempting to dismiss the harm it causes. I have seen the flabby banal face of evil in a YouTube video. This is who the Prime Minister is trying to combat with his current proposals, the kind of offender so thoroughly certain that it is he who has been wronged. Oldfield thinks he is the one sane man in society. He luxuriates in being written about. Ultimately he is “small fry” himself but deeply unpleasant all the same. I know Nigel intends me to feel threatened but I’m not in his usual demographic.

"A 13-year-old sexual predator? No. I encountered the real deal last night"

NW is 41 years old. He took a 13-year-old girl home, allowed her to strip and then engaged in what we must euphemistically refer to as a “sex act” with her. For this and other offences including the possession of eight images of child sexual abuse and eleven sexual images involving horses and dogs, he received an eight-month suspended sentence. But it’s not the lenience of the punishment that has pushed the case into the headlines. It's the comments of the prosecutor and judge.

The Crown Prosecution Service has disavowed the words used by prosecutor Robert Colover at Snaresbrook crown court as “inappropriate”. That’s far too mild, almost offensively so. Colover told the court: “The girl is predatory in all her actions and she is sexually experienced.” His Honour Judge Nigel Peters said in his judgment: “On these facts, the girl was predatory and was egging you on. That is no defence when dealing with children but I am prepared to impose a suspension.” This should go without saying, but in an encounter between an adult man and a girl of 13, the child is not the predator. Regardless of whether she has been sexualised, she is a victim.

I hadn't thought a great deal about this case before I came into contact with a real predator last night. Popping up in the middle of a conversation on Twitter about my bullying piece, someone called “the OSC” revealed himself (or, less likely, herself) to be a fervent defender of paedophiles. Not only does this individual have a Twitter account dedicated to obsessively pushing distorted views about children, he also has a blog. One which has been relentlessly updated since April 2012. I've since discovered that OSC stands for "Online Sex-Offender Community".

I’m flagging up this particular example not because it is rare or unusual but because there is a whole network of these sites and accounts across the web. Those who identify themselves as part of the Online Sex-Offender Community are brazen. Their behaviour justifies the scepticism I and many others have shown towards David Cameron’s internet filtering proposals.

One of the measures put forward the Prime Minister and his dotty surrogate on the issue, Claire Perry, is a pop-up to tell those who seek child abuse images that they risk their jobs, their lives and their families by doing so. The existence of sick individuals such as the OSC, operating in the open on social networks, puts paid to the notion that these people can be shamed. Among the OSC’s messages about the Wilson case there are several references to the girl as a “Lolita”.

The existence of these dangerous individuals is the reason we need to spend more money on traditional policing and investigations. It’s also why charities such as The Lucy Faithful Foundation, which works to prevent abuse and deal with offenders and potential offenders, are so important. The brashness of the OSC is yet more evidence that desperately clutching at technical solutions is not the way to deal with this evil.

Government again uses paedophile paranoia to justify Internet snooping Law

On the day the beleaguered Child Exploitation & Online Protection agency (CEOP) has led nationwide arrests for downloading child porn, had only this morning released a report effectively asking for more money, warned of a connection between child porn and ‘contact offending’ and had released a ‘dramatic’ video showing a raid on a porn suspect’s house, it was no coincidence that the Home Secretary, Theresa May also confirmed that she would push ahead with laws to monitor everyone’s email and Internet usage, citing ‘paedophiles’ as one of the main excuses for doing so.

It is perhaps not surprising that CEOP is making such a noise as despite protestations, it will soon be consumed by the new National Crime Agency, something it has been fighting against for years.

TheOpinionSite.org suggests that all these events, actions and announcements have been deliberately coordinated; designed to lend weight to the government’s new, highly intrusive, Internet – snooping laws and to con a trusting public into believing that they are necessary when in reality, they are not."

Sex offenders demand Facebook access

"Registered sex offenders are fighting against legal rulings in the US which ban them from using social networking sites, such as Facebook.

The number of offenders challenging the ban is unknown, but legal cases are being mounted by people across Indiana, Nebraska and Louisiana.

They claim that the restrictions – which stop them from joining social networks, online chartrooms and instant messaging forums – are infringing their free speech and right to participate in common online discussions.

Sites such as Facebook and LinkedIn have recently altered their policies to reflect their support of banning these offenders from their sites – where people freely upload images of themselves and children on an hourly basis.

However, civil liberty groups say social networks like Twitter and Facebook are now “virtually indispensable to free speech”.

US authorities have stood by the bans – saying they are needed to prevent these registered sex offenders from roaming free online and preying on children using these sites – often without their parents’ knowledge.

Judges in the UK typically stipulate that convicted sex offenders are no longer allowed onto social networks – as part of their punishment. However, more is still needed to be done in enforcing these bans ... [we will cover this issue, below]

The OSC has contacted Facebook, on a number of occasions, so as to discuss their Terms of Service etc; we have received no reply.

This is the position of The OSC, on this issue:

"Apart from a small, single number ... every sexual offence/attack/potentially-illegal action (i.e. hundreds/thousands worldwide), involving Social Networking sites, has been carried out by non-'RSO's, almost exclusively by minors, themselves.

A community, whether on-line or off, includes all its members. All members have equivalent legal, Human and civil rights to that membership and enjoy the right to a private life and the enjoyment of it, free from offence, fear and harassment.

Free Speech must be balanced against these rights. There are many people who believe their right to Free Speech is absolute; this is not correct. However, we do believe it should be enabled, as much as is reasonably possible.

The other fundamental requirement, is being able to monitor and report offensive, and potentially-illegal content, carried out against registrants etc, on these sites; we do this, regularly, in assisting the authorities.

Free Speech rights must be allowed and be proportionate, and the creation of scapegoats and pariahs, for no good, evidenced-based reason, is no such response."

Ms Barnett is, clearly, confused, about the nature of the need to register under the SOA 2003, and that many, if not, most, of the people who do so, are no more of a threat to society than those who do not.

She also seems ill-informed, on the requirements and nature of SOPOs, and the frequency of such 'bans'; we hope she will respect our contact, so as to clarify her confusions.

Registered sex offenders have no right to be on Facebook

However, we are still far from a world where the judiciary and police have caught up with monitoring adult abuse and child grooming online pre-emptively – before it goes too far – and as well as they do in the real world.

Equally, while the Government remains undecided about whether filters to protect children from inappropriate content online should be mandatory – we are still missing vital legislation to proactively protect our children and vulnerable adults online from invisible predators. {the legislation exists and is clear, if disproportionate to civil rights]

Registered sex offenders [sic] should never be allowed on social networks where people freely use their profiles as digital scrapbooks of their lives – frequently sharing photos of their babies and themselves on nights out potentially dressed proactively [whyever not, is it the 'Paedo-Stare-Of-Doom', which concerns you?] 

They do not have the right [sic] to participate in an open network online – where many children under the age of 13 have set up identities without their parents’ knowledge – just as they cannot mix openly in society offline [we are sorry, what was that? -  we cannot mix openly with minors offline? That is certainly 'news' to us]

The rules protecting children [sic] and curbing the freedoms [indeed] of registered sex offenders [sic] in the real world must be rigorously upheld in the virtual world if our digital-savvy society is to function healthily. [they are, in fact, as the courts are beginning to show, too much so]

It is the duty [sic] of the social networks, governments, the judiciary and police, in all countries, to work closely together to keep registered sex offenders and other harmful people [sic] away from these very open and welcoming online forums.
