"The new censorship typifed by the Paul Yore child pornography accusation is a symptom of the lack of respect for cultural freedom and creative expression, also felt by musicians.
Yore's works, including an installation Everything’s Fucked featuring a young Justin Bieber directly above a urinating dildo, were seized by Police at Linden Contemporary Arts Centre last week following a complaint that they constituted child pornography.

Most child sex offenders have multiple victims
"An astounding [sic] 93 per cent of child sex offenders [sic] have more than one victim, while 23 per cent abuse 10 or more children, psychologist Sandra Ifrah told parents attending workshops on ‘Parenting Safe Children’ held recently in Melbourne.

These statistics [sic] underscore the importance of reporting all cases of child sexual abuse to the police as abusers are extremely likely [sic] to repeat their crimes and/or to have abused other children in the past. “The seven per cent with only one victim is mainly because they got caught the first time,” Ms Ifrah said.
Studies [which?] have found that approximately one in three girls and one in six boys will be sexually assaulted before they turn 18, with a quarter of all victims aged under nine and 37 per cent aged 9-12. Eighty per cent of offenders are known to victims – a family member, family friend or other person of trust – and they are of all ages, academic levels and socio-economic statuses. Many [sic] are charismatic and seek out employment and activities that provide them with easy access to children, Ms Ifrah said. The over-whelming majority (98 per cent) are male but it is important to note that some abusers are female. Up to 50 per cent are minors, under the age of 18"

Whistleblower cop axed, abuse probe told
"Whistleblower Peter Fox lied about forgetting to bring abuse victims' statements to a meeting.
Police whistleblower Peter Fox has told an inquiry he breached an order not to contact a Newcastle journalist who had information about child sex abuse.
Whistleblower cop Peter Fox was axed from investigating alleged child sex abuse by priests in the NSW Hunter region, despite his protests that victims had been through hell and he'd promised them he'd follow through.
Subsequently, he breached an order not to contact a journalist because he felt it was a sinister move designed to sabotage the investigations.
Detective Chief Inspector Fox, who has alleged a "Catholic mafia" of police and others tried to cover up the clergy's pedophilia in the NSW Hunter Valley, told an inquiry in Newcastle on Tuesday he was ordered off the case at a "hostile" meeting in December 2010.
Superintendent Max Mitchell, now an assistant commissioner, had made it clear to him that he would have no role in "any way, shape or form" in a new investigation.
But Insp Fox said the new probe was a sham he believed was "set up to fail", and the meeting confirmed his suspicion that some senior police were effectively trying to "sabotage" the investigations.
He said Supt Mitchell told him to hand over all statements and documents, which he did, and to have no further contact with Newcastle Herald journalist Joanne McCarthy.
But he said Ms McCarthy had more information than police and her input was the "genesis" of the whole police inquiry.
He breached the order not to contact her by sending her an email that night in which he outlined his removal from the case and said "the pricks can shove it".
"I make no apology for it," he told the inquiry."

Police called on grandfather who took child swimming
"A Sydney man whose granddaughter took off her clothes for a spontaneous swim at the beach was alarmed when the police arrived to investigate.
Seventy-year-old Leo (who chose not to disclose his surname) told Fairfax media he was babysitting for the girl's parents at Balmoral Beach when six-year-old Emma decided to go for a swim.
"She didn't stop beaming from the time she got in to the time she got out," he said.
But shortly after helping his granddaughter get dressed, Leo was approached by police.
"They wanted my name; they took my identification. They also talked to Emma and asked her name and date of birth. They informed me a complaint had been lodged."
Police quickly established that the situation was innocent, but the girls' family told the Sydney Morning Herald they wished the anonymous complainant had approached Leo personally, rather than going to the police."

Judge blasts failures of sex offender support
"A Supreme Court judge has delivered a scathing criticism of the lack of support services and accommodation options for dangerous sex offenders in the community, which left him no choice but to detain a schizophrenic paedophile in jail indefinitely.
Justice John McKechnie, who is in charge of the court's dangerous sex offender list, called for ministerial intervention and said there was "far too much reliance on the stretched and limited resources of the private sector to overcome deficits within government services".
In a judgment handed down yesterday, Justice McKechnie said the State's failure to meet its obligations was rendering the court's discretion "illusory" and could compromise protection of the community.
Imposing an order for the continuing detention of Anthony John Alvisse, who has spent nearly twice his original sentence in indefinite custody since finishing a jail term in 2006, Justice McKechnie said the failure of government departments to secure suitable accommodation for the past seven years had left him no option.
An annual review of Alvisse's order was done last month.
Alvisse has a long history of child sex offences and was last jailed for three years and four months in 2003 for sexually assaulting a teenager.
He was released under strict supervision in December 2006 but was locked up in February 2007 after he called triple-0 confessing he was a sex offender and wanted help "because he felt as if he wanted to offend again".
Justice McKechnie said the first attempt to release Alvisse into the community failed because the accommodation he had was inadequate "leaving him alone too often, a prey to loneliness and boredom""

Effective (and Ineffective) Treatments for Sexual Offenders
"Are Sex Offenders Treatable?
Last week I wrote about clinician prejudice toward sexual offenders. As part of that writing I introduced the four main categories of sexual offenders:
>Violent offenders
>Fixated child offenders
>Regressed child offenders
>Sexually addicted offenders
I also mentioned the some of the most damaging misconceptions that most people, including many psychotherapy professionals, have about sex offenders.
>All sex offenders are treatable.
>No sex offenders are treatable.
>All sex offenders are sociopaths
None of these beliefs is correct. The reality is that most but not all sex offenders can benefit from proper treatment. In fact, the recidivism rate is actually quite low, provided the offender is paired with the most effective form of treatment. It’s all about good assessment and knowing who needs what and when."

Clinician Prejudice Toward Sex Offenders A couple of weeks ago my colleague Jenner Bishop posted an open letter on the IITAP (International Institute for Trauma and Addiction Professionals) listserv about clinician prejudice toward sex addicts and sex offenders. Jenner had just come from a “suite meeting” for an office she’d recently rented, at which she’d been bombarded with angry questions from the other therapists about how they were supposed to protect their clients from her “unsupervised” sex addicts and offenders. She had explained that she doesn’t work with violent offenders, and that the offending behaviors of her clients were typically something along the lines of hiring prostitutes and/or looking at illegal pornography – which the other therapists’ clients were probably also doing, even if the therapists weren’t aware of it – but Jenner’s fellow professionals just wouldn’t let it go.
She writes:
"I was shocked. Eventually someone admitted that – despite the landlord sending around an advance email informing tenants the potential new renter is a Certified Sex Addiction Therapist – they wish they’d further investigated what a CSAT does, because they’d have informed the landlord that my practice is incompatible with theirs. You know, I just forget. We’re on the front lines of healing such a grossly misunderstood population. And it’s not just the masses, it’s fellow clinicians with these massive prejudices and blind spots.""

Sex register gets 500 hits a day
"The public sex offender register has been visited an average of 500 times a day in the six months since it went online, WA Police statistics have revealed.
But only four requests have been lodged by parents or carers seeking information about adults who have regular unsupervised contact with their children.
No details published on the website have led to information from the public which helped police find offenders who failed to comply with reporting requirements.
Sex offender management squad officers are not aware of any charges relating to vigilante behaviour. [not aware of charges, oh, nothing must have happened then ... also, early days, yet]
The statistics, which do not indicate whether visits to the website have tapered off since its launch, could include multiple visits to the website and requests for information by the same people.
The register includes three tiers that provide varying levels of access and information about different categories of child sex offenders. Legislation introduced with the register also includes penalties for vigilante behaviour and re-publication of information from the website.
Police Minister Liza Harvey said despite claims by critics of the website that it would lead to vigilante behaviour and a flood of inquiries about the sex offender status of individuals, the public had behaved responsibly in the use of the website.
"The high level of traffic and inquiries about paedophiles [sic] in their locality indicate that there is a strong public interest in information about absconded, serious and repeat offenders being made public," Mrs Harvey said.
"Given that research has shown [which?] that access to such resources increases the likelihood of parents engaging in protective behaviours with their children [fear], this is a victory for common sense and community safety."
But shadow police minister Michelle Roberts said the statistics, which indicated only a small proportion of WA residents had used the site, did no more than confirm a high level of anxiety in the community about sex offenders. She called for a random survey of visitors to the website to determine the use and effectiveness of the information provided.
Mrs Roberts said vigilante behaviour had been prevented because the legislation and register were significantly different from the election promise of the Liberals in the lead-up to the 2008 poll."

Weekend jail for pair who beat man over phantom child porn
"Two men who viciously beat and robbed a friend after accusing him of possessing child pornography will spend their weekends in jail for the next year.
Matthew James Hood pleaded guilty in the ACT Supreme Court to aggravated robbery and property damage and was ordered to serve one year of periodic detention.
Co-offender Matthew James Burge, who also faced four charges of burglary and theft from separate incidents, pleaded guilty and was slapped with one year of periodic detention.
In February, Hood, 20, and Burge, 21, went to the man's Calwell home after drinking at a nearby club.
The court heard the trio watched television and smoked cigarettes before discussing pornography.
The complainant, a 54-year-old man, mentioned he had recently downloaded some pornography and invited the pair to view it on his laptop.
Burge did so and began accusing the older man of having images of underage girls on the computer.
A subsequent police check of the injured man's laptop computer revealed no images appearing to be child pornography.
The pair then proceeded to attack the other man, kicking him repeatedly in the head and chest. {must have been very disappointed]"

Australia's mandatory ISP filtering plan axed
"Telcos to filter child abuse material via INTERPOL block list.
The Federal Government has formally abandoned plans to introduce legislation for mandatory ISP filtering, closing a dark chapter in politics concerning Australia's internet.
Instead, internet service providers will be directed by the Government and the Australian Federal Police to block "child abuse websites" that feature on an INTERPOL block list [oh, that will be useful, then].
Communications Minister Stephen Conroy said in a statement that "Australia's largest ISPs have been issued notices requiring them to block these illegal sites in accordance with their obligations under the Telecommunications Act 1997".
"The Australian Federal Police will now begin issuing notices to smaller ISPs and will work closely to assist them in meeting their obligation under Australian law and prevent their services being used for illegal activities," Conroy said.
"Given this successful outcome, the Government has no need to proceed with mandatory filtering legislation.""

There are a couple of convicted murderers living in the same suburb as I do. I know, because I’ve seen them. There are probably a few in your suburb, too. Maybe even your street. After all, almost all of them do eventually get out, and they have to live somewhere.
Like dozens of others convicted of that crime all over Australia, they do their time, satisfy the prison authorities and the Prisoners Release Board what used to be the Parole Board that they are ready to be released, and quietly merge back into society.
Usually, you hear no more from them or about them. They don’t go on some special internet register where everyone can see what they look like, what their crimes were, or where they live.
It’s the same with convicted drug dealers. They do their time and assimilate back into the community. There is no restriction on them living or working anywhere at all. They can change their names or their appearance. And, just like the murderer, you would never know."
"But in the wrong hands this sort of information has the potential to be extremely dangerous. The potential for vigilantism is obvious, as is the potential for mistaken identity. The experience with these registers in the US has included deaths and gratuitous violence, as well as payback measures such as graffiti and molotov cocktail bombings. There is no reason to think it won’t happen here.
Given the downside of this sort of exercise in naming and shaming, and the comparatively limited benefits of it if any you have to think of it as just another cynical exercise in political opportunism by the government a gratuitous attack on those marginalised groups in the community who are universally abhorred.
The experiment is likely to be a real crowd pleaser, but it’s hardly likely to have any impact on the problems that it purports to address."

"An appeal court has overturned a decision allowing the partner of a convicted sex offender to receive IVF treatment.
A Victorian tribunal failed to consider the best interests of a child when it allowed a convicted sex offender and his wife access to IVF treatment, an appeal court has found.
The Victorian Civil and Administrative Tribunal (VCAT) last year granted the couple access to the fertility treatment despite the husband having been jailed for sexually penetrating a 16-year-old girl who had a cognitive impairment.
The VCAT ruling overturned a decision by the Patient Review Panel to deny IVF treatment to the woman and her 34-year-old partner, referred to as ABY.
On Friday, in what Victorian Chief Justice Marilyn Warren said may be considered a test case, the Victorian Court of Appeal ordered VCAT to reconsider its decision, saying it failed to apply the proper legal test.
Chief Justice Warren and Justices Pamela Tate and David Beach said the correct test that should have been applied was whether it was in the best interests of the child born from the treatment.
They said these include matters affecting his or her physical, sexual, emotional and developmental wellbeing."

Man freed in indecency case says paedophiles [sic] ‘need hanging’
"It was meant to be the holiday of a lifetime for the man flying to Australia to meet a family he befriended on Facebook.
But it turned to a living hell as he was thrown behind bars, rubbing shoulders with serial killers and rapists, in Yatala Prison.
The former factory worker had tried to look up an old friend on Facebook.
A twist of fate saw an Australian woman come forward as her son shared the same name. She befriended him and two years later tempted him into flying 24,000 miles for a holiday.
Instantly his internet “friends” borrowed 140 dollars here and 180 dollars there.
He said: “I arrived with 1400 dollars (currently about £900) and by day four I had 23 dollars to my name.”
He joined the family on March 25 last year and six days later police arrested him for allegedly indecently assaulting their teenage boy and ‘grooming’ him.
The man was freed in May this year at the end of the trial in which a relative of his accusers sprang to his defence and gave evidence. The family would have won 177,000 dollars for the boy following a conviction and could have sued him personally for 150,000 dollars.
The man is clear on what he thinks of child sex offenders and says: ”I think they need hanging.”
Prison was hell."

Man freed in indecency case says paedophiles [sic] ‘need hanging’
"It was meant to be the holiday of a lifetime for the man flying to Australia to meet a family he befriended on Facebook.
But it turned to a living hell as he was thrown behind bars, rubbing shoulders with serial killers and rapists, in Yatala Prison.
The former factory worker had tried to look up an old friend on Facebook.
A twist of fate saw an Australian woman come forward as her son shared the same name. She befriended him and two years later tempted him into flying 24,000 miles for a holiday.
Instantly his internet “friends” borrowed 140 dollars here and 180 dollars there.
He said: “I arrived with 1400 dollars (currently about £900) and by day four I had 23 dollars to my name.”
He joined the family on March 25 last year and six days later police arrested him for allegedly indecently assaulting their teenage boy and ‘grooming’ him.
The man was freed in May this year at the end of the trial in which a relative of his accusers sprang to his defence and gave evidence. The family would have won 177,000 dollars for the boy following a conviction and could have sued him personally for 150,000 dollars.
The man is clear on what he thinks of child sex offenders and says: ”I think they need hanging.”
Prison was hell."

WA sex offender website to go live
"Western Australia is leading the way in publishing information about known sex offenders released back into the community, with a new website to be launched this week.
The Community Protection [sic] Website will go live online on Monday and provide the public with photographs and certain information on the state's most dangerous and serious repeat sexual offenders.
The website has been divided into three tiers for different types of offenders.
Tier one is for sex offenders who have gone underground and do not comply with their reporting obligations.
Information will include a photograph, date of birth, physical description, name and known aliases.
Tier two is for repeat or highly dangerous sex offenders and people can make a request to be given the photograph of an offender living in their postcode and adjoining postcodes.
Tier three will allow guardians to make a request regarding a specific person who has regular unsupervised contact with their child.""

The Sext Files: ‘these people are not serious sex offenders’
"Current sexting laws mean young people are winding up on the Sex Offenders Register who shouldn’t be there, some legal experts have told a parliamentary inquiry. Swinburne University students Dimity Hawkins and Simeon Barut investigate as part of Crikey’s series The Sext Files.
Victoria’s Sex Offenders’ Register is out of control because of a flood of sexting offenders being compulsorily added to the register, legal experts say.
“The register originally was set up to monitor serious threats to the community,” James Dowsley, co-chair for the criminal law committee at the Law Institute of Victoria, told Crikey. “Those resources are now being stretched to monitor thousands of people on the register that we say ought not be on it.”"

Man charged for child, women beach photos
"A 35-year-old Maylands man is facing charges after allegedly photographing young women and children at Cottesloe beach last weekend.
Police allege the man took a series of photos while young women and children were sunbaking and emerging from the ocean between 10.30am and 10.50am on Saturday.
It is alleged the man used a zoom function to photograph their breast and groin areas without their knowledge.
Police claim the man struggled and refused to give them his camera before being arrested.
He was charged with one count of indecent acts in public and one count of obstruct police and will be summonsed to appear in court at a later date."
