Viewing images of child sexual abuse is child sexual abuse.

"We were horrified by the comments of Simon Bailey, Chief Constable of Norfolk police & the Association of Chief Police Officers’ lead on child protection and abuse investigations in the Guardian this morning suggesting that men who look at images of children being sexually abused, raped and tortured were “not all were an immediate threat”.

Men who look at these images or videos online PAY to do so fueling an industry which is based on the sexual exploitation and torture of children. No one “accidentally stumbles” on images of child sexual abuse, rape and torture. They have to search for these images and, then, they pay for them. This is without getting into the issue of “pay-per-view” child sexual abuse where men pay to watch another man torture a child live.

Images of children being sexually abused, tortured and raped are a growth industry because men PAY to see these images and videos. They look at the images knowing the children are being abused. They look at them because they don’t care. They believe they are entitled to watch these images of children being tortured – some as young as a day old.

These men need to be held criminally liable for participating in the sexual exploitation, rape and torture of children.

It’s incredibly frighting that the ACPO lead on child protection and abuse investigations doesn’t get this – that he confuses paedophilia, a psychological condition which very few have, with the vast majority of perpetrators who CHOOSE to sexually abuse children. And, that Bailey doesn’t understand that those who are clinically diagnosed as paedophiles are still making a choice.

We suggest that ACPO sign up Bailey and all of their members for some proper training on child sexual exploitation from an organisation who understand that viewing images of children being sexually abused, raped and tortured is a crime. That these men are financially supporting an industry which is based entirely on the rape, sexual abuse and torture of children."

Innocent man commits suicide after paedophile accusation

"GS, 56, "became a hermit" after the allegations of sexual abuse of a young girl more than 20 years ago

A man falsely accused of historical child abuse leapt to his death from a bridge, an inquest heard.

GS, 56, was accused last November of sexually abusing a young girl more than 20 years ago.

Police exonerated him but the dad-of-one became depressed.

His brother Michael told the hearing in Hull: “He became a hermit.”

Mr S, who lived in Hull city centre, left a suicide note before jumping from the Humber Bridge in June.

Verdict: Suicide."

Restricted Group Speaks Up, Saying Sex Crime Measures Go Too Far

"Jason Shelton, at home in Encinitas, Calif., has been unable to find work since serving time for a sex offense. “All I want is a job,” he said.

LOS ANGELES — Larry Neely looked out across the expanse of an airport hotel conference room that usually holds conventions of labor unions, political groups or business executives.

On this day, though, the chairs were filled with dozens of people who, like Mr. Neely, have had to register as sex offenders.

Mr. Neely, who pleaded guilty to multiple counts of sexual indecency with a child dating to 2003, said that at first, “I was terrified; I was hiding, hoping to stay under the radar.”

Across the room, men in the crowd nodded.

As local and state governments have imposed tough penalties for sex crimes in recent years, including restrictions on where sex offenders can live or even set foot, members of this highly stigmatized group have begun to fight back.

A few weeks ago, more than 100 people — sex offenders, almost all of them men, along with wives, girlfriends and mothers — came from around the country to “Justice for All: A Conference to Reform Sexual Offense Laws.”

They and others have formed associations and are holding conferences like this one to argue that a wave of legal penalties and restrictions washing across the country has gone too far. They hope to convince judges, lawmakers and the public that indiscriminate laws aimed at all sex offenders are unconstitutional and ineffective.

Over the last few years, Mr. Neely has overcome his fear and taken on a decidedly public role: He has become an advocate for sex offenders’ rights. At the conference, he urged others to speak up."

Is It 'Very Offensive' for Sex Offenders to Demand Just and Sensible Laws? 

"As further evidence of the shallow thinking behind the indiscriminate crackdown on sex offenders, consider Schroeder's take on the debate about recidivism: "The pro-sex-offender lobby likes to bandy about percentages, as if even 1 percent is acceptable." Actually, it is the supporters of ever-harsher laws who like to bandy about percentages, claiming that sex offenders should be treated as an especially worrisome class of criminals in part because they are especially likely to commit new offenses after they've served their sentences. Since the evidence suggests that is not true, surely it is relevant to say so. Questioning hyperbolic claims about recidivism hardly amounts to saying recidivism is "acceptable."

"CONCERNS for children’s safety have been raised after several school bus drivers were found not to have the relevant CRB [sic] checks.

The services of two coach operators for Stockton Council have been withdrawn after spot checks on school runs found five drivers did not have the appropriate criminal record check.

A spokesperson for Stockton Council said: “The safeguarding of all our children and young people is of paramount importance to us and that’s why as a matter of routine we frequently carry out spot checks on all coach and taxi drivers which operate on our school routes.

“All school coach drivers must have relevant CRB [sic] checks in place and this is a condition of the contract they have with the council."

Bus driver admits sexually assaulting girl at back of vehicle

"Bus driver: CF admitted the charges.

A bus driver is facing jail after he admitted putting his bus out of service and having a sordid clinch at the back of the vehicle with a 14-year-old girl. CF, 32, has been placed on the sex offenders register after he was spotted kissing the young girl [sic] at the back of the number 17 bus he was driving after he pulled over and put the bus out of service.

Man accused of trying to touch children at rec facility

"Police are investigating a man suspected of approaching and trying to sexually touch children at a recreational facility in Salem.

A Salem Police Department news release said G "is believed to frequent places where children are present" and try to sexually touch them.

Investigators said G hasn’t abused any children, but worry he may cross the line in the future.

The rec center has security restrictions in place, one of which is running names of visitors through an online national predator database.G was not listed in the database, officials said."

Criminal record checks to be relaxed

"CRB information file Civil liberties groups are expected to welcome the judgement

Thousands of job applicants will no longer have to face their criminal past being disclosed to employers, under changes announced by the Home Office.

Old and minor cautions and convictions will be filtered out of the information revealed in applications for jobs in England and Wales.

It follows a Court of Appeal ruling in January that blanket checks did not comply with human rights laws.

All serious violent and sexual offences will continue to be disclosed.

Under the proposed legislation, convictions resulting in a non-custodial sentence will be filtered from record checks after 11 years for adults and five and a half years for young offenders.

Cautions will be filtered from record checks by the Disclosure and Barring Service (DBS), formerly known as the Criminal Records Bureau, after six years for adults and two years for young offenders."

Police cautions lead to a 100-year criminal record that can wreck prospects of getting a job or going to university

"Growing numbers of people are being turned down for jobs and university places because they accepted police cautions for minor offences without realising they would give them a criminal record.

New figures show that cautions showed up on 153,000 Criminal Records Bureau checks carried out last year, allowing employers to stop candidates working with children or in health and social care.

Young people caught shoplifting or taking part in drunken pranks are agreeing to sign the statements in the mistaken belief they will be wiped from databases after a few years, not realising that they remain on file until they turn 100."

"Dozens of sex offenders and paedophiles [sic] in Lancashire have been let off with cautions, 
figures have revealed.

Figures obtained under the Freedom of Information Act show Lancashire Police gave out 68 cautions for sex offences in 2011.

Among them, 12 unconditional cautions, two reprimands and three warnings were issued for sexual assaults on a females aged 13 and over.

And one unconditional caution and three warnings were given out to people for sexual assault on females under 13-years-old.

One warning was given for sexual activity involving a child under 13 and a further two unconditional cautions were given for soliciting for the purpose of prostitution.

Figures from 2006 show that two cautions, eight unconditional cautions, one reprimand and six warnings were given out for sexual assault on a female aged 13 and over.

And for sexual assault on a female under 13-years-old there were two unconditional cautions and one warning.

Other figures for 2006 show that there was one unconditional caution for the rape of a female child under 13, one unconditional caution for sexual grooming and two unconditional cautions for soliciting for the purpose of prostitution.

The number of cautions, warnings and reprimands for all offences has reduced overall."

THE experience with sex offender registers in the US has included deaths and gratuitous violence, as well as payback measures

There are a couple of convicted murderers living in the same suburb as I do. I know, because I’ve seen them. There are probably a few in your suburb, too. Maybe even your street. After all, almost all of them do eventually get out, and they have to live somewhere.

Like dozens of others convicted of that crime all over Australia, they do their time, satisfy the prison authorities and the Prisoners Release Board what used to be the Parole Board that they are ready to be released, and quietly merge back into society.

Usually, you hear no more from them or about them. They don’t go on some special internet register where everyone can see what they look like, what their crimes were, or where they live.

It’s the same with convicted drug dealers. They do their time and assimilate back into the community. There is no restriction on them living or working anywhere at all. They can change their names or their appearance. And, just like the murderer, you would never know."

"But in the wrong hands this sort of information has the potential to be extremely dangerous. The potential for vigilantism is obvious, as is the potential for mistaken identity. The experience with these registers in the US has included deaths and gratuitous violence, as well as payback measures such as graffiti and molotov cocktail bombings. There is no reason to think it won’t happen here.

Given the downside of this sort of exercise in naming and shaming, and the comparatively limited benefits of it if any you have to think of it as just another cynical exercise in political opportunism by the government a gratuitous attack on those marginalised groups in the community who are universally abhorred.

The experiment is likely to be a real crowd pleaser, but it’s hardly likely to have any impact on the problems that it purports to address."

"Western Australia is leading the way in publishing information about known sex offenders released back into the community, with a new website to be launched this week.

The Community Protection [sic] Website will go live online on Monday and provide the public with photographs and certain information on the state's most dangerous and serious repeat sexual offenders.

The website has been divided into three tiers for different types of offenders.

Tier one is for sex offenders who have gone underground and do not comply with their reporting obligations.

Information will include a photograph, date of birth, physical description, name and known aliases.

Tier two is for repeat or highly dangerous sex offenders and people can make a request to be given the photograph of an offender living in their postcode and adjoining postcodes.

Tier three will allow guardians to make a request regarding a specific person who has regular unsupervised contact with their child.""

Innocent man tells of ordeal after false accusations

"Tony Holden who was found guilty of sexual harassment but has now been cleared

SEX lies threatened a man’s future when tongue-wagging gossips tormented him.

For months, neighbours taunted 38-year-old Tony Holden after he was found guilty of sexual harassment and was forced to sign the sex offenders’ register for five years.

But today, after Tony cleared his name and won an appeal against his conviction, he told of his ordeal and how he was haunted knowing he was innocent.

Officers stormed the Beehive Pub in High Bridge, Newcastle, in December, when he was accused of sexually touching a woman at a West End nursing home.

And since being found guilty at Newcastle Magistrates’ Court Tony has been subjected to cruel jibes.

He said: “It has been horrendous. I have had abuse in the street. People have called me everything. The police came to my house and said I must sign on the sex offenders’ register for five years. I couldn’t believe it. I was no risk at all.

“My life wasn’t worth living. I had to go to the doctors. It’s all I could think about. I was thinking about it morning to night.

“It ruined everything – my chances of getting a job.”"

"A PAEDOPHILE [sic] who sexually assaulted two young boys has been caught again [?] after he was spotted taking pictures of children at a karate club open day [and?].

TE, 37, mingled [!] with the likes of Basildon mayor Mo Larkin and MP Stephen Metcalfe at the Maru Karate Kai Club open day in Luncies Road, Pitsea in imnages captured by the Echo.

He was at the event in his role working as a volunteer for the Basildon Heritage Club and has been at several other events in the borough where children have been present [and?].

E was jailed in 2008 for sexually assaulting and grooming two young boys. He was also banned from being alone with or working alongside children [can you see where this is going?]

"Ken Porter, chairman and treasurer of the Basildon Heritage Club, said the organisation did not carry out criminal record checks on its members as it does not work “directly with children” although youngsters are often present at events where the group holds exhibitions."

"As well as being jailed, E was made the subject of a Sexual Offences Prevention Order, which banned him from working or being alone with children and possessing a computer for ten years.

The Maru Karate Kai Club is understood to have written to parents and complained to police after the truth about E came to light.

This followed concerns from parents who saw him taking pictures.

E was arrested on suspicion of breaching his order. He has been bailed until March pending further enquiries."

"The man, who the Recorder has chosen not to name, is staying in a Newham bail hostel but is free to return to the house he owns after serving eight years of a 15-and-a-half year sentence for abusing children.

Conservative Cllr Barry Oddy said: “Ideally this would not happen. The problem we have is that this person owns the property. If it was rented or leased it would be different.

“I am not comfortable at all with the situation but I am sure the safer neighbourhood team and local police will be checking on him.”

He added: “In an ideal world (in a Fascist world] there would be an exclusion zone around schools and playgrounds, but it would be challenged under human rights laws and those idiots (non-Fascists] in Europe [here] would go against it.”"

Abstract:

"The emerging war on sex offenders, as typical of wartime mentality, has been marked by substantial deviations from established legal doctrine, constitutional protections, and the rule of law. Because of a high level of panic among the general population about sex offenders the use of preventative detention for sex offenders has received little attention or scrutiny.

While the population of the detention facility at Guantanamo Bay has slowly decreased, the number of persons in state and federal detention centers dedicated to sex offenders has continued to climb. With the courts largely rubber stamping the federal civil commitment of sex offenders allowed under the Adam Walsh Child Protection and Safety Act (AWA) in 2006, the path has been cleared for an enormous expansion of sex offender detention.

Because of the limited attention given to these detentions, they represent a particularly dire threat to American liberties.

The normal societal and institutional checks against government abuse embodied in the media, public, Constitution, and courts have essentially been removed. We authorize government to detain indefinitely those who are deemed “sexually dangerous” at our peril.

Instead of waiting for someone to commit a wrong, the government acts to restrict liberty of persons who have yet to commit a wrong (but the government believes will likely do so in the future). The criminal justice system offers plenty of opportunities for the government to prosecute someone before harm is done using inchoate and conspiracy crimes.

To go beyond those already broad tools, the circumstances should be highly exceptional, the danger should be real and imminent, and the net should be cast narrowly.

In the case of sex offender civil commitment, the circumstances are no more dangerous than for other serious crimes, the risk is speculative based upon pseudo-science, and the net is far too broad.

Because of these aspects of sex offender civil commitment laws, America should fundamentally reconsider its approach to fighting sexual violence. Laws like AWA, premised on myths that allocate substantial resources in a never ending war, do not create a just or better society."

Scientific explanation of psychopathy cuts jail time

"Serial sex offender Raymond Henry Garland, considered one of Australia's most dangerous sexual predators, was officially diagnosed a psychopath last week. Psychiatrist Joan Lawrence told the Brisbane District Court that Garland had an "almost 100 per cent chance of violent reoffending." Garland has been dealt four indefinite sentences – but research out today suggests that biological evidence of psychopathy could alter the length of such sentences."

"It's usually up to the judge to decide what factors to balance at sentence, how they should be weighed and what evidence to consider, and that results in very varied sentencing," he says. "I think there should be less discretion involved in sentencing, although judges hate the idea."

For sex offenders, a new beard will require new photo

"Cuomo signs three new bills Wednesday

ALBANY — The state is implementing tougher laws and regulations for sex offenders, requiring the most serious offenders to get a new photo every 90 days if they change their appearance.

That means a new beard, a different hair color or any major changes will require a new photo, said officials for Gov. Andrew Cuomo.

Level III sex offenders, who have the highest risk of a repeat offense, have to report with the state every 90 days, so the new law wouldn’t require a new trip, but a new photo if their appearance changes.

For other sex offenders, they’ll have to notify state officials if they change their look. The measure was passed by the state Legislature during the legislative session that ended in June. Cuomo signed it into law Wednesday.

“These new laws, coupled with our comprehensive reforms, will better protect [sic] the public against sex offenders,” Cuomo said in a statement."

Sex offender order will be ended

"A MAN who took photographs of naked boys in swimming pool changing rooms will soon no longer have to register as a sex offender.

WP avoided a jail sentence in 2006 but was told that he would be put under a timeless sexual offences prevention order. A judge has now ordered it will end next June.

Because he received a six-month suspended jail term, P, 58, only had to register as a sex offender for seven years.

Robin Shellard, representing him, told Swindon Crown Court it would be unfair to make him continue registering when that time was up.

Prosecutors agreed, in light of cases heard by the Court of Appeal, and did not oppose an application for it to end."
