Giving vengeance a voice in court

"A criminal trial should be a cool-headed assessment of evidence, not a chance for victims to vent their distress.

It is hard to remember a reform to the UK’s criminal-justice system which was not geared towards giving victims a ‘voice’ or ‘presence’ in the courtroom. This week, yet another victim-centred reform was announced, one which would allow for victim-impact statements to be read out in court by victims or their relatives. Victim’s minister Dominic Green said that the reforms would ‘give victims a real say in proceedings’."

"A victim’s emotions have no place in the criminal court. While we can, as human beings, acknowledge and pay due deference to the hardship of a criminal trial, particularly for the victims of the crimes under consideration, we must keep the central purpose of this ancient social ritual at the forefront of our minds. We cannot allow a victim-centred approach to justice to turn our courtrooms from the hopefully objective and impartial arbiters of the social will, into the organs of state-sanctioned revenge."

Judge spares sex abuser from jail in line with daughter’s wishes

"Suspended sentence for businessman OH after pleading guilty to indecent assault

Judge Carroll Moran said OH a father of four, was guilty of a breach of trust and the fact he had abused his own child was a further breach of this trust.

A 61-year-old man who subjected his young daughter to years of sexual abuse has avoided a prison sentence after she indicated she did not wish to see him jailed.

Earlier this month, Limerick businessman and former guesthouse owner OH was remanded in custody and warned he would be going to jail after harrowing evidence of the abuse suffered by his young daughter was outlined at Limerick Circuit Court.

Mr H, with an address at Westbury, Co Clare, pleaded guilty to 12 counts of indecent assault of his daughter SR between January 1988 and December 31st, 1990, and a further 20 counts of sexual assault between September 1991 and December 1995.

The offences occurred at the former family homes in Foynes, Kilcornan and Adare in Co Limerick.

Ms R, who waived her right to anonymity, told gardaí the abuse started when she was five years old. She also recalled how she was beaten and chastised by her father for mispronouncing words."

The disturbing case of the bloggers who fake death and disease for attention

"The Internet, it turns out, is a kind of paradise for people feigning illness and other tragedy.

Faking illness — or violence — is nothing new. As early as Roman times, physicians complained about lying patients. And in the 19th century, psychologists began talking about something they called “factitious disorder,” a category of mental illness in which the patient fakes being sick (or fakes that a child/relative is sick) without receiving any obvious benefit, like money or sick leave. Women would claim to have had (and lost) multiple pregnancies. Otherwise healthy people would shave their heads and drop weight and groan about how much they hated chemo.

By 1980, the American Psychiatric Association had recognized factitious disorders as an official condition — a chronic condition, unlikely to be cured, and affecting as many as 1 percent of all hospital admittees.

But in the late ‘90s, researchers began to notice something different about “factitious disorders” that played out online. For starters, the psychiatrist Marc Feldman observed in 1998, Internet identities are malleable already, which makes an illness that much easier to fake. And because there are so many online communities devoted to health, such fakers find victims readily. In other words, the Internet profoundly enables factitious disorders — and it makes them much more difficult to discover and treat.

Feldman gave the phenomenon a new name: “Munchausen by Internet.” And in the almost two decades since he identified it, Feldman said the disorder is only growing."

Abstract

"A sexual offender is thought to have victim empathy when he has a cognitive and emotional understanding of the experience of the victim of his sexual offense. Most sex offender treatment programs devote significant time to developing victim empathy. The authors examine three meta-analytic studies and some individual studies that suggest victim empathy work is unnecessary, or even harmful. Service user studies, however, report positive reactions to victim empathy work. The authors conclude that the enthusiasm for victim empathy work as a rehabilitative endeavor is disproportionate given the weak evidence base and the lack of a coherent theoretical model of change. However, because the research is inconclusive, it is not possible to conclude that victim empathy work is “correctional quackery.” We suggest a research program to clarify whether or not victim empathy intervention for sexual offenders has value."

Sexual abuse [sic] is known to have an impact on both child and adult mental health [no, there appears to be some correlation, in a small minority of people], but the neuropsychological basis of this effect is still largely unknown.

This study compared neuropsychological test results from a group of 76 children, 13 of them sexual abuse [sic] victims with symptoms of post-traumatic stress disorder, 26 victims of sexual abuse [sic] who showed no symptoms post-traumatic stress disorder, and 37 controls.

The groups were matched by age, sex, socioeconomic status, and educational level. Child sexual abuse [sic] was associated with reduced ability to inhibit automatic responses measured by the Stroop test regardless of post-traumatic stress disorder status.

These findings indicate possible attentional inhibition difficulties in child victims of sexual abuse [sic], which may help explain psychopathology associated with the experience."

"The Sun recently unveiled their new crime-fighting team - Dr Sara Payne and Shy Keenan – as the nation’s salvation when it comes to issues of criminal justice and victimisation.

Dr Payne, now with a high-ranking prefix to her name as though to present an image of authority, has recently gone on record as suggesting that the Press is a shining ‘bastion of hope’, citing the example of the News of the World’s shameful ‘Name and Shame’ campaign of outing convicted child sex offenders in 2000, leading to a formal campaign (which was ultimately successful) to introduce Sarah’s Law [sic] – a community notification scheme whereby parents can access information about convicted sex offenders living in their areas.

Payne stresses how this cause was close to her heart following the murder of her daughter, Sarah, by a previously convicted sex offender, Roy Whiting, but doesn’t address that the new legislation wouldn’t have prevented this tragic event, given that Whiting lived some distance away from the Payne’s family home.

Shy Keenan is a public face in the field of child protection, having been the victim of sexual abuse throughout her childhood. This puts her in a unique position as a very high profile voice for victims groups.

Whilst I sympathise with both of these women for the horrific events that they have experienced over the years, this should not exclude them from the same critical analysis that would befall any columnist working in the mainstream popular press, so here goes…"

New research [sic] shows action needed to stop people seeing indecent images of children for the first time

"Initial research findings [sic] into the motivations, behaviour and actions of people who view indecent images of children (often referred to as child pornography) online is released today (Thursday, March 28) by the child protection charity the Lucy Faithfull Foundation (LFF) and the Internet Watch Foundation (IWF).

The qualitative research involved hearing from Internet Offenders in their own words about what prompted them to begin viewing indecent images of children; how their illegal behaviour developed over time; methods used to find and view images; potential strategies for desisting; and how they are managing this behaviour at present.

It is hoped the research will lead to the development and implementation of new strategies to tackle the global problem of indecent images of children, in particular to prevent the first viewing of child sexual abuse images. Recommended areas for government, industry, law enforcement and the not for profit sectors to consider are:

>Preventing incidental viewing and first time access. Warning users of adult legal pornography of the dangers of straying into illegal materials when sexually aroused.

>Warnings for risky key word searches. A warning about the dangers of risky searches and the potential to find illegal indecent images could help some offenders think twice about their actions.

>Warnings for accessing sites assessed as containing child sexual abuse images. A warning that a website is no longer accessible as it contains child sexual abuse images.

>Better management of legal pornographic websites. Many offenders used progressive links on legal websites to access child sexual abuse images on their first occasion.

>Increased awareness of how to report child sexual abuse images. The Internet Watch Foundation takes reports of images and works with the online industry to remove them at source.

>Increased availability of resources for those who develop risky sexual thoughts and behaviours. The Stop it Now! Helpline can offer confidential advice to people concerned about their thoughts and feelings towards children and help them to manage them.

>Making monitoring software available. As well as filtering and blocking software monitoring software is available to help individuals avoid taking risks online.

>Educating both young people and adults about the criminal law in this area. Informing them that all sexual images of people who are, or appear to be, below 18 years of age are likely to be illegal."
