When Careless And Unlucky, Hurting, Parents, Via Extreme Offenders, Challenge Already Bad Law

Very rarely, and very unfortunately, in a world of erring human beings, there is a coincidence of a number of circumstances, which leads to a terrible tragedy.

Sarah Payne, James Bulger, Madeleine McCann, April Jones etc, the list is relatively short, but very real. This is where parental responsibility has been lacking, even dangerously-lacking, but, paths have been crossed, with men in extreme mental states (usually), bent on carrying out unacceptable and, ultimately, devastating acts.

With these incredibly rare cases, comes the backlash, regret, grinding consciences, self and group recriminations, ill-informed, spineless and votemongering political populism, knee-jerk reactions and the dangerous input, of those with financial and other vested interests.

At these times, bad laws are created and regressed.

"So, without the profiles of those who are missing, it is hard to know how dangerous, or otherwise, these people are.

In addition, 97% of people on the Register have been assessed as ‘low risk’. It’s not a exact science, but the police would tend to err on side of caution for obvious reasons. If those are reflected in the missing, then it is likely that only 12 will not be classified as low risk.

Conclusion

Whenever there is a story like this, among the questions that it is always worth asking are; what the figures mean, whether it is a big number in real terms, what information is missing, and what the explanation for the figures are?

What is missing is any details of how many people who were previously missing were found because they committed other sexual or violent offences, as well as an analysis of the people who are missing.

To critically approach these questions is not to dismiss the seriousness of the issue, or the concerns of those raising this as an issue. But, in answer to the question of how worried we should be, perhaps the answer is ‘not as much as you’d think when you read the headline’."

Filtering legislation

"What is the new filtering legislation about?

Previously, all convictions, cautions, final warnings and reprimands on the Police National Computer were disclosed on Standard and Enhanced DBS (formerly ‘CRB’) certificates until a person reached 100 years of age.

On the 29th May 2013, an amendment to The Police Act 1997 was implemented that allows certain minor offences to be removed or ‘filtered’ from the certificates. Offences that are eligible to be filtered no longer need to be disclosed for jobs that are eligible for Standard or Enhanced DBS checks.

Please note that the legislation applies to England and Wales only."

"The Rehabilitation of Offenders Act 1974 aims to give those with convictions or cautions the chance – in certain circumstances – to wipe the slate clean and start afresh.

Under the Act, eligible convictions or cautions become “spent” after a specified period of time known as the “rehabilitation period”, the length of which varies depending on how the individual concerned was dealt with. Prison sentences of over 30 months are excluded from the scope of the Act and can therefore never become spent. The rehabilitation periods for other types of sentence vary according to whether the person was cautioned or convicted and, if the latter, the type of sentence imposed. Rehabilitation periods will generally be shorter for offenders aged under 18 when they were convicted.

Once the conviction or caution becomes spent, the offender is regarded as rehabilitated and (for most purposes) is treated as if he had never committed the offence.

However, there are a number of exceptions to this general approach. For example, for some types of employment a person can be required to disclose details of both unspent and spent convictions or cautions.

The Government has recently legislated (via section 139 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012) to reform the 1974 Act in two key ways. The first key change is to extend the scope of the Act to cover custodial sentences of up to 48 months, and the second is to change the length of some of the rehabilitation periods (in most cases by reducing them).

The Act received Royal Assent on 1 May 2012 but section 139 has not yet been commenced and so is not yet in force. The Government had initially indicated that section 139 would be commenced in spring 2013; however, in February 2013 the offender rehabilitation charity Unlock said that it had been notified by the Government that section 139 would not now be commenced until November 2013. In answer to a PQ in October 2013, the Government said that it was working through some significant business and technical issues regarding implementation that were required to be resolved before commencement. It said that it aimed to have the reforms in place at the earliest possible point."

"Plaintiffs' affidavits explain in detail the difficulties and embarrassment they and their families have endured as a consequence of complying with these new restrictions, even though their convictions are now almost twenty years in the past and they have led completely law-abiding, if not exemplary, lives in the interim. Their stories raise substantial questions as to the wisdom and fairness of subjecting them and similarly situated individuals to lifetime registration and notification requirements with their attendant obligations and restrictions. But given the previous decisions addressing the issues Plaintiffs raise, I conclude that the relief, if any, must come from the legislative branch. With one limited exception, the fact that the restrictions are difficult and cumbersome is not enough to make them unconstitutional. For the most part, the amendments to the Wisconsin sex offender registry system do not depart in any meaningful way from the systems already found to be constitutional by the Bollig and Smith Courts.

The lone exception I find to this is the $100 fine provision, which I have concluded cannot be constitutionally imposed on them. With this exception, Defendants' motion for summary judgment is GRANTED and Plaintiffs' motion for summary judgment is DENIED. The Clerk is directed to enter judgment declaring that imposition of the $100 annual fee on Plaintiffs pursuant to Wis. Stat. § 301.45(10) constitutes punishment in violation of their rights under the ex post facto clauses of the United States and Wisconsin constitutions and enjoining Defendants from assessing or collecting such amount from Plaintiffs. All other claims against Defendants are dismissed with prejudice."

Wastes Valuable Resources On 'No'-Risk Offenders

"To the editor:

In the age of information, there is no excuse for ignorance of nearly two decades’ worth of studies on sex-offender policies and profiles. Sadly, the statements made by law enforcement and District Attorney Ernie Lee in an Aug. 20 article headlined, “Law enforcement weighs in on appellate decision” — regarding the repeal of North Carolina’s social media ban for sex offenders — don’t reflect that.

The judges in the case clearly stated that the law was overly broad because the ban applied to everyone convicted of any type of sex offense, without regard to whether or not they posed a risk to re-offend, had used a computer to commit their initial crime or had a child victim.

Why would law enforcement support a law that wastes valuable resources on no-risk offenders while truly dangerous individuals fall through the cracks?

According to a 2008 report by the American Psychological Association, “the publicity about online ‘predators’ who prey on naive children using trickery and violence is largely inaccurate.” The report goes on to say that the majority of victims in cases where social media was involved were willing participants in Internet-initiated sexual activity, but too young to legally give consent. The cases rarely involved violence and 75 percent of victims engaged physically with their offenders more than once.

A tremendous number of arrests for “soliciting minors” stem from law enforcement sting operations who entice potential offenders with non-existent teenagers.

Lastly, social media has become an integral part of connecting with friends and loved ones, keeping up on and discussing the news, and even obtaining employment. We should be encouraging former sex offenders to re-integrate healthily, not create additional obstacles. Given the conclusive reports of low sex-offender recidivism and high prevalence of crimes committed by first-time offenders, we agree with the court’s ruling. While we can all agree that one re-offense is one too many, and that predatory behavior towards minors must be stopped, it is counter-productive to pour precious resources into defending a law that in reality will do almost nothing to prevent future victimizations.

"A Hampton woman who invented a sexual assault that sent an innocent man to prison is set to be sentenced today, clearing the way for the Virginia Court of Appeals to consider clearing his name.

North Carolina appeals court strikes social media ban for sex offenders

"The North Carolina Court of Appeals on Tuesday struck down North Carolina's ban on registered sex offenders using social media sites like Facebook and Twitter.

The court said the ban in N.C. General Statute 14-202.5 "is not narrowly tailored, is vague, and fails to target the "evil" it is intended to rectify."

"The statute violates the First Amendment's guarantee of free speech, and it is unconstitutional on its face and as applied. Accordingly, we vacate the trial court's judgment," wrote the court.

The ruling centered around a Durham case in which LGP appealed his felony conviction for accessing a commercial networking site last year. According to the trial records, the Durham Police Department was looking at evidence that registered sex offenders were using the websites MySpace and Facebook, and an officer recognized P's photo on Facebook.

The North Carolina law says registered sex offenders may not use commercial social media sites if they know the site "permits minor children to become members or to create or maintain personal Web pages."

But in its ruling, the appeals court said the law "arbitrarily burdens all registered sex offenders by preventing a wide range of communication and expressive activity unrelated to achieving its purported goal [of preventing contact with children.]""

"Judge twice gives Ohio child-porn owner 1-day jail stay, says guidelines are flawed

Appalled at the harsh sentencing guidelines for child pornography offenses, a federal judge sentenced an ailing, 67-year-old defendant to only one night in jail — and when an appeals court ordered the defendant resentenced, the judge imposed the same punishment.

“If I have got to send somebody like Mr. (R)B to prison, I’m sorry, someone else will have to do it,” said U.S. District Judge James L. Graham of Columbus, Ohio. “I’m not going to do it.”

The 6th Circuit Court of Appeals on Thursday vacated B’s sentence again, saying it didn’t reflect the seriousness of the offense, and this time ordered that another judge impose a penalty.

The unusual act of judicial disobedience by Graham — who was appointed to the bench 27 years ago by President Ronald Reagan — is the latest protest of sentencing rules for pornography possession, which other federal judges have described in opinions as “irrational” and “bordering on witch hunts.”

Children’s commissioner: Rules on touching ‘wrong’

"SCOTLAND’S Children’s Commissioner has claimed that touching children is “fundamental” to their development and that the “pendulum of safety has swung too far” in their relationship with adults such as teachers.

Tam Baillie, appointed by the Scottish Government to champion children’s issues, said many professional carers and volunteers were scared to touch a child who was not ­related to them because of concern over how those ­actions might be perceived.

"A Thorold woman whose home has been targeted in a poster campaign inaccurately claiming a sex offender is living in her residence says her family is afraid to go outside for fear of retribution.

"It's scary," said the Bolton Ave. woman, who didn't want to be identified. "It's literally just blossomed into this huge, huge thing that isn't even true."

But one of the men who handed out flyers warning residents that SMD is living in the house stands by them.

"If we had to do this whole thing again, we wouldn't hesitate doing it," said the Thorold resident, who said he distributed the flyers with members of the Ontario Coalition for Accountability."

Letter: Sex offender residency bans are ineffective

"I was disappointed, but unfortunately not surprised, to read the Times’ June 18 editorial supporting a sex offender residency restriction bill in the New Jersey Legislature.

The public relies on the media to report accurately, particularly on such an important subject. Yet, when it comes to sex offender issues, even editorial boards seem more motivated by emotion than facts. Numerous studies on residency restrictions, including a 2012 study by Jill Levenson, Ph.D., of Lynn University in Florida, have found that sexual recidivists do not live closer to schools or parks than non-recidivists. The few registrants who did sexually re-offend were likely to drive to a different neighborhood.

State Sen. Fred Madden is a sponsor of a bill to prevent released sex offenders from living close to schools, playgrounds."
