I am a post-tariff IPP. Along with many others in the same position to say that I am frustrated by this sentence would be a gross understatement. My biggest complaint is the government-prescribed, psychological abuse delivered in the form of Offending Behaviour Programmes. There is no scientific basis behind OBPs, which are nothing more than psychological experiments. This country condemned the Nazi’s for conducting psychological experiments on prisoners during World War II, and yet we allow this travesty to continue upon our own shores and in our own prisons. Every intelligent being should ask themselves how this inexcusable position has arisen and what can be done to resolve the issue. I have already formulated my own theories, which I will explain with the help of some of the greatest minds in history.

"As a forensic (though not prison) psychologist, I have a great deal of sympathy with Anthony's frustrations. However, quoting Feynman is a bit risky, partly because he wasn't a psychologist, and partly because his views must be somewhat out of date as he is somewhat dead (25 years ago this year). Also, he is somewhat wrong - for example, in stating that psychological experiments don't get repeated. Anyway, none of this actually bears on the scientific status (or otherwise) of present day UK risk assessment.

There has actually been some respectable scientific investigation of risk assessment techniques. For example, a couple of studies have recently investigated the SARN, and demonstrated that the allegedly "dynamic" factors assessed do not have any predictive power over and above that of the static factors of the Risk Matrix 2000. In other words, if someone is assessed using the SARN, this cannot tell us anything at all about his risk before "treatment", his risk after "treatment", or any improvement during it. Therefore, assessments of alleged "unmet treatment needs" which depend upon the SARN are scientifically invalid. I have seen such an assessment successfully challenged in a parole hearing (the man was released) and am astonished that no one has apparently challenged it in the High Court. This is even more astonishing, because studies have been available for as long as 15 years showing that certain "risk factors" routinely assessed in sex offenders are in fact not risk factors at all. A 2005 study concluded: “Many of the variables commonly addressed in sex offender treatment programs (e.g., psychological distress, denial of sex crime, victim empathy, stated motivation for treatment) had little or no relationship with sexual or violent recidivism.” Yet people carry on as if nothing had happened.

Another practice which has been scientifically investigated, and shown to be invalid, is the practice of "adjusting" static risk assessments in the light of clinical information. For example, saying something like "the Risk Matrix 2000 says this man is low risk, but in the light of XYZ I would estimate his risk as medium". A number of studies have shown that altering a static risk assessment in this way reduces its accuracy. Always. This is mathematically inevitable, because clinical estimation of risk has been scientifically demonstrated to be very poor, and mixing a poor predictor with a better one reduces the overall accuracy to the level of the poor one. Static risk predictors are not fantastic, but they are about 65 to 70% accurate, which may sound impressive until you realise that you can get 50% accuracy by tossing a coin. Still, they do better than chance.

What worries me is that those doing the risk assessment seem very often not to be aware of how limited it is. They should be."

Prisoners win big payouts for parole delays

"A backlog in sentence reviews has led to compensation claims of up to £9,000 each
Murderers, rapists and kidnappers [that will be, victims] have received compensation totalling hundreds of thousands of pounds from the Government after complaining that delays in their parole hearings breached their human rights.

The Parole Board has admitted that a backlog of cases has forced it to pay out more than £300,000 in the past three years to compensate scores of prisoners for "distress" caused by the delays.

The total bill for compensation in 2012 was more than £100,000 and includes a £9,000 payout to a murderer who sued the authorities when they missed the deadline for deciding whether he should be freed on parole.

The Parole Board yesterday blamed the soaring costs on the increased workload caused by Imprisonment for Public Protection (IPP) sentences introduced in 2003. But a Conservative MP said the figures were "an indictment" of the justice system. "The public will be astonished that people like murderers and rapists [that will be, victims] can make a profit from proceedings designed to help them get out of prison early," said the Shipley MP Philip Davies. Quick guilty verdict in Facebook sting case

"It took jurors less than 30 minutes to find a 35-year-old Snohomish man guilty of attempting to rape an Elma boy he met on Facebook. He now faces life in prison without the possibility of parole.

JRA was convicted of first-degree attempted rape of a child after trying to meet what he thought was an 11-year-old boy for sex in an Elma park bathroom. He had actually been corresponding on Facebook with a Washington State Patrol detective and was arrested at the park. A was already a Level 2 sex offender after a 2001 conviction for second-degree rape of a child.

Because this is A’s second conviction of a Class A sex crime, Washington State’s “two strikes” law for such offenses mandates he receive a life sentence. Barring any contests, that’s likely what will be handed down at A’s Dec. 3 sentencing hearing."

Inspectors give their verdict on conditions for sex offenders at HMP Bure in Norfolk

"The annual report into Norfolk’s prison for sex offenders has again highlighted “inappropriate” care and facilities for elderly and disabled prisoners.

For the third consecutive year, the issue has been flagged up in the Independent Monitoring Board (IMB) report about HMP Bure, which opened in 2009 at the former RAF Coltishall.

It also highlights “totally unacceptable” handling of prisoners with indefinite sentences. A “serious lack of opportunity to complete programmes” means they are held “far beyond a release date that they would otherwise have achieved”.

The IMB report clears the prison managers of any blame, and urges the government to suspend the sentencing exercise to allow a “more robust structure” to be put in place across the country.

The prison houses up to 523 category C male sex offenders, largely from the eastern region."

Michigan Senate OKs bills attacking child pornography

"The Michigan Senate has unanimously passed three Republican-introduced bills that supporters say would make it easier to prosecute people for child pornography.

The bills approved Wednesday go to the state House for consideration.

Attorney General Bill Schuette says the bills help update laws written in the 1990s when he says “the Internet was still in its infancy.”

A bill by Tom Casperson of Escanaba amends criminal procedures to make it easier for prosecutors to use evidence gathered in undercover police operations against child predators [sic] at sentencing.

A bill by Goeff Hansen of Hart restricts who has access to child pornography during the discovery phase of criminal trials.

Police: Man thought he was arranging sex with 16-year-old

"A 44-year-old man was arrested after finding two detectives, a sergeant, and a tactical officer at a Tinley Park restaurant instead of the 16-year-old girl [sic] he was trying to arrange a sexual encounter with over the Internet, police said today.

MGW 44, of Palos Park, was arrested Thursday and charged with indecent solicitation of a child over the Internet, according to a police report from Tinley Park Police.

The investigation began Monday when police posted an ad in the “Casual Encounters” section of Craigslist. It was titled: “Later in the week? Wild child looking.”

In the post, police wrote: “Hello, it looks like I will be free later in the week on Thursday. I am young but don’t feel young. I need an adventure. I am 5-foot-8, and athletic, want to know more?” the report said.

Later that day, investigators received a response to the post, which they said turned out to be from Whitlock.

Investigators continued to communicate via email with him and, on Wednesday at 9:26 p.m. an investigator told him he was a “16-year-old girl’’ who attends Lincoln Way North High School, and Whitlock then asked to have sex with her, the report said.

Investigators even exchanged photographs with Whitlock, giving him a photo of a female police officer when she was 16 years old, the report said."

Undercover operations to curb prostitution renewed

"A SENIOR garda has issued a strong warning that the force is to revitalise recently successful undercover operations targeting those seeking the services of prostitutes.

Supt Frank O’Brien, of Limerick’s Henry Street Garda station, said Garda stings would be set up again following recent concerns expressed by the business community in parts of the city.

Earlier this month two men were convicted at Limerick District Court of soliciting undercover gardaí for sexual services.

The men were arrested by gardaí as part of Operation Freewheel, which saw more than 20 men detained and charged with soliciting or importuning for the purposes of prostitution on dates between November 11th and December 4th, 2011.

The operation sparked controversy, with some of the men claiming entrapment. However, this was rejected by the courts.

Following the undercover sting, street prostitution in Limerick seemed to decline.

However, Supt O’Brien said the activity had since resurfaced {not successful then] and was causing concern among the public."

"A KEYNSHAM man who was part of a nationwide paedophile [sic] ring has been jailed for ten years.

Bank manager AF, 54, arranged to meet a man and his ten-year-old daughter for sex in a London hotel, a judge at Reading Crown Court was told.

But F, of WR, was arrested when the "paedophile" [!!!] behind his sick fantasy turned out to be an undercover police officer called "Dave".

F admitted conspiracy to rape a child under 13 years. He admitted 11 counts of making indecent images and one of possessing 290 films of extreme pornography and 51 images. He also admitted arranging or facilitating the commission of a child sex offence.

Nigel Lithman, defending the father of two, said: "He did not meet a child, but is ashamed of his actions."

He added that F was of good character.

F was jailed for ten years in an indeterminate sentence for the protection of the public. He will serve at least five years.

He has also been disqualified from working with children."

"The Government has moved to placate public concern over high risk sex offenders in the wake of Wanganui's on-going efforts to stop a notorious sex offender from moving into the community.

Justice Minister Judith Collins today announced a new Bill targeted at offenders who pose a high risk of sexual or violent offending once they are released from prison.

The Public Safety (Public Protection Orders) Bill will allow the High Court to order offenders to live in a secure facility within prison grounds until the Court is convinced they pose no threat to the community.

Offenders could potentially be under extended supervision for the rest of their lives."

The European court of human rights judges said inmates serving indeterminate sentences had no realistic chance of accessing rehabilitation courses.

The European court of human rights has ruled "arbitrary and unlawful" the operation of indeterminate sentences for the protection of the public (IPPs), currently being served by more than 6,000 prisoners in England and Wales.

The Strasbourg judges said the prison system was "swamped" by prisoners without fixed release dates after the indeterminate sentences were introduced in 2005. They said the three inmates who brought the case had "no realistic chance" of accessing the rehabilitation courses they need to qualify for release.

The new justice secretary, Chris Grayling, told MPs he was disappointed by the judgment, and intended to appeal against it. He said: "It is not an area where I welcome the court seeking to make rulings."

The unanimous ruling by seven judges, including the British judge Sir Nicolas Bratza, awarded up to €8,000 (£6,500) compensation to three prisoners, Brett James, Nicholas Wells and Jeffrey Lee, who have been held up to two years and 10 months longer than the original minimum recommendation of their trial judge. They were also awarded €12,000 costs each."

Judges express 'great concern' at shorter sentence for paedophile [sic]

"IPPs, brought in by David Blunkett in 2003, were abolished by the Coalition Government earlier this year. Critics said the tough sentences have been used far more than was planned, boosting the prison population, but were not understood by victims or the public.

It is claimed that only a tiny proportion of those given the sentences have been released so far, remaining in jail long after they would have done on normal sentences. A Ministry of Justice spokesman said: "Sentencing and appeal decisions are purely a matter for the courts as only they have the full facts of a case before them.

"We are replacing the widely criticised and complex IPP scheme with a new regime of tough, determinate sentences. This will see more dangerous criminals given life sentences, and others spending long periods in prison and being supervised for lengthy periods after their release.”"

Do pedophiles deserve sympathy?

(CNN) -- One cannot choose to not be a pedophile, but one can choose to not be a child molester.

"Pedophilia" was long used as a synonym for "child molestation," and both were often seen as psychological failures of self-control. Child molesters were thought to be acting out their own histories of abuses, reacting to fears of adult relationships, or manifesting a symptom that might be resolved in psychotherapy, after which they would no longer be pedophilic.

Recently, however, a number of studies have starting changing that view. It appears that one can be born with a brain predisposed to experience sexual arousal in response to children.

Cases of child molestation that involve long strings of victims over the course of years illustrate what can happen when someone gives in to, or outright indulges, his sexual interests, regardless of its potential damage on others. It is those cases that dominate headlines and provoke revulsion toward pedophiles.

But they are rare. An untold number of cases merit sympathy.

The science suggests that they are people who, through no fault of their own, were born with a sex drive that they must continuously resist, without exception, throughout their entire lives. Little if any assistance is ever available for them.

Having encountered thousands of cases, it is my experience that the pedophiles who do go on to become actual child molesters do so when they feel the most desperate. Yet, much of what society does has been to increase rather than decrease their desperation.

If it is the brain's wiring that ultimately determines who will go on to develop pedophilia, can we detect it early enough to interrupt the process? Until we uncover more information, we will do more good by making it easier for pedophiles to come in for help rather than force them into solitary secrecy."
