Paedophile's [sic] images of abuse victim cannot be deleted, police say

The paedophile's [sic] laptop contains images of the girl he abused

Dorset Police officers have said it would be "unlawful" to delete photos of an abuse victim from a paedophile's [sic] laptop.

The man, a family member, was jailed in 2013 for nine years after admitting a string of sex offences, including assaulting a child under the age of 13.

He has now formally requested a laptop and a mobile telephone are handed back.

Liberty, which represents the victim's family, said photos of the girl in swimwear and leotards were on the PC.

"It would be unlawful for police officers to alter the computer and phone's memories by removing the disputed photographs before returning them”

Dorset Police said they could not delete the family pictures as they were not legally classified as indecent or prohibited.

As a result, the sex offender, who is in his 50s but cannot be named to protect the identity of his victim, will have access to photos of the girl and her family when he is eventually released from jail.

The victim's mother said the family had been "traumatised" by the abuse.

"I am appalled that the man who abused my child can ask the police to hand over our family photos for him to keep for the rest of his life.

"My daughters struggle every day with the devastating consequences of his abuse and this will only make them feel more humiliated and degraded.

"Why should we continue to be traumatised further?"

Liberty argued that the return of the computer and mobile would breach articles three and eight of the European Convention on Human Rights, which protect against inhuman treatment and invasion of privacy, respectively.

In a letter to Dorset Police, Liberty said the prospect of having the photos returned to the abuser was "causing the girls a significant amount of distress" and would be "an enormous violation of their dignity and personal integrity".

The abuse has caused the victim to suffer "enormous psychological harm" and she eats very little, self-harms frequently and is at risk of suicide, Liberty said.

Rosie Brighouse, legal officer at the organisation, said: "We urge the police to protect these victims' dignity.

"It's surely common sense that these vulnerable girls aren't degraded further?"

'Fundamental error'

In a reply, Dorset Police said "present options" were limited as the legislation used to seize the phone and computer required officers to return the property.

The force added: "Furthermore it would be unlawful for police officers to alter the computer and phone's memories by removing the disputed photographs before returning them."

The county's Police and Crime Commissioner (PCC), Martin Underhill, said it was not the fault of the police and has set up an e-petition to lobby to change the "fundamental error" in the law.[ah, a loophole, again]

He said: "How can we protect victims of sexual abuse if current legislation allows perpetrators to keep images of them?

"Think of the trauma this causes to the victims. And think of the control and power this gives the abuser.""

I have come across a case which highlights how victims of sexual abuse are being let down. This case involves a man convicted for sexual abuse. When he was arrested, his laptop was seized by the Police. Now the man is convicted, the case is over, the man is asking for his laptop back.

The laptop contains images of his victims which were not deemed indecent. 

The law states that the police have to return the equipment in its original condition.

This is a Dorset case. Question? Should an abuser, be allowed to retain images of his victims? Think of the trauma this causes to the victims? And think of the control and power this gives the abuser? This is not the fault of the police. The legislation is wrong. It is double jeopardy for victim’s photos to be viewed by their abuser – it opens old wounds. Victims need better protection, Government should legislate to stop all victim images being retained by sex offenders."

"You know when a scandal has made it to the news big league when it gets the “gate” tag, like Watergate. Well, the last ten days or so in the UK have given us Paedogate, in which the rabid right wing Daily Mail launched a sustained campaign to expose left wing support for the Paedophile Information Exchange (PIE) when I was its Chair back in the 1970s.

The aim was clearly to embarrass and undermine three leading figures in the Labour party. It worked. Initially dismissed as old hat because the story had been around for years as vague internet gossip, the Mail’s detailed trawl through publicly accessible archives and their own newspaper cuttings library paid off. At last, the rest of the national media finally sat up and paid attention in a big way. The Labour trio who were under fire, thanks to their work for the National Council of Civil Liberties (NCCL), to which PIE was affiliated, were forced to respond publicly. Harriet Harman, now Deputy Leader of the Labour party, angrily denounced the Mail. She had been an NCCL legal officer. Patricia Hewitt, a former cabinet minister in Tony Blair’s government, had a tougher hand to play because she had been NCCL’s General Secretary and had been closely associated with the organisation’s own very radical policy on the age of consent. She was forced into an apology in which she disowned this policy and also wrote ..."

The NCCL was right to affiliate with PIE

"If civil liberties groups won't defend free speech for the unpopular, what's the point of them?

To see the parlous state of moral and political debate in twenty-first-century Britain, look no further than the Harriet Harman / PIE scandal.

Here, in this resuscitation of old claims and smears about the relationship between the National Council for Civil Liberties (NCCL) and the Paedophile Information Exchange (PIE), we had an opportunity for a serious debate about freedom of speech and association, about whether even the most unpopular groups in society - and what could be more unpopular than an organisation of self-defined paedophiles? - should have the right to exist and to give voice to their ideology.

But instead, we’ve ended up with yet another shrill clash of competing paedo smears, with the Daily Mail suggesting that Harman (who was legal officer of the NCCL from 1978 to 1982) was a friend of perverts, and Harman’s backers in the press countering that actually it’s the Daily Mail that ‘sexualises children’. All matters of principle in the old NCCL / PIE relationship have been brutally elbowed aside by every side in this smear-fest disguised as a debate, where the national sport of ‘Hunt the paedo’ has trumped measured discussion of rights, freedom, and unpopular causes.

You’d never know it from the media frenzy, but there are some important principles at stake in this flashback to the old ties between the NCCL and PIE - primarily the principle that even the most unpopular people in a society should be free to associate with each other and to propagate their ideas and advocate for legal change. No, not free to abuse children or plan to abuse children, as some individual PIE members were arrested for doing, but free to express an outlook, however warped that outlook might appear to the rest of society.

The truth is that the NCCL was right both to have PIE as an affiliate and to defend its members against charges of ‘corrupting public morals’. Why? Because a key role of any civil liberties group worth its name is to defend the rights of association of the most loathed sections of society, to ensure that even the profoundly unpopular enjoy the same liberties, most importantly freedom of speech, as the respectable and the right-on.

For all its faults, the NCCL of the 1970s and early 1980s was a pretty good civil liberties organisation, certainly in comparison with the aloof, lawyerly outfit it has become in recent years under its new name of Liberty. Indeed, its willingness to have PIE as an affiliate, and to defend its members against the ‘crimes’ of publishing a non-pornographic magazine and posting private letters to each other containing sexual fantasies, shows just how serious it was about civil liberties, and that it possessed that key belief that should motor all defenders of freedom - that the freedoms of speech and association are universal and must extend even to those we hate or simply do not understand.

Reading the smearing articles about Harman - and also Patricia Hewitt and Jack Dromey, two other Labour bigwigs who were leaders of the NCCL when it had PIE as an affiliate between 1975 and 1983 - you could be forgiven for thinking that the NCCL had helped to facilitate actual acts of paedophila. It didn’t, of course. What it did was protect the freedom of individuals to promote the idea of paedophila and to define themselves as an association of paedophiles. And anyone who truly believes in freedom of thought and speech must, as an absolute bottom line, appreciate the fundamental moral difference between acts and ideas. Acting on paedophilic thoughts is a crime, as some PIE members discovered; having and voicing paedophilic thoughts is not, or at least shouldn’t be. There is a profound difference between breaking the law against child sex and campaigning for a change in the law on the age of consent, however perverse the reasoning for that campaign might seem. It is to the NCCL’s credit that it recognised this.

The NCCL’s involvement with PIE consisted primarily of defending its right to propagate its ideas and to exist as an organisation. It did not fight for the ‘right’ of PIE members to rape children, but rather defended PIE’s right to lobby, to publish a magazine with paedophilic ideas, to advocate for the abolition of the age of consent, and to post private letters to one another describing fantasies. Incredibly, some PIE members were actually arrested for doing that, for ‘sending obscene material by mail’ by writing personal letters to one another that were not publicly disseminated. If you do not recognise that as a pretty tyrannical assault on freedom of thought, then you need to go back to school and retake Liberty 101. The NCCL’s defence of PIE’s right to exist and its right to share ideas and information was correct and admirable.

If civil liberties organisations won’t defend the freedoms of speech and association of unpopular groups, then what is the point of them? Respectable groups don’t find their freedoms curtailed. The Women’s Institute is not prevented from publishing its ideas; Labour Party members aren’t arrested for what they write in private letters. It is only the moral outliers of a society who have their right to propagate their beliefs hammered by the authorities, whether it’s gay pornographers, the hard left, Nazis or self-confessed paedophiles. It is the freedom of speech of these deeply unpopular causes that true civil libertarians must defend, firstly because we recognise that freedom of speech means nothing unless it extends to everyone; and secondly because if we allow the state to define a certain outlook as so foul that it ‘corrupts public morals’ and thus must be extinguished, then we set a very dangerous precedent that might one day reach to us and call into question the acceptability of the views we hold, too.

In the US, where there is a far healthier attitude to freedom of speech, civil libertarians have for a long time asserted that it is entirely possible to defend a group’s right to exist, speak and publish (not to abuse, I reiterate) while simultaneously finding what that group says to be outrageous and grotesque. So the American Civil Liberties Union (ACLU) has defended the right of American Nazis to hold a march in a predominantly Jewish town - not because it likes Nazis (some of the ACLU’s leading figures are Jews whose forefathers were obliterated in the Holocaust) but because it recognises that a serious commitment to political freedom means defending it even for the ‘enemies of freedom’.

Indeed, the ACLU has also defended the speech and association rights of paedophilic groups. In a court case in the early 2000s, it represented the North American Man-Boy Love Association (NAMBLA) in a civil suit in which the association was being sued by the parents of a 10-year-old boy who was raped and murdered by two paedophiles. The parents claimed NAMBLA’s (non-pornographic) website fuelled the outlook of the two paedophiles. The ACLU argued that there was no evidence to back this up and defended the right of NAMBLA to continue publishing its ideas and campaigning for the abolition of the age of consent.

Why did the ACLU do this? Not because it is pro-paedophile, of course, but because it is pro-freedom of thought – consistently and seriously. It recognised how extremely unpopular NAMBLA is; in her book Free for All: Defending Liberty in America Today, Wendy Kaminer, a leading member of the ACLU at the time of the NAMBLA case, and today a contributor to spiked, said ‘virtually no group of people is more unpopular’ than paedophiles and revealed that ‘the ACLU [was] excoriated by many and lost considerable support’ over its decision to defend NAMBLA. But it was the right thing to do, she wrote, because a ‘simple appreciation of freedom of thought and expression’ should make it clear that we must have freedom even for ‘offensive, unpopular speech’.

‘The notion that pubescent or prepubescent children may enter into consensual, mutually beneficial sexual relationships with adults seems deeply flawed to me, but so do a lot of ideas I don’t share’, wrote Kaminer. If libertarians ‘only protected sensible speech, we’d inhabit a very quiet nation indeed’, she said. That, right there, is a principled commitment to freedom of thought and expression, where it is recognised that even ideas we find flawed or foul should not be censored, and the groups who espouse them should not be broken up. The NCCL once took a similar Voltairean approach to freedom of speech and organisation, and it is now lambasted for doing so.

There have been two responses to the return of the NCCL / PIE scandal: the illiberal side says the NCCL was disgusting and crazy; the other, pro-Harman side is little better, saying, ‘Look, the Seventies were weird and sexual liberation went too far, so you can’t blame the NCCL for stupidly having PIE as an affiliate’. Both sides avoid the question of principle, the question of whether - regardless of PIE’s perverted ideas and massive unpopularity - it was right for civil libertarians to defend its right to exist and to speak and organise. The fundamental thing that was different in the Seventies was less the out-of-control sexual liberation stuff than the fact that civil liberties groups genuinely believed in civil liberty. It is the ditching of that core commitment to freedom in recent years, not least by Liberty itself, which means so many can now look back in horror at the fact that libertarians defended the right even of paedophiles to publish words and arguments. The coming back to life of the NCCL / PIE scandal really confirms how alarmingly illiberal, how disconnected from true freedom of thought and Voltairean ideals, modern Britain has become.

It’s easy to have a pop at Harriet Harman, even easier to mock the Daily Mail for being hypocritical. But that’s enough easy posturing. Let’s now ask some hard questions. Do you support the right of paedophiles to set up an organisation (no, not a child sex ring, but a campaigning organisation)? Do you support the right of paedophiles to publish their ideas and their written fantasies? Do you support the right of paedophiles to campaign for a reduction in the age of consent? Do you support these rights even though you find the content of the material being published and the arguments for a lower age of consent to be deeply immoral and perverse? I answer yes to those questions. How about you?

In defence of the dark Seventies

They might have had some trouble keeping the lights on in the 1970s, but in other ways the ‘dark decade’ looks quite enlightened. Of course, in much of Seventies Britain racism was not so much acceptable as obligatory. But building on the gains of the 1960s, big strides were made in the struggle for female emancipation and gay liberation, and for rights and freedom of expression more widely. It was in this pro-freedom atmosphere that, as Brendan O’Neill has argued on spiked, it would have been weird if a civil-liberties group such as the NCCL had not defended free speech for the odious Paedophile Information Exchange (which is in no way the same thing as defending child-sexual abuse).

The Seventies brought the last set-piece showdowns between the old moral pillars of the British Establishment and the new wave unleashed in the Sixties. The two most notorious of these were the 1971 obscenity trial of the editors of the alternative publication, Oz – which involved the spectacle of the children’s cartoon character, Rupert Bear, standing trial after Oz pictured him having sex with a naked granny – and the 1977 private prosecution for blasphemy brought by Mary Whitehouse against Gay News, over a poem in which a Roman centurion fantasised about having sex with the crucified Jesus Christ. Both trials initially went the way of the prosecution – the Oz editors were jailed, the Gay News editor given a suspended prison sentence – but in the longer run, the public response to the harsh sentences served only further to discredit the old censorious laws.

The irony is that while these battles for freedom of expression were being won, in the student unions the new strand of politically correct No-Platform censorship was growing. Twenty years later, those student union prigs were running the country."

But as primary social goals, they are incompatible with the peaceful and productive advancement of human knowledge. To advance knowledge, we must all sometimes suffer. Worse than that, we must inflict suffering on others.’"

A dam smart way to divert attention

"PS: Briefly, as I have a plane to catch, I guess I should mention a rather less interesting propaganda issue than the Itaipu dam film. The Daily Mail has emailed me several times in the last few days asking for a comment on their latest misleading crap about supposed Labour government support for PIE in the 1970s.

I see no point in responding, as anything I say would merely serve as another angle to keep the story going.

Not that they need my help. They have already run the story in various versions before, and will no doubt do so again at the slightest excuse, whether they have anything new to say or not. They know what keeps their punters happy, so they cannot be accused of incompetence in terms of generating sales. However, so far as this particular repetitious saga is concerned they are beginning to resemble the Daily Express, which constantly recycles a handful of stories (death of Princess Diana, disappeared toddler Madeleine McCann, miracle cure for arthritis, stormy weather ahead) to its elderly readership, who are presumably so far gone in senility they cannot remember they read the same thing only a few days before.

The Mail can take the downmarket Express route if they wish. It may be successful in sales terms, but it is hardly a recipe for respected journalism."

"In recent days I have been the subject of a politically-motivated smear campaign by the Daily Mail.

They have accused me of being an apologist for child sex abuse, of supporting a vile paedophile organisation, of having a relaxed attitude to paedophilia and of watering down child pornography laws. These are horrific allegations and I strongly deny them all of them.

This is not the first time the Daily Mail has made this horrible and untrue allegation. And, this is not the first time the Daily Mail has attacked me. The editor and proprietor of the Daily Mail are entitled to their political views and they are of course entitled to oppose what I stand for but they are not entitled to use their newspaper to smear me with innuendo because they disagree with me politically and hate my values.

I sincerely hope people won't believe these smears - I suspect even the Daily Mail doesn't believe them to be true. But given the seriousness and the aggression with which the Daily Mail are pursuing me, I feel that I need to put the facts in the public domain.

1. Allegation that I supported the lowering of the age of consent to 10

This is not true. I supported the equalisation of the age of consent (as set out in NCCL document “priorities and strategy for the executive committee June 1981") by making the age of consent the same for homosexual as well as for heterosexual sex.

2. Allegation that I opposed the law on incest

This is not true. The document they refer to was written by NCCL in 1976 before I started to work there.

3. Allegation that I was seeking to water down a proposed ban on child pornography.

This is not true. I supported the Protection of Children Bill 1978. At the start of the document it makes clear that “The NCCL deplores the exploitation of children whether in the form of use in commercial pornography or as victims of sexual assaults"

The submission argued for some amendments to guard against unintended consequences including:

- Parents being criminalised for taking pictures of their children on the beach or in the bath

- The use of pictures in sex education being criminalised

- We also proposed that the definition of indecent was too wide and instead proposed "obscene" as indecent was very broadly defined and could include Page 3 of the Sun.

The Mail have tried to make me guilty by way guilt by association.

NCCL was an organisation which anyone could apply to join and indeed any organisation could apply to be "an affiliate" on payment of a fee. When I was at NCCL there were around 6,000 members and nearly 1,000 affiliated organisations of which PIE was one.

Members and affiliates decided the organisation's policy at the AGM from year to year.

I was aware that because NCCL opposed censorship and supported gay rights, paedophiles had sought to exploit that and use NCCL as a vehicle to make their arguments. But by the time I came to work for NCCL this vile organisation had already been vigorously challenged within the organisation. Jack Dromey was instrumental in that challenge when he took over the chair of NCCL in 1976

The reason I decided to go to work for NCCL was because I actively supported the work they had done and in particular the work of their women's rights committee on the Equal Pay Act, on the introduction of the Sex Discrimination Act and for greater protection of victims of domestic violence and against race discrimination.

Since being elected to the House of Commons in 1982 and during my times in Ministerial Office I have always championed the rights of those subjected to sexual abuse - especially women and children.

I hope The Daily Mail will stop this campaign of smear and innuendo against me. I have done nothing wrong and am guilty of none of their grotesque allegations."

Harriet Harman, the NCCL: Smear Or Legitimate Story?

"Iain takes the Daily Mail to task.

One of the most irritating phrases you will ever hear on television is “the BBC has learnt”. You’d think it meant that due to an original piece of journalism, the BBC has found out something nobody else has. Invariably it means the BBC has switched on Sky News.

Sky use a similar technique by using the phrase “Sky sources have told us.” But in each case it gives the broadcaster cover to hype up a story that might otherwise be considered a little pedestrian. And it perverts the news agenda. But this sort of thing happens every day. Take the current furore about Harriet Harman, the Daily Mail, and the NCCL.

Over the last few days both the BBC and Sky have studiously ignored the front pages of the Daily Mail, which has accused Harriet Harman of, well, I’m not totally sure exactly. It seems they think that because she was legal officer to the NCCL she must have somehow sympathised with the aims and objectives of one of its thousands of members, the Paedophile Information Exchange. It’s a ‘guilt by association’ smear which upon any reasonable examination doesn’t stand up to scrutiny. But day after day the Daily Mail demands that Harman, her husband Jack Dromey and Patricia Hewitt say ‘sorry’. It’s the same kind of tactic they used on Ed Miliband back in September.

Conservatives have up to now attacked the BBC for not even mentioning the issue, understandably believing that if three Tory politicians had been accused of something similar the BBC might not have been so coy. We’ll never know. However, the BBC could defend its position by pointing out that these allegations are nothing new and were first aired back in 2009. That would be a sustainable editorial position.

But yesterday the game changed when Harriet Harman decided to break cover and respond to the allegations by giving the BBC’s Laura Kuenssberg an interview. It turned out to be a bad move. Instead of saying that it was a clear mistake for the NCCL to allow the PIE to be an associate member, she prevaricated and appeared a little shifty. Not only that she compounded her error by accusing the Daily Mail of being hypocritical because it publishes pictures of bikini-clad young women on its website. Women, not girls. So instead of closing down the story, it has merely given all other media outlets the excuse to cover it on the basis that if Harriet Harman has spoken about it, it becomes a legitimate story.

Cue BBC overkill. It’s now leading bulletins on the Today Programme and 5 Live. I haven’t seen Sky News yet this morning, so I can’t comment on what they are doing but as it’s the lead story on their website it’s probable that it is leading their bulletins too.

I’ve steered clear of the story on my LBC show, not because of any desire to be politically correct, but because I genuinely don’t see this as a massive story. I see it as a politically-motivated smear by a newspaper which is besmirching its own good name by running it day after day after day.

Does anyone seriously believe Harriet Harman, Jack Dromey and Patricia Hewitt have any paedophile sympathies? No, of course not. They worked for a ramshackle organisation which was run in an anarchic way. Just as anyone with dubious views can join a political party, anyone or any organisation with dubious views could join the NCCL. Does anyone seriously think that Harman, a lowly junior legal officer, had the power to expel a member who had legitimately joined? Presumably to do so would have meant changing the NCCL’s constitution. Perhaps she and her husband tried to do that. Who knows? But remember that one of the NCCL’s aims was to promote freedom of speech for everyone, no matter how vile their views.

The biggest mistake Harriet Harman has made was to give that interview to Newsnight. All it succeeded in doing was fanning the story’s flames and giving other media organisations and newspapers to excuse they needed to cover it. Well, that’s all fine and dandy, but the overblown and blanket coverage it is getting is so out of proportion to the lack of coverage it got yesterday, that editors all over the place, but especially the BBC, would do well to examine why they are doing what they are doing. Are they doing this because it is such an important story or because of their collective feeling of guilt that maybe they should have given it some coverage well before today?

When I go into LBC today and we start planning my Drive programme, it will be interesting to see how the story has developed during the day. If I cover it at all – and at the moment my feeling is that I’d rather not – it will be looking at the behaviour of the Daily Mail, more than the behaviour of Harriet Harman. No doubt I will get a shedload of abuse for it, but hey – broad shoulders and all that."
