"S.2 offence Harassment

The elements of the section 2 offence are:

>a course of conduct;
which amounts to harassment of another; and
which the defendant knows, or ought to know amounts to harassment of another.

As a summary only offence, the section 2 offence requires an information or complaint to be laid within 6 months from the time when the offence was committed, or the matter of complaint arose. The 6 months' limitation should run from the last date of the course of conduct alleged.

In determining whether the defendant ought to know that the course of conduct amounts to harassment, the question to be considered is whether a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other."

A network of Arizona-based Internet companies is mining data from sex-offender sites maintained by law-enforcement agencies and using it to demand money and harass those who complain or refuse to pay

"State and national registries are set up to provide information on where the most serious sex offenders are living and warn that the information cannot be used to threaten, harass or intimidate offenders.

But sex offenders and others profiled by the Arizona companies accuse their operators, in a civil lawsuit and elsewhere, of running an extortion racket by demanding up to $499 for removing names, criminal histories, photographs, addresses, phone numbers and other personal data from their non-government sites.

They accuse operators of posting inaccurate or old information and using the threat of exposure as a sex offender as leverage.

Operators of SORArchives.com, Offendex.com and Onlinedetective.com did not take down individual profiles after payments were made and launched online harassment campaigns against those who balked at financial demands or filed complaints, an eight-month Call 12 for Action investigation found.

Call 12 found the websites list individuals as sex offenders who no longer are required to register and whose names have been removed from state databases. Among the hundreds of thousands of names that appear, the websites include names and addresses of people who never have been arrested or convicted of a sex crime."

"JG can't do a lot of the normal things parents do, like drop his son off at school, attend parent-teacher conferences, or take his daughter to the park, a library or anywhere else children gather.

For the offense of inappropriately touching his 8-year-old sister when he was 12, G, 26, has spent almost half his life as a registered sex offender. The designation subjects him to residency and zoning restrictions that dictate where he can live and spend time. It has also made him the target of harassment, death threats and hampered his ability to find a job or keep a home, he said.

As he sees it, his wife and four children are still paying the price for what he did as a child.

"The biggest effect is obviously not being able to provide stable housing and a stable environment," said G, who lives in Dallas. "I have missed two first days of school, experiences which can never be re-lived.""

'Insulting words' crime ditched

"Theresa May Mrs May told MPs that free speech needed to be balanced with action against widespread offence

The crime of "insulting" someone through words or behaviour, which once led to the arrest of a student for asking a police officer whether his horse was gay, is to be dropped.

Home Secretary Theresa May confirmed to MPs that the government would not seek to overturn a Lords amendment scrapping the ban.

The director of public prosecutions has said it will not hinder his work.

But Labour warned that it could remove protections for minority groups.

 Section 5 of the 1986 Public Order Act currently means that "threatening, abusive or insulting words or behaviour" might be deemed a criminal offence."
