Funding success for Northumbria Law School

Northumbria Law School wins prestigious seminar funding

"Professor Chris Ashford and senior lecturer, Nicola Wake have been awarded funding from the Modern Law Review to run a seminar on ‘Consent, Compulsion and Sexual Offenders: The Compulsory Treatment of Sex Offenders’ to be held in March 2014.

This is only the second time this award has gone to a new university, the first time also being Northumbria in 2010 for a seminar on Expert Evidence in Criminal Proceedings.

This event will be run jointly by the School’s Centre for Evidence and Criminal Justice Studies and the Gender, Sexuality and Law Research Group. It aims to bring a new dimension to the approach of legal academics and legal practitioners to the “treatment” of sex offenders. It will bring together academics and practitioners for the first time to enable an inter-disciplinary dialogue on this topical area of criminal law and to develop a sustainable international research network.

The Gender, Sexuality and Law Research group was launched in 2013. It draws together established, early career academics and postgraduate students from a range of disciplines across the University aligned with the core theme of gender, sexuality and law. The group acts a point of focus for this growing community of scholars, and organizes a seminar series together with a range of activities to support and develop a community of academic inquiry. In the first six months of operation, the group has successfully attracted funding to explore LGBTQ law student identities, LGBTQ ‘communities’ within law schools (with Bradford University), and to explore conceptions of privacy in the context of mobile ‘dating’ Apps such as the popular Grindr and Scruff products (with Newcastle University).

The unintended consequences of laws addressing sex between teachers and students

"There is a painfully uncomfortable episode of “Louie” in which the comedian Louis C.K. muses that maybe child molesters wouldn’t kill their victims if the penalty weren’t so severe. Everyone I know who watches the show vividly recalls that scene from 2010 because it conjures such a witches’ cauldron of taboo, disgust and moral outrage, all wrapped around a disturbing kernel of truth. I have similar ambivalence about the case involving former Montana high school teacher SDR. Louie concluded his riff with a comment to the effect of “I don’t know what to do with that information.” That may be the case for many of us, but with our legal and moral codes failing us, our society needs to have an uncensored dialogue about the reality of sex in schools.

As protesters decry the leniency of R’s sentence — he will spend 30 days in prison after pleading guilty to raping 14-year-old Cherice Morales, who committed suicide at age 16 — I find myself troubled for the opposite reason. I don’t believe that all sexual conduct between underage students and teachers should necessarily be classified as rape, and I believe that absent extenuating circumstances, consensual sexual activity between teachers and students should not be criminalized. While I am not defending Judge G. Todd Baugh’s comments about Morales being “as much in control of the situation” — for which he has appropriately apologized — tarring and feathering him for attempting to articulate the context that informed his sentence will not advance this much-needed dialogue.

I do think that teachers who engage in sex with students, no matter how consensual, should be removed from their jobs and barred from teaching unless they prove that they have completed rehabilitation. But the utter hysteria with which society responds to these situations does less to protect children than to assuage society’s need to feel that we are protecting them."

"The backlash over a round of Twitter slut-shaming has led to nearly two dozen suspended accounts as users flock to support an Irish teen known as #Slanegirl.

Over the weekend, Irish Twitter users were quick to throw the wolves of the Internet at a girl who was photographed multiple times engaging in public sexual activity at an Eminem concert at Slane Castle, near Dublin. The girl's identity was leaked and her image turned into a meme as #Slanegirl went viral.

Now, the Independent reports that the girl has been hospitalized and sedated. She’d had a rough weekend: According to the police, the girl reported having been sexually assaulted at a different outdoor event on the same night—before her photos went viral.

On the Web, the tone seems to have shifted rapidly. What started as a litany of mockery turned into outrage that the girl's photos—which technically constitutes child pornography; she's still a minor under Irish law—were ever leaked to begin with.

The doxers have become the doxed. A source sent the Daily Dot email proof that roughly 125 accounts were forwarded to Twitter. That number includes those who first tweeted the #Slanegirl images, plus about 100 more who retweeted."

"Pretoria - It is no longer a criminal offence for children aged between 12 and 16 to engage in consensual sexual activities with each other, the Pretoria High Court ruled on Tuesday.

Judge Pierre Rabie’s ruling follows an application last April by the Teddy Bear Clinic for Abused Children, supported by the Centre for Child Law, challenging certain provisions of the Sexual Offences Act.

The two organisations argued the Act often resulted in many underage pregnant girls not wanting to have abortions at clinics, as this would lead to criminal charges against them and their partners.

They requested the court to declare certain provisions unconstitutional as they infringed on a child’s right to dignity and privacy."

Online Predators Not Distinctively Dangerous Sex Offenders

"A new University of New Hampshire study challenges the view that online predators are a distinctly dangerous variety of sex offender, requiring special programs to protect youth.

The study from the UNH Crimes against Children Research Center finds that sex offenders who target teens increasingly use Internet and cell phone communications to lure teens into sexual relationships. In crimes that involve such communications, offenders who meet and recruit youth online operate in much the same way as offenders who meet and know youth in ordinary offline environments.

"These are all serious crimes," said lead author Janis Wolak, a senior researcher at the UNH Crimes against Children Research Center. "But the so-called 'online predators' are not more insidious.""

It's hardly surprising to hear that some under-16-year-olds are having sex: a one-size-fits-all age of consent doesn't accommodate individual differences. What is surprising is that the children in question weren't exploring sex with their peers, but were having sex with much older adults. Consider this scenario: A 12-year-old is repeatedly raped by a family friend who tells her it's their little secret. She doesn't scream and cry each time, she doesn't try to fight him off and she doesn't tell anyone. Did she consent to sex? No, of course not. Why then is it such a struggle for some to grasp that teenage victims of child sexual exploitation (CSE) don't consent either?"

"The Post committed an egregious error [sic] in its July 26 front-page story “Top swim coach accused of affair with teen in 1980s” by describing incidents of child sexual abuse as an “affair” and a “sexual relationship.” Not only do these terms imply consent but they also minimize what is a very insidious crime and suggest that some of the blame may lie with the victim.

Children are not able to give consent [sic]. The swimmer at the focus of the story was 13 when the abuse allegedly began. A child’s involvement with an adult offender should never be considered consensual. A more accurate description is “statutory rape.”

Who is a rapist? That's a question our societies began to struggle with as far back as when we determined that women had the right to refuse sex.

More often than not, we just say who isn't a rapist. Deuteronomy says he's not a rapist if you didn't scream. Some judicial systems say he's not a rapist if he's your husband, and increasingly few say he's not if he marries you right after. Cops, prosecutors, juries and members of the public who eventually get called to serve on them have myriad of unwritten rules about who isn't a rapist: famous men, men whom you kissed that night, men with whom you (or anyone) previously had consensual sex, men who were going to pay you for it, men who are "too attractive" to have to resort to coercion, men who didn't have weapons, men who haven't ever raped anyone else and seem too old to start now … and the list goes on."
