Opinion: Nintendo got it right on Alison Rapp's firing

"Nintendo made a smart decision in a bad situation.

Nintendo fired Alison Rapp, and it's the right call. Not because of a smear campaign, which was utter horsesh*t, but because of her words and actions while employed at Nintendo.

Let's address the smear campaigns. They originate from her detractors finding a publicly available academic writing from her college days. It seems to take an unpopular stance on Japan's right to make their own laws regarding depictions of child sexuality. It's an uncomfortable topic to be sure, but any topic should be open to properly researched and reasoned academic discourse. Barring her actually diddling children, she did nothing wrong by discussing a controversial subject, even if you don't agree with it.

If that was the sole reason for her firing, I would be there with the rest of the pitchfork-wielding mob, but it's not.

Rapp chose to write about child sexuality and air controversial opinions on social media sites, and made no bones about her posts being intentionally inflammatory. She (allegedly) moonlighted as a model for suggestive photos, and posted a sample from her “shoot” on her twitter. There's nothing particularly bad about any of these things on their own.

The problem is that Alison Rapp was employed by Nintendo of America in the PR field. You know, the only major video game company that's adamant about catering almost exclusively to children and families. We can clearly see Rapp was aware that she needed to be careful about what was and wasn't appropriate, given her position with Nintendo and working with children, but that didn't stop her from making “edgy” posts on twitter, be they serious or in jest."

Internet Trolls Win?

"Internet trolls use various tactics to shame, discredit, harass, isolate, and mentally/emotionally torture individuals. They don’t refrain from even going through their target’s garbage to find something that points to a skeleton in someone’s closet.

Over the past few months, internet trolls have caused quite a lot of commotion for a Nintendo Employee named Alison Rapp, a female mid-level marketing face of Nintendo America. For months, internet bigots made sure they shamed, isolate, discredit, harass Ms.Rapp in every way possible.

They believe that Ms.Rapp is somehow responsible for their favorite Nintendo games being censored in America. An amorphous group has targeted her relentlessly, going as low as using her Amazon wishlist and an anime pillow to shame her.

Pointless and desperate petitions were also filed in order to get her fired from Nintendo. Unfortunately for them, nothing worked and even petitions were taken down as they violate community guidelines."

Why did Nintendo fire this woman?

"Nintendo fired a woman named Alison Rapp on Wednesday, a decision that's putting the spotlight back on harassment in the gaming industry.

Rapp worked in marketing at Nintendo and has been a vocal advocate for women in gaming.

She was also a frequent target of online vitriol from supporters of a movement known as GamerGate. The movement purports to promote ethics in gaming -- but has been condemned for harassing women and their supporters in the gaming industry.

It was this harassment that Rapp posits cost her her job.

Rapp had found herself in the hotseat over Nintendo's decision to tone down its sexualization of girls in games, according to Kotaku.com. Though Rapp wasn't involved in the decision-making process behind these changes, she become a sort of scapegoat for those who disagreed with Nintendo.

For its part, Nintendo (NTDOF) said it let go of Rapp -- who had been at the firm since 2013 -- because it discovered she was "moonlighting" with a second job, which it said it doesn't allow."

Registered sex offender attacked at work not eligible for comp

"A registered sex offender who sustained injuries when he was assaulted by his co-worker on the job isn't entitled to workers compensation benefits, the Nebraska Court of Appeals has ruled.

P McD was working for Denver-based Western Sugar Cooperative monitoring machinery and ensuring work areas were clean in February 2013 when a co-worker, Jason Bates, assaulted him with a brass hammer, according to court records.

Mr. Bates called Mr. McD a “chimo", which is short for child molester, according to court documents, after seeing on the Internet that Mr. McD is a registered sex offender. Mr. Bates' employment was terminated immediately.

Having sustained injuries to his nose, clavicle and left shoulder, Mr. McD filed a petition for workers comp benefits, according to records.

Determining that Mr. McD was assaulted for reasons personal to Mr. Bates, the Nebraska Workers' Compensation Court found that he was not entitled to workers comp benefits, records show."

Reforms to the Rehabilitation of Offenders Act "will make a huge difference to thousands of people, but they don't go far enough" says Unlock, a national charity for people with convictions

"On Monday 10th March, the UK Government will finally implement reforms to the 1974 Rehabilitation of Offenders Act.

The charity Unlock has campaigned for changes for many years. Christopher Stacey, Director of Services at Unlock, says “There are over 9 million people in England & Wales with a criminal record and more than 1.2 million people get convicted at court every single year.

For the majority of these people, these changes mean that the length of time they’ll need to disclose their conviction for will be reduced – for example, more than 800,000 people a year receive a fine at court, and the rehabilitation period for this will reduce from 5 years to 1 year.“

"Background

The Rehabilitation of Offenders Act 1974 exists to allow people with convictions to be reintegrated back into society by having the right to legally ignore their conviction after a period of time. The Act allows convictions, cautions, reprimands and final warnings in respect of a certain offence to be considered ‘spent’ after a specified period of time known as the ‘rehabilitation period’ which is decided by the sentence or disposal received.

Once ‘spent’, the person is considered rehabilitated and the Act treats the person as if they had never committed an offence. As a result, the conviction or caution in question does not need to be disclosed by the person when applying for most jobs, educational courses, insurance, housing applications or other purposes, unless the role applied for is exempt from the Act (see ‘Exceptions to the Act’).

If a role is covered by the Act, it is unlawful for an employer to refuse to employ a person (or dismiss an existing employee) because the individual has a ‘spent’ caution or conviction.

It is also unlawful for an organisation to knowingly carry out (or enable someone else to obtain) a Disclosure and Barring Service (DBS) check on a person for a role which is covered by the Act.

If a role is covered by the Act, the employer is only legally entitled to carry out a basic criminal check known as a basic disclosure (provided by Disclosure Scotland) which will reveal only ‘unspent’ convictions.

A basic disclosure should not be confused with a standard DBS check which is legally required only for positions exempt from the Act such as approved financial posts by the Financial Conduct Authority, accountants, lawyers, barristers and other legal positions. "The Rehabilitation of Offenders Act 1974 aims to give those with convictions or cautions the chance – in certain circumstances – to wipe the slate clean and start afresh.

Under the Act, eligible convictions or cautions become “spent” after a specified period of time known as the “rehabilitation period”, the length of which varies depending on how the individual concerned was dealt with.

Prison sentences of over 4 years are excluded from the scope of the Act and can therefore never become spent. The rehabilitation periods for other types of sentence vary according to whether the person was cautioned or convicted and, if the latter, the type of sentence imposed. Rehabilitation periods will generally be shorter for offenders aged under 18 when they were convicted.

Once the conviction or caution becomes spent, the offender is regarded as rehabilitated and (for most purposes) is treated as if he had never committed the offence. [if only]"

"Unlock have campaigned for many years to see changes to the Rehabilitation of Offenders Act. It’s the first time in nearly 40 years since the legislation has been reformed in this way.

It’s been quite a wait since the law received Royal Assent in 2012, but we’re delighted that we’ve finally got there.

Since we got notice of the implementation date, we’ve been working hard behind the scenes to make sure that we do all that we can to prepare for the changes.

We are also firmly of the belief that the changes don’t go far enough, and we’ve been doing a lot of work to try and make this clear"

Filtering legislation

"What is the new filtering legislation about?

Previously, all convictions, cautions, final warnings and reprimands on the Police National Computer were disclosed on Standard and Enhanced DBS (formerly ‘CRB’) certificates until a person reached 100 years of age.

On the 29th May 2013, an amendment to The Police Act 1997 was implemented that allows certain minor offences to be removed or ‘filtered’ from the certificates. Offences that are eligible to be filtered no longer need to be disclosed for jobs that are eligible for Standard or Enhanced DBS checks.

Please note that the legislation applies to England and Wales only."

Under the Act, eligible convictions or cautions become “spent” after a specified period of time known as the “rehabilitation period”, the length of which varies depending on how the individual concerned was dealt with. Prison sentences of over 30 months are excluded from the scope of the Act and can therefore never become spent. The rehabilitation periods for other types of sentence vary according to whether the person was cautioned or convicted and, if the latter, the type of sentence imposed. Rehabilitation periods will generally be shorter for offenders aged under 18 when they were convicted.

Once the conviction or caution becomes spent, the offender is regarded as rehabilitated and (for most purposes) is treated as if he had never committed the offence.

However, there are a number of exceptions to this general approach. For example, for some types of employment a person can be required to disclose details of both unspent and spent convictions or cautions.

The Government has recently legislated (via section 139 of the Legal Aid, Sentencing and Punishment of Offenders Act 2012) to reform the 1974 Act in two key ways. The first key change is to extend the scope of the Act to cover custodial sentences of up to 48 months, and the second is to change the length of some of the rehabilitation periods (in most cases by reducing them).

The Act received Royal Assent on 1 May 2012 but section 139 has not yet been commenced and so is not yet in force. The Government had initially indicated that section 139 would be commenced in spring 2013; however, in February 2013 the offender rehabilitation charity Unlock said that it had been notified by the Government that section 139 would not now be commenced until November 2013. In answer to a PQ in October 2013, the Government said that it was working through some significant business and technical issues regarding implementation that were required to be resolved before commencement. It said that it aimed to have the reforms in place at the earliest possible point."

After serving their time, some sex offenders can be on another list for the rest of their lives.

Convicted sex offenders are required to register with their local law enforcement office for at least 15 years, often much longer than that.

Now some registered sex offenders and their families are saying this branding is doing more harm than good.

"Sam," a registered sex offender who asked to have his identity concealed, calls every day a battle.

"No sooner did we move and the house was getting egged," he says. "They spray-painted on the porch that I need to move. Why keep attacking me?"

Another registered sex offender we'll refer to as "C," says he sees the same struggles.

"Two kids in the area accused me of fondling them," C says. "You want to crawl into a hole and you're afraid."

The Arkansas House of Representatives passed legislation earlier this year prohibiting level three and four sex offenders, considered the most likely to re-offend, from swimming areas and playgrounds in state parks.

They also can't live within 2,000 feet of any school, day care, public park or youth center.

These men say the restrictions, along with the sex-offender stigma, make it nearly impossible to find a steady job and safe place to live."

One of the biggest obstacles that people with a criminal conviction face in Britain is securing employment. I have discussed and argued this topic many times during my journey through the criminal justice system, and, as I approach the completion of my sentence, I have a fairly good understanding of how the Disclosure and Barring Service (DBS) operates.

Over the last 12 months we have seen the effects that the DBS (formerly the Criminal Records Bureau) can have on people with convictions from decades ago. 2012 saw candidates for the role of Police and Crime Commissioner withdrew because of historical offences.

Of course, there has to be screening in place. Arguing for the complete withdrawal of such a process would be futile. But the approach the British have towards the disclosure process is tyrannical to say the least. There is now a whole new business area involving companies that will undertake DBS screening on behalf of other companies (for a fee, naturally) and on most application forms there is a part that makes most people I know with convictions give up the prospect of working for that company."

"Any resident of Malaysia, whether a citizen or not, can apply for what is known as a “good conduct” report from the Consulate General of Malaysia. This costs as little as £3.79 and the turnaround time is around two months. The report will satisfy a job application’s conviction-reporting requirements for any Malaysian company. It truly is that easy."
