Doncaster woman cleared of child porn charges changes name

"A woman cleared of child porn charges in a case involving a pop star has changed her name.

Joanne Mjadzelics, of Thorne Road, Doncaster, has now swapped her name by deed poll after being cleared by Cardiff Crown Court last month.

The former girlfriend of paedophile rocker Ian Watkins, singer of the Lostprophets, revealed she had made the change in a radio interview.

She said: “It has completely destroyed me because I have not been able to work.”

Ms Mjadzelics said the charges meant people were not interested in giving her a job.

And she faced major expense paying for her accommodation while she was on trial which meant she was now struggling financially.

Now the former escort says she hopes to get involved with helping prostitutes get off the streets and turn their lives around.

She said: “There is nothing in Doncaster. I want to see if there’s a way to get them off drugs and off the streets.”"

Cumbrian man tells of his rape trial ordeal

"A man cleared of raping a schoolgirl when he was 16 years old has described the devastating effect of the allegation on his life.

It took a jury two hours and 38 minutes to unanimously clear TM of the 11 sex abuse allegations he faced – three charges of rape, seven of sexual activity with a child and one of sexual assault.

He has consistently denied all of the charges. Outside Carlisle Crown Court yesterday, after he was cleared on all counts, Mr M, of [redacted], Longtown, said that he had endured a year of stress and turmoil since he was arrested.

He said: “I’ve lost two stone in weight, I haven’t been sleeping, and somebody put my window out at my house, so I ended up losing that too because my landlord didn’t want it to be damaged any more.

“I stopped going out because I was afraid to walk down the street, so I lost my benefits as well.

“It’s been terrible.”"

Enhanced criminal records certificates – teachers on trial

"Of course, a critically important issue for the teacher in question is whether the allegations will ultimately find their way into any enhanced criminal record certificate (ECRC). This is an issue which has been considered by the High Court in two recent cases.

In the first, R (L) v Chief Constable of Cumbria Constabulary [2013] EWHC 869 (Admin), L, a teacher, had been accused of having improperly propositioned and hugged an 18 year old pupil whilst at a pub. L had denied the allegations and no criminal prosecution had ultimately been mounted. The High Court held that inclusion in the ECRC of information relating to the allegations was unlawful as it constituted a disproportionate and hence unjustified interference with L’s Article 8 rights (see further Rachel Kamm’s more detailed post on this judgment here).

This week, the High Court has given judgment in the case of RK v (1) Chief Constable of South Yorkshire (2) Disclosure and Banning Service [2013] EWHC 1555 (Admin). RK had previously been acquitted of six counts of indecent assault and sexual activity with a child (in essence it was alleged that RK had repeatedly touched the bottoms of teenage girls in his care). Nine years later RK sought disclosure of a draft ECRC from the Constabulary. The draft included information about the allegations and referred to them as ‘offenses’. RK sought a judicial review of the draft certificate.

"Critically the judgments in both L and RK highlight the dangers attendant on the police unthinkingly substituting their own view of an individual’s guilt or innocence in the face of an acquittal by the criminal courts or other important evidence raising questions about the reliability of the information in issue."

"Judge twice gives Ohio child-porn owner 1-day jail stay, says guidelines are flawed

Appalled at the harsh sentencing guidelines for child pornography offenses, a federal judge sentenced an ailing, 67-year-old defendant to only one night in jail — and when an appeals court ordered the defendant resentenced, the judge imposed the same punishment.

“If I have got to send somebody like Mr. (R)B to prison, I’m sorry, someone else will have to do it,” said U.S. District Judge James L. Graham of Columbus, Ohio. “I’m not going to do it.”

The 6th Circuit Court of Appeals on Thursday vacated B’s sentence again, saying it didn’t reflect the seriousness of the offense, and this time ordered that another judge impose a penalty.

The unusual act of judicial disobedience by Graham — who was appointed to the bench 27 years ago by President Ronald Reagan — is the latest protest of sentencing rules for pornography possession, which other federal judges have described in opinions as “irrational” and “bordering on witch hunts.”

Children’s commissioner: Rules on touching ‘wrong’

"SCOTLAND’S Children’s Commissioner has claimed that touching children is “fundamental” to their development and that the “pendulum of safety has swung too far” in their relationship with adults such as teachers.

Tam Baillie, appointed by the Scottish Government to champion children’s issues, said many professional carers and volunteers were scared to touch a child who was not ­related to them because of concern over how those ­actions might be perceived.

Child pornography trial collapse

"The trial of one of Scotland's most successful Highland Football League managers, who was charged with downloading child pornography, has collapsed.

GC went on trial at Aberdeen Sheriff Court facing three charges relating to child porn.

Mr C, 41, from Aberdeen, was accused of downloading more than 200 photographs of youngsters on computers at his city home. But the former football manager – who retired from Buckie Thistle last year – denied the offence.

Forensic experts admitted the images could have got on to his equipment without his knowledge and could not prove he had seen them."

Sex offender vindicated 2 decades later

"A convicted sex offender has been vindicated after his now adult-children stepped forward to say he did not sexually abuse them.

The Salt Lake Tribune reports (http://bit.ly/10NTa3g) Kevin Peterson finished serving 15 years in prison in 2007. Upon his release, he was required to register as a sex offender.

The allegations surfaced in 1990 while Peterson was engaged in a custody battle over his children, then 5 and 8 years old. Now an adult, his son cried as he told officials he had lied.

Peterson was cleared under a Utah law that went into effect in 2008 that allows new or changed evidence, such as DNA, to be taken into consideration.

Peterson is the fourth person cleared under this law. Two of the cases are being appealed by the state."

Policeman cleared of animal porn charges

"A POLICE officer has been cleared of possessing extreme pornographic images.

GR, aged 26, a police officer who was previously based in Farnworth, was accused of having two animal porn videos on his mobile phone.

A jury of seven women and five men at Minshull Street Crown Court, Manchester, yesterday took just 25 minutes to unanimously find him not guilty of the charges.

PC R told the court that the images were sent to him by a colleague while he was doing temporary work at a TV licensing firm in Preston between April and August, 2006."
