"A trial of nine men accused of sex offences against a 14-year-old girl in East London has been thrown out on day one due to new evidence from Twitter.

140 police officers were involved in dawn raids in March and the nine men were arrested and charged with 25 counts, including rape.

LBC 97.3's Joe Pike reports from the Old Bailey: "There were claps and cheers in the public gallery as the judge announced the nine men were free.

"All the men were in their 20s and denied the counts against them, mostly rape.

"Samantha Cohen from the Prosecution told the court the contents of a recently-discovered Twitter account belonging to the alleged victim meant there was no realistic prospect of conviction.""

The victims [complainants] are taking over the law courts

"Reorientating criminal justice around the rights of alleged victims [complainants] is destroying the rights of the defendant.

Last week, the Crown Prosecution Service (CPS), which undertakes all prosecutions for criminal offences in England and Wales, launched a policy allowing victims [complainants] to review any decision taken by it to not charge a suspect or to halt a prosecution for lack of evidence.

This right will only apply to decisions made by the CPS, and will not apply to police decisions not to investigate an allegation. The prompt for this policy change came from a Court of Appeal judgement in 2011 in the case of Christopher Killick, in which the court included a recommendation that such a right should exist in the course of a judgement.

CPS head Keir Starmer justified the move on the basis that it bolsters the victim’s [complainant's] position in the criminal-justice system. He described how the policy will prevent victims [complainants] being mere ‘bystanders’ in the course of criminal justice and how ‘it is now recognised by the criminal-justice system that the interests of justice and the rights of the victim [complainant] outweigh the suspect’s right to certainty’.

This glib dismissal of the defendant’s right to certainty in the name of victims’ [complainants'] rights shows just how influential the ‘victim’ [complainant] has become in criminal proceedings. But the decision also comes at a historical low point for the authority of the CPS. This new policy is driven by two factors: a historical move towards a more victim-centred [complainant-centred] justice system and the CPS’s own profound crisis of institutional authority.

The policy follows a number of cases in which the CPS’s ability to judge whether or not to prosecute has come under close scrutiny. In the course of Operation Yewtree, the CPS issued a public apology for its decision not to prosecute the late liberal MP Cyril Smith on the basis of evidence presented to it in the 1970s. The investigation into the Cyril Smith case followed criticism of the CPS after a lawyer had failed to proceed against those involved in what became known as the Rochdale sex-ring case, because of doubts raised about the credibility of the victims [complainants]. The new policy is not driven by sympathy for victims [complainants], nor is it a straightforward response to the decision of the Court of Appeal. It is a cynical and ill-thought-out attempt to counter a perceived lack of public faith in the CPS to make the right calls on prosecutions.

Usually, the decision whether to prosecute signifies the first involvement of the CPS in a criminal case. The CPS lawyer making the decision has to establish that there is sufficient evidence to prosecute and that it is in the public interest to do so. The fact that the CPS does not feel confident that its lawyers can get this decision right, when it represents such a significant aspect of its role in any given case, shows just how depleted the authority of the CPS has become.

But there are other factors at play. The new policy is symptomatic of a justice system that is reorientating around the rights of the victim [complainant] at the expense of the rights of the defendant. Victims [complainants] now play a greater role in criminal proceedings than they ever have before. For example, since 2003 it has been possible to read statements out in court from the victims [complainants] of serious offences in the course of sentencing a defendant at the end of a case. Judges are entitled to take these victims’ [complainants'], statements into account when passing sentence.

Moreover, numerous legislative changes have been enacted to make it easier for victims [complainants] to give evidence and to minimise the distress of the trial process. These have included allowing victims [complainants] to be questioned from behind a screen or by video link. Most significantly, in relation to a defendant’s rights to finality in his dealing with the state, we also saw the repeal of double jeopardy in 2003, meaning defendants could be tried again for crimes of which they had been acquitted. All of these reforms have been justified on the basis of giving a more central role to victims [complainants] in the administration of justice.

But the idea that victims [complainants] have any ‘rights’ whatsoever when it comes to criminal proceedings is a dangerous legal falsehood. There are two parties in a criminal case: the defendant and the state. Because the state is able to utilise an enormous amount of resources in bringing prosecutions, the defendant’s rights are a vital means through which the playing field is levelled. The defendant’s right to finality, his right to certainty that the state will not pursue him over and over again for the same offence, was eroded by the repeal of double jeopardy. Now, with the introduction of the right to review, the CPS seems ready to do away with it completely.

The trend towards ‘victim-centered justice’ [complainant-centred] has extremely draconian connotations for the way justice is administered. In the victim-centered [complainant-centered] courtroom, all that matters is closure for the victim [complainant], even if that closure comes through denying and overriding due process and the erosion of fundamental freedoms. Victims [complainants] are, and must be, ‘mere bystanders’ in a criminal case. Otherwise, the objective and impartial administration of justice stands to be replaced by the emotionalised and draconian passing of state-sanctioned revenge."

"In the great criminological choir some get chosen for solo parts: thus by the accident of victimisation Helen Newlove becomes a Baroness and Victims Commissioner after her husband is kicked to death. Sara Payne’s daughter, Sarah, dies at the hands of Roy Whiting and through the boost of the News Of The World’s campaigning zeal Sara becomes an honorary doctor of the Open University. As this story shows Roy Whiting has been seriously victimised but don’t expect his name to feature in any politically astute honours list.

But back to honours and Dr Sara Payne. She lends her name, and more controversially her title, to The Sun’s Justice Campaign. A number of academics are concerned about this and as an OU graduate I am uneasy but probably because I’m opposed to honours systems in all areas of life. Yes, I know my father, Brian, has an honorary degree from the Open University.

So far Sara Payne is not advertised or billed as a criminologist. However, Mark Williams-Thomas is, and some in the criminological community are unhappy about this. I welcome his voice and enthusiasm but am more concerned that his very policey/punitive approach is seen as representative of UK criminology. A better example of this ‘who can be described as a criminologist debate’ though is Roger Graef. I recall a colleague being very exercised that he was described as a criminologist. But, enjoy the irony here, I’m happy to honour him with that title. And similarly Richard Garside a very sage commentator on crime and criminal justice. And famously Against Criminology and now sadly dead I honour Stan Cohen."

Met police boss: Covert relations 'almost inevitable'

"Bernard Hogan-Howe Bernard Hogan-Howe said such relations should not form the strategy

Some undercover police will "almost inevitably" have sexual relationships with members of groups they are infiltrating, the Met chief has said.

Bernard Hogan-Howe told the Home Affairs committee such relationships "shouldn't be part of the strategy".

But, he said, when officers got close to targets it was not "impossible to imagine" that relationships developed.

The Met is being sued by a group of women who have had relationships with undercover officers.

The women came into contact with five undercover officers who carried fake passports and other identity papers and were involved in various undercover operations between 1987 and 2010.

Speaking at the Home Affairs Select Committee meeting, the Metropolitan Police Commissioner said it was up to officers monitoring the deployment of undercover police to spot relationships early or before they began and to move the covert officer out."

After Savile, every British man should worry about his past

"The Pandora’s Box of Historic Sexual Abuse Cases

As the Jimmy Savile affair rumbles on, the question of whether so called “historic” offences should be subject to some form of Statute of Limitation has again been raised, not just because police, the CPS, courts and politicians seem to be applying today’s modern thinking to life as it was 40 years ago but also because the authorities are successfully bringing prosecutions that were not pursued at the time based on little or no evidence.

This week saw another “historic” case end with the jailing for 11 years of a 78 year old man for sex offences alleged to have taken place some 63 years ago from 1949-1973; the longest delay ever in bringing charges before a British court.

TheOpinionSite.org should point out that the recent sudden surge of accusers from the past is no accident either. The police and the CPS are openly inviting anyone who “thinks they may have been abused, no matter how long ago” to come forward and make a complaint, regardless of whether or not there is any evidence.

In other words, police are using the high profile Savile case in order to “trawl” for cases that they know full well will end in easy convictions."

His eccentricity, his weirdness has become nothing less than a sign of Savile’s malevolence, an index of the extent to which we ought to believe him to have been a child abuser."

During the 1980s and early 90s, cases of alleged "satanic ritual abuse" were reported around the world. "Covens" of abusers allegedly wore black robes and masks as they violated and sometimes killed children. In most instances children had indeed been seriously abused but allegations of satanic rituals were rarely, if ever, substantiated. The fantasy was largely discredited, but allegations of depraved paedophile rings continued to emerge in secularised form.

The late Richard Webster, a writer who dedicated many years to campaigning for "abusers" he believed were wrongly convicted, saw analogies with medieval witch hunts. Genuine witches existed, practising magic and calling on supernatural forces, but they were mostly eccentric individuals, not members of an international conspiracy threatening church and state. Since even real witches were mostly harmless and child abusers anything but, the analogy is not exact. The similarity lies, as Webster put it, in how "our need to rid the world of anyone who might conceivably be a paedophile" has become so urgent "that the requirement for evidence has all but disappeared". That is illustrated by the allegations that followed the Jimmy Savile revelations, which are reported recklessly and uncritically to the point that working in BBC light entertainment at any time in the last 50 years has almost in itself become evidence of guilt, either of abuse or covering it up.

Cameron frightened of questioning alleged abuse claims

"The police proudly say that Jimmy Savile “is believed” to have abused up to 300 or 400 people, depending on who you listen to.

What that means is that they cannot yet prove that he has actually abused anyone.
If the only evidence is the recollections of ageing minds, that is not enough. Nor is it sufficient evidence to lock up those who are still alive – at least, it shouldn’t be.

The zealots, the police, the CPS and the industry all tell us that if the above measures were introduced, the guilty might go free.

So what? If introducing the suggested changes means that the innocent will not end up in jail and not die there (as they often do), the changes are worth it."

BBC row mustn’t stop praise where it is due

"IF instead of being alive, angry and wealthy enough to sue, Lord McAlpine was dead, then he would now be firmly established in our minds as a paedophile and grieving relatives would have no recourse to justice. It is time to drop the law which says you can libel the dead with impunity and introduce the kind of provisions that prevail in some other countries, whereby relatives can sue for distress caused.

Newsnight ignored the blooming obvious, which is that if an independent inquiry after extensive analysis had decided there was no evidence to connect Lord McAlpine with what went on then there might be grounds for caution.

To be fair that was exactly the same reasoning on which the Jimmy Savile programme was dropped: some of the women complained they had been to police but had received a letter saying the star was too old and frail to be prosecuted but nobody could produce the letter and when a version did come to light it was demonstrably a fake."

The Merry Knives of Winsor and yet Another Savile Inquiry.

"Ping! went the computer in the middle of the night as a rash of correspondents e-mailed to warn me that yet another Savile report was out. Several pointed to the Guardian headline published a dutiful couple of minutes after the report’s embargo deadline of midnight.

“Police could have stopped Jimmy Savile in the 1960s, says official report”.

Don’t tell me that the Bebe Roberts spurious Daily Mail article had been accepted as fact, surely not! No link to any report of course, they wouldn’t want we plebs actually looking at the source and checking facts would they? It took half an hour or so to track down the report, since it was only available to the public at midnight and Google was a bit slow in finding it. The main stream media get it hours beforehand, so that they have a chance to get their agenda straight. Consequently I haven’t had a lot of much needed beauty sleep…

Once I had the report in my hand, it didn’t take long to track down the offending paragraph, page 7 actually; it is the only part of the report that could possibly be twisted into that categorical statement that ‘Savile could have been stopped’.

"It is impossible to state categorically that a prosecution would have resulted, if all these links (including the MPS intelligence) had been made known, not only to all the investigating teams but also to the Crown Prosecution Service (CPS)."

OK, the Guardian headline is true only in the sense that if today’s guidelines for informing alleged victims of the presence of other alleged victims had been in place back 50 years ago the CPS might have taken a different view, and might have acted differently, and it might have resulted in Savile being taken to court, and that might have resulted in a successful prosecution? Not that this redefinition stopped a rash of commentators landing on the Guardian web site saying ‘knew it all along, protected by the mighty and the powerful, da dum, da dum’."
