"2. Notification Requirements

2.1 What the requirements are

The notification requirements for those convicted or *****cautioned***** for sexual offences (commonly referred to as the ‘sex offenders register’) were initially introduced to England, Wales, Scotland and Northern Ireland as part of the Sex Offenders Act 1997. This system, which applied retrospectively, was amended under Part 2 of the Sexual Offences Act 2003 meaning that relevant offenders were required to notify certain personal details to the police in their area. These included:

>Name and any aliases;

>Date of birth;

>National Insurance number;

>Main address and any addresses at which they reside for more than 7 days in 12 months;

>Foreign travel plans of three days duration or more

>Any changes to the above details.

However, under the Sexual Offences Act 2003 (Notification Requirements) (England & Wales) Regulations 2012, since the August 2012 those subject to notification requirements are also required to:

>Notify the police of all foreign travel (including any period of less than three days);

>Notify weekly where they are not registered as regularly residing or staying at one place (i.e. where a registered sex offender has no sole or main residence and instead must notify the police of the place where he can regularly be found);

>Notify where they are living in a household with a child under the age of 18. Under the changes, those subject to the notification requirements will be required to notify when residing or staying in a relevant household for a period of at least 12 hours with a child who is under the age of 18;

>Notify bank account and credit card details. This has been explained by the Home Office as being necessary to tackle Internet child pornography. Whilst the legislation requires notification of bank accounts, credit and debit cards held by the offender or jointly, it does not require details of accounts, credit or debit cards held independently by family members to be provided.

These details must be provided in person at a nominated police station within 3 days of the conviction or caution and must be updated on an annual basis. Failure to comply with the notification requirements is a criminal offence punishable by up to 5 years imprisonment.

The basics

These orders are civil behaviour orders or ‘preventive orders’ imposed upon conviction (‘post-conviction orders’) or upon complaint (‘stand-alone orders’). The former are by far the most common.

The orders specify terms which prohibit the person subject to the order from doing certain things. The orders are targeted at sexual offending and are designed to prevent the commission of acts or offences which would cause serious sexual harm to another person.

SOPOs are from the same family as ASBOs. A SOPO operates in a similar way to an ASBO in that it is preventative in nature, targeted at the behaviour of the person subject to the order. Consequently, many of the principles are the same.

Power to order

Stand-alone orders

The power is a discretionary power.

A Chief Officer of Police may by complaint make an application if a) it appears that that the defendant has been convicted of a Schedule 3 offence (list here) or a Schedule 5 offence (list here), or if he has been *****cautioned***** for such an offence, and b) the defendant has acted in a way as to give reasonable cause to believe that an order is necessary.

Sex case defendants 'should get anonymity'

"Maura McGowan - When a defendant is convicted "everything [sic] should be open" says Maura McGowan

Suspects in sex cases should have their identities protected until they are convicted, a senior lawyer has said.

Maura McGowan QC, chairman of the Bar Council of England and Wales, said defendants should get the same right to anonymity as complainants.

She wants the change because sexual allegations carry "such a stigma".

But the charity Rape Crisis said anonymity for defendants would discourage people from reporting sex crimes and "victimise victims [sic] further".

Ms McGowan told the Stephen Nolan Show on BBC Radio 5 live: "Until they have been proven to have done something as awful as this, I think there is a strong argument in cases of this sort - because they carry such stigma with them - to maintain the defendant's anonymity."

Times crime editor warns of “chilling effect” of Leveson Inquiry

"The crime editor of the Times has said the “chilling effect” of the Leveson Inquiry and the Metropolitan police’s “internal clampdown” has led to there being “virtually no social contact with officers”.

“In the current climate, if you arranged to meet an officer you’d be looking over your shoulder the whole time,” Sean O’Neill told the Inquiry this morning.

He expressed his fear that building up a relationship of trust with contacts would be “seriously inhibited” if it were impossible to meet them for coffee, noting that he had “bought officers and staff cups of coffee, pints of beer, lunches and evening meals”."

Child safety merger condemned as ‘dangerous’


"Theresa May’s plans to shake up Britain’s world-renowned child protection squad have been condemned as potentially dangerous.

The Home Office said yesterday that the Child Exploitation and Online Protection Centre (Ceop) would investigate the scandal of street grooming gangs exposed by The Times last week.

But Jim Gamble, who quit [oh yes, quit ;) ] recently as head of Ceop, and other prominent supporters of the unit in Britain and abroad, said that the Home Secretary’s plans to subsume it into a new FBI-style agency were ill-informed, politically motivated and potentially dangerous for child safety."

Convicted paedophile [sic] seeks damages from Facebook

"A convicted child sex offender, who won a landmark court case forcing Facebook to take down a website page monitoring paedophiles [sic], is now seeking damages.

On Friday, Facebook was given 72 hours to take down the page 'Keeping our kids safe from predators', which had focused on paedophiles [sic] in Northern Ireland.

The man took the case after discovering that his photograph and threatening comments were posted on the page.

Facebook complied with the order, but a similar page appeared within hours.

The High Court judge who ordered the removal of the original page, Mr Justice McCloskey, held that the contents of the original version amounted to prima facie harassment of the man and risked infringing his human rights."

"When he issued the proceedings against Facebook, the man claimed harassment, misuse of private information, and a breach of his right to privacy and freedom from inhuman or degrading treatment.

Mr Justice McCloskey's written judgment discloses that one of the remedies being sought is a claim for damages against Facebook Ireland Ltd.

That issue has not been determined, with the ruling only on interim relief.

The court heard the man suffers from ill health and fears being attacked or burnt out of his home.

In a statement filed as part of his case he said: "I am in fear for my safety and in a state of constant anxiety as I believe if this material continues to be published it will only be a matter of time before the threats materialise into an attack on me or my home.

New Paedophile [sic] Monitoring Page On Facebook

"Just hours after a challenge from a convicted sex offender sees one page shut down a new version can be found online.

Facebook was told to remove the offending page

A new Facebook page which claims to be an information service on the whereabouts of paedophiles has been set up just hours after a judge ordered a similar one be removed.

A convicted paedophile, known only as XY, started court proceedings in Northern Ireland against the social networking site after discovering his photograph and threatening comments had been posted on the page called Keeping Our Kids Safe From Predators.

He claimed harassment, misuse of private information, and a breach of his right to privacy and freedom from inhuman or degrading treatment.

High Court judge Mr Justice McCloskey ruled his human rights had been breached and said Facebook must take down the page within 72 hours.

However, during the afternoon a new page with the title Keeping Our Kids Safe From Predators 2 could be found on the site.

Facebook to Track ‘Keeping Our Kids Safe From Predators 2’ Paedophile [sic] Monitoring Page

"The second page has gained over 3,500 Likes since it appeared online

Facebook said it will track the content of a paedophile [sic] monitoring page after it was forced to remove an identical predecessor page by a high court order.

The page "Keeping our kids safe from predators" was removed after a convicted sex offender who appeared on the page won a court order against it. A judge ruled that some of the content amounted to harassment and breached the man's human rights.

Almost immediately, however, a second Facbook page, "Keeping our kids safe from predators 2", appeared on Facebook. Again, it features the names and pictures of convicted sex offenders.

The second page, which has gained over 3,500 "likes" carries a warning that rude or threatening comments will lead to the removal of the commentator.

A spokesman for Facebook told IBTimes UK that the page was not violating the company's terms and conditions but that it would be monitored.

A spokesman said: "Consistent with the court order, the [first] page is unavailable. We will be studying the text of the order before deciding on [our] next steps.""
