Julie Burchill entitled to 'offend' transsexuals, press watchdog rules

"Julie Burchill was entitled to write a controversial article about transsexuals because she was expressing her opinion, the Press Complaints Commission has ruled.

Burchill, pictured, launched the attack in defence of her friend and fellow writer Suzanne Moore.

The newspaper watchdog rejected claims that the columnist's description of transgender people as "d**** in chicks' clothing" and “a bunch of bed-wetters in bad wigs” was inaccurate or misleading.

It was “clear” from the tone of the article that Miss Burchill was using the phrases to voice her views, the regulator said, adding that the comments were "clearly distinguished from fact"

The article did not breach the PCC’s rules on discrimination because Miss Burchill did not single out any individuals, but referred “to transgender people generally", a ruling by the watchdog said."

Comment:

Few support freedom of speech, as much as we do, but, it is such inconsistencies, in logic, interpretation and decision (this stems from the PCC's media-protecting 'Code of Practice'), which has led to their downfall.

In doing so, due to their past ineffectiveness (in particular, against bullying, corrupt, lying and dangerous 'journalists'), this has led to the post-Leveson cull, which the media are now whining about; the PCC is, predominantly, the media and their associates.

Get them out, as soon as is possible, so that a consistent, agreed and evidenced-based approach may be adopted.

'Insulting words' crime ditched

"Theresa May Mrs May told MPs that free speech needed to be balanced with action against widespread offence

The crime of "insulting" someone through words or behaviour, which once led to the arrest of a student for asking a police officer whether his horse was gay, is to be dropped.

Home Secretary Theresa May confirmed to MPs that the government would not seek to overturn a Lords amendment scrapping the ban.

The director of public prosecutions has said it will not hinder his work.

But Labour warned that it could remove protections for minority groups.

Section 5 of the 1986 Public Order Act currently means that "threatening, abusive or insulting words or behaviour" might be deemed a criminal offence."

No Charges Over Tom Daley Tweet

"A footballer will not face charges over a homophobic tweet he posted about Olympic divers Tom Daley and Peter Waterfield.

Director of Public Prosecutions Keir Starmer said Daniel Thomas's message was "not so grossly offensive that criminal charges need to be brought" - and said the divers both agreed with the decision.

He added that new guidelines for prosecutors on social media cases would also be issued, given the growing number of complaints."

DPP statement on Tom Daley case and social media prosecutions

"“The Communications Act 2003 makes it an offence to send a communication using a public electronic communications network if that communication is “grossly offensive”. It is now established that posting comments via Twitter constitutes sending a message by means of a public electronic communications network. It is also clear that the offence is committed once the message is sent, irrespective of whether it is received by any intended recipient or anyone else. The question in this case is therefore whether the message posted by Mr Thomas is so grossly offensive as to be criminal and, if so, whether a prosecution is required in the public interest.

“There is no doubt that the message posted by Mr Thomas was offensive and would be regarded as such by reasonable members of society. But the question for the CPS is not whether it was offensive, but whether it was so grossly offensive that criminal charges should be brought. The distinction is an important one and not easily made. Context and circumstances are highly relevant and as the European Court of Human Rights observed in the case of Handyside v UK (1976), the right to freedom of expression includes the right to say things or express opinions “…that offend, shock or disturb the state or any sector of the population”."

Mum's anger over paedophile [sic] in Brighton park

"Charlene Vickery was shocked to discover her daughter was yards away from a convicted paedophile [sic]

A mother has said she will never go back to a park [great result for the little one, The Sun] after learning her two-year-old child was just yards from a convicted paedophile [sic].

Horrified mother Charlene Vickery has said she will not return to Pavilion Gardens in Brighton after learning that her daughter Chloe was just yards away from convicted sex offender KP.

Pictures published in a national newspaper over the weekend appeared to show 57-year-old P staring at a blonde child in Pavilion Gardens."

"Cheap, sensationalist journalism of the lowest kind by the national newspaper concerned in this case, and by The Argus.

The most likely outcome of this sort of media-driven panic will be to drive such offenders into hiding where they will no longer be monitored, so making the possibility of them re-offending greater.(As was the case on that estate in Portsmouth a few years back.)

Net result being that children will be at greater risk - so well done to The Argus; but at least it might add a few onto the circulation figures!"
