"The many possession offences include possession of certain drugs; racially abusive or threatening material; various forms of pornography or depictions of abuse; firearms or ammunition without a certificate; explosives; false identity documents; or even a television without a licence. And, of course, the object does not have to be in the same room (or same building) as you; you just need to have sufficient awareness and control for a prosecutor to show that the banned item was in your possession.

"The victim had five convictions for gross indecency and indecent assault in the 1980s and 1990s against boys aged between 14 and 17.
A man who admitted killing a convicted sex offender in a flat fire has been jailed for 10 years.
Daniel Martin, 25, set fire to a wheelie bin and pushed it up against the front door of AH's flat in Worcester in the early hours of December 14, 2011, sparking a rapidly spreading and ferocious blaze in which the 52-year-old was killed.
Sentencing Martin for manslaughter at Birmingham Crown Court, Mrs Justice Thirlwall said the crime was "shockingly stupid" (NS Sherlock].
She said he had intended "to do something so frightening, it would cause him (H) to move away from the area where he had lived since 2001".
"You say you threw stones at his window to try and wake him and say you saw a light come on," she added.
"Whatever you did, it was too little too late.
"You say your intention was only to frighten the victim and the prosecution accept you did not intend to kill or attempt to cause really serious harm."
She added she was "not satisfied" Martin was a danger to the public [really, wiggy?], but he "was a liar and thoroughly anti-social", with a lamentable record of previous convictions, albeit not for similar offences."

Judge Carroll Moran said OH a father of four, was guilty of a breach of trust and the fact he had abused his own child was a further breach of this trust.
A 61-year-old man who subjected his young daughter to years of sexual abuse has avoided a prison sentence after she indicated she did not wish to see him jailed.
Earlier this month, Limerick businessman and former guesthouse owner OH was remanded in custody and warned he would be going to jail after harrowing evidence of the abuse suffered by his young daughter was outlined at Limerick Circuit Court.
Mr H, with an address at Westbury, Co Clare, pleaded guilty to 12 counts of indecent assault of his daughter SR between January 1988 and December 31st, 1990, and a further 20 counts of sexual assault between September 1991 and December 1995.
The offences occurred at the former family homes in Foynes, Kilcornan and Adare in Co Limerick.
Ms R, who waived her right to anonymity, told gardaĆ the abuse started when she was five years old. She also recalled how she was beaten and chastised by her father for mispronouncing words."

LANSING (AP) -- More people will be added to Michigan's public sex offender registry under a bill signed by Gov. Rick Snyder.
The bill signed Tuesday will require people convicted of a single Tier I offense for some crimes involving minors to be placed on the online registry. Offenses that qualify include possessing child pornography and surveillance of a minor.
Republican Sen. Rick Jones is the bill's sponsor. He says it will add about 250 people to the public registry.
People convicted of such crimes must already register with the state, but their information is made available only to police. Currently only people convicted of Tier II and III offenses are placed on the public registry."

There are well over three quarter of a million (751,138) men, women and children required to register for offenses such as urinating in public, streaking, incest, exposure, rape, false accusations by a soon-to-be ex-wife, angry ex-girlfriend, accusations after a party where there was heavy drinking, or a spiteful student, viewing suggestive or abusive images of a person underage (16 in some states and 18 in others), solicitation, prostitution, endangering the welfare of a child and many other "offenses" resulting in a registry not being used as intended and that was to manage and track the most violent repeat offenders.
Our organization, Women Against Registry, advocates for the families of these folks who have been adjudicated, paid their debt to society and are living a law-abiding life. But, these families are subjected to harassment, beatings, vehicles damaged, signs placed in their yards, being asked to leave their church, organizations, flyers distributed in the community and even being murdered all because they are trying to help someone reintegrate into society."

"NEW YORK - The state's sex offender registration law is remedial, not punitive, and therefore does not violate the U.S. Constitution's ex post facto clause or double jeopardy when applied retroactively, a New York state appeals court ruled on Thursday.
The Appellate Division, First Department, said the 1996 Sex Offender Registration Act, or SORA, is not a punitive statute, even though several amendments have imposed stricter registration and notification requirements.
"It may be true that subjecting sex offenders to lifetime registration and notification requirements ... increases the difficulties and embarrassment [sic] a sex offender may endure," wrote Justice Richard Andrias for a unanimous four-judge panel. "However ... the fact that the restrictions are difficult and cumbersome [sic] is not enough to make them unconstitutional."

Pataki, that found SORA does not violate the ex post facto clause when applied retroactively because the law was intended to protect the public [how?] and enhance law enforcement's ability to investigate future sex crimes [pre-crimes], not to punish convicted offenders. As a teenager, I was groomed by a 76-year-old man with a penchant for the company of adolescent girls. He wore zip-up cardigans and looked like a normal grandpa. He wrote poetry, bought us gifts, and talked sagely about the importance of waiting for a special relationship before having sex.
He crossed many boundaries, many times, in ways which make me shudder looking back. He was too frail at that stage of his life to ever attempt anything more than a kiss in return for money, but police later told me that other victims from his youth were not so fortunate.
I don’t believe in monsters, or the devil, or the concept of evil. Dehumanization is counterproductive: The guy who groomed me was just one of many millions of screwed-up human beings with serious issues. And maybe (for the sake of his victims) if someone had tried to help him in his early life, hundreds of young girls could have been spared from those depraved compulsions.
“I am a sexual predator. I need help.” These are the chilling words in a letter penned in 2004 by Ariel Castro, the man accused of abducting three women and holding them hostage in his Ohio home for 10 long years.
In the handwritten note found by law enforcement officers at Seymour Avenue, Castro claimed he was abused by his parents and raped by his uncle as a child. The question is, should we care? As a mother, I think we should.
I’m not a pedophile [sic] apologist, to be clear. But vengeance for the loss of a child’s innocence is distracting us from the crucial search for preventive measures. Our collective disgust of pedophiles [sic] means we are distancing ourselves from gaining any understanding of them and pushing the problem further underground. If we want to protect our children, we need to know how."
"While Megan’s Law is certainly useful in soothing our paranoia, it does little to protect the 90 percent of child victims who are abused by a trusted adult well-known to them."
"As Stevens argues, most pedophiles [sic] “are nice people but with terrible, secret compulsions and addictions. I don’t believe in monsters, or the devil, or the concept of evil. Dehumanization is counterproductive: The guy who groomed me was just one of many millions of screwed-up human beings with serious issues. And maybe (for the sake of his victims) if someone had tried to help him in his early life, hundreds of young girls could have been spared from those depraved compulsions.
“I am a sexual predator. I need help.” These are the chilling words in a letter penned in 2004 by Ariel Castro, the man accused of abducting three women and holding them hostage in his Ohio home for 10 long years.
In the handwritten note found by law enforcement officers at Seymour Avenue, Castro claimed he was abused by his parents and raped by his uncle as a child. The question is, should we care? As a mother, I think we should.
I’m not a pedophile [sic] apologist, to be clear. But vengeance for the loss of a child’s innocence is distracting us from the crucial search for preventive measures. Our collective disgust of pedophiles [sic] means we are distancing ourselves from gaining any understanding of them and pushing the problem further underground. If we want to protect our children, we need to know how."
"While Megan’s Law is certainly useful in soothing our paranoia, it does little to protect the 90 percent of child victims who are abused by a trusted adult well-known to them."

Five-year sexual risk order
"A 22-YEAR-OLD man has been handed a five-year risk of sexual harm order by Bodmin magistrates to restrict his contact with female children.
MDP, 22, of no fixed abode, appeared before the court on August 30 when he was handed the order after an application by Devon and Cornwall Constabulary.
Under the terms of the order, P must not:
Have any contact or communication of any kind with any female child under 16 other than inadvertently and when it is not reasonably avoidable in the course of lawful daily life or with the consent of the child's parent or guardian (who has seen a copy of the order) and with the express approval of social services.
Live in the same household as any female child under 16 without social services approval.
Seek, obtain or engage in any employment, whether for payment or otherwise, which would bring him into contact with female children under 16 as a normal part of that employment or activity.
Loiter within a radius of 100 metres in the area of educational establishments, including nursery, junior and secondary schools, and all associated land and property.
P was ordered to pay £200 costs to Devon and Cornwall Constabulary."

Prevention order for Harpenden sex offender
"A 62-year-old man from Harpenden who was convicted of having a sexual relationship with a child in 2004 was made the subject of a sexual offences prevention order on Friday.
The order was handed to MA by St Albans Magistrates’ Court and has placed the sex offender under a number of restrictions including preventing him from accessing internet chat rooms ..."
" ... which also stops him from going on websites relating to the care and nurture of children, to be made after they raised concerns Angell was likely to reoffend because of his concerning behaviour.."
This comes after the court heard A was convicted in 2004 of engaging in sexual activity with a 12-year-old girl whom he met over the internet."

"A PROGRAM that has more than halved the rate of child sex crime reoffending has been axed.
Tony Vinson, from the University of Sydney, said yesterday that the program, which diverts ''suitable'' child sex assault offenders from the criminal justice system into a two-year treatment program, had helped protect children from reoffenders."
"The Attorney-General, Greg Smith, confirmed last night that the state government had axed the program as of Saturday..
"This program does not reflect community expectations and is not supported by the government,'' he said. "The community rightly expects those who engage in child sex assault to receive a custodial sentence."

Sex offenders testify against social networking ban
"One after another, nearly a dozen John Does took the stand in a fifth-floor federal courtroom in Lincoln this week.
You wouldn't know it by looking, but they all are convicted of crimes that landed them on the Nebraska Sex Offender Registry.
And they all are suing the state over changes state lawmakers made to it in 2009 -- specifically, a provision that says they have to provide to their local sheriff's office any remote communication device identifiers and addresses, including serial numbers, telephone numbers and account numbers.
They're also suing over a provision that sets out a penalty for those who knowingly and intentionally use any social networking site, instant messaging or chat room service that allows anyone younger than 18 to access or use it.
The state says the laws serve a significant governmental interest: to protect children from predators [sic]
The three dozen John Does say they violate their First Amendment rights and that, as written, the definitions could be construed to apply even to landline phone calls, cellphone texts and blogs.
Among those who testified were business consultants, IT contractors and retailers who make musical instruments and sell high-end car stereos.
Wednesday morning, one man, who has a software design and consultant business in Omaha, said the Internet is an extension of the real world."

Convicted sex offender said being on the register was 'biggest kick in the teeth'

His status as a sex offender was also "very testing" in his personal life because he was godfather to nephews and nieces, he said.
But Judge Hart told Fenemore there was nothing he could do because registration as a sex offender is automatic for a specified period depending on the sentence imposed.
"I wish you well for the future, I hope you can get your life back to normal," said the judge."

Boulder sex offender balks at 'intensive' probation, asks to be sent to prison
"Judge grants Justin Mathis' request, sentences him to 12 years
After months of being out of jail, a convicted Boulder sex offender self-revoked his probation, electing instead to go back behind bars to serve a 12-year sentence.
While parole violations are not uncommon, it's much less frequent that a sex offender on probation opts for incarceration -- and the scenario that played out in a Boulder courtroom last week helps prove that the treatment and probation program for sex offenders is rigorous, prosecutors say.
"It speaks to the stringency of probation when you've got somebody saying, 'I don't want to do this -- just send me back to prison,'" Boulder prosecutor Katharina Booth said.
But Denver defense attorney Gary Lozow -- who is not connected to the case of Justin P. Mathis, 37 -- countered that, if anything, such a decision illustrates that the program treats sex offenders like pariahs, making it difficult for them to transition back into society.
"At the beginning of the process and in the preliminary stages, there's an incredibly high price to pay for such an offense," Lozow said of Colorado's approach to treating sex offenders. "There's isolation. There's reporting. There's overtaxing dues to pay. The concept all but makes you a pariah. They require a process that lends itself to failure.
"The idea is to disintegrate you as a human being.""

"Officer mentions in the video that "the sex offender registry is the most significant punishment most sex offenders get," admitting it's punishment and therefore unconstitutional! He also says "to teach your children that nobody is suppose to touch them in their bathing suit area," but most sexual crimes occur by someone the victim knows, usually a parent or sibling."
