The unintended consequences of bail reform

"What of those simply released but still subject to investigation? The police must start with a presumption that all suspects can be treated in this way, so we must expect a great number of people will find themselves in this position.

They include those the police do not fear fleeing or committing other offences. And these are likely to be the people that would find the delay and lack of information most distressing – the elderly, children, those with clean records and the most to lose. I fear they will end up suffering more from delay and lack of information, than even those bailed under our present system."

Bail reform could lead to ‘endless investigation’

"According to the report by the College of Policing, there is a danger of investigations ‘without deadlines’. It reported that the average length of time individuals spent on pre-charge bail, including extensions, was 53 days; and that more than four out of 10 of all cases involving violence and sexual offences (41%) were bailed for more than 28 days.

Time allowed for forensic analysis was one of the main reasons for long periods of pre-charge bail with phone downloads being the most frequent type. The study found that six out of 10 cases involving suspects who were bailed for more than 90 days involved some form of forensic analysis."

Google’s Role In Woodland Child Pornography Arrest Raises Privacy Concerns

"The FBI says the investigation began in March when Google’s hashing technology found two child porn pictures in his Picasa library. Picasa is a cloud-sharing platform for images owned by Google.

From there, the company notified the National Center for Missing and Exploited Children, which says it found more images on a Tumblr account owned by G. That’s when the feds took over."

Of course, anyone who is not lying, or has a modicum of knowledge and/or principles, knows, that these search terms would never bring up any potentially-illegal images, and have not been able to do so, for many years; knowing that, there is no intention, here or elsewhere, to do so. We do know, that they will be on 'the list'.

Bing, first. SafeSearch off. We could turn images off, but, we will take Microsoft's word for it, as a newbie will.

Web search ...

Much as before, now image/videos/news search ...

We have no idea what the 100,000 possible search terms could be !!!

Now, the zealots, profiteers and simpletons, will be jumping up-and-down, for joy, about that result (not that it stops anything, that really matters, of course).

However, the bonafide researcher and Libertarian should be very concerned, indeed.

Image searches lead, often more rapidly, to very valuable (re)sources ... for example, court documents, media reports, related cases and issues etc. etc. etc.

This is, of course, the (predicted and usual) danger of knee-jerk, blanket, censorship.

This is a private company, Microsoft, throwing the baby out with the bath water, for popularity and profit.

This is the false flag, which is (and has been, for a long time) to be used, for all topics, which are, or will be, deemed to be unacceptable, for our consumption.

This is where we are in 2013 ... and it has little to no point (as suggested), at all.

Next time, Google.

Online child safety [sic] – big things [sic] happening

"Pulling out the stops

Google and Microsoft have really pulled out the stops. This is a very impressive initiative. It is narrowing the spaces in which paedophiles [sic] and collectors of child abuse images [sic] can operate. The challenge now is to work out how to gauge the effectiveness of and learn from the various measures that are being put in place but I am sure there is a will so we can find a way.

The beginning of a new phase

This is unlikely to be the end of the story but there is no question we have reached an important milestone. There are still anxieties about the Darknet and the true extent to which it and the use of encryption may continue to frustrate law enforcement’s and everybody’s efforts. But we don’t always have to do the really hard stuff first. Dealing with the more open parts of the internet has to be a key priority precisely because it is so accessible and therefore has the greater potential to draw in new offenders. All the companies involved deserve a great deal of credit for their willingness to sail into these uncharted waters and so does Claire Perry MP and the Government as a whole for sticking with the issue in the way that they have. I await with interest to see how what is happening in the UK starts to roll out or impact other jurisdictions."

Laboring In The Shadows To Keep The Web Free Of Child Porn

"Internet search providers like Google and Microsoft are also investing in similar programs."

"The Microsoft system, known as PhotoDNA, was co-developed by a team at Dartmouth and has since been donated to the National Center for Missing and Exploited Children. Earlier this year, Twitter began using it to scan every photo that's uploaded to its site.

The program works by scanning known images of child pornography and giving them a unique signature that goes into a database. If that image appears on another site, it is instantly flagged and removed. Google has its own proprietary tagging system that works in a similar way.

But in order for an image to be identified as child pornography in the first place, a person has to review it. The people who do that work for tech companies are employed all over the world, and very little is known about them, says Sarah Roberts of Western University in Ontario, Canada."

Efforts to end child pornography have been ineffective

"In continuing this internet blockade against child pornography, Google has also proposed a solution, a database of “encrypted” child porn images that is said to enable some companies and law enforcement to further collaborate on detecting and removing these photos from the possession of predators.

Google uses technology known as “hashing,” which is similar to Facebook’s photo tagging capabilities.

The software allows the company to tag images with an identification code that is reported and blocked by other companies when locating a duplicate image elsewhere on the web.

Ironically, Google, which is in the business of making news and information widely available, is creating a content blockade."

Sometimes Of Dubious Quality, At Least

Criminal assessments 'utterly useless'

"Assessment tools used to predict how likely a psychopathic prisoner is to re-offend if freed from jail are "utterly useless" and parole boards might just as well flip a coin when deciding such risks, psychiatrists say.

Publishing a study that found risk score tools were only about 46 per cent accurate on how likely psychopathic convicts were to kill, rape or assault again, they said probation officers and judges should set little or no store by such tests.

They warned that clinicians carrying out such classifications must be aware of their severe limitations, and make sure prisoners undergo comprehensive psychiatric diagnosis before any risks assessment is made.

"If you apply these (tests) to somebody who is a psychopath, they're utterly useless, you might as well toss a coin," said study leader Jeremy Coid, director of the forensic psychiatry research unit at Queen Mary University of London.

"They will not predict accurately at all," he told reporters at a briefing in London about his findings.

Coid and other forensic psychiatrists said the findings - which also showed the tools performed only moderately well in prisoners with disorders like schizophrenia, depression, drug and alcohol dependence - could have major implications for risk assessment in criminal justice systems."

Sex Offender Scapegoats, Used To Justify Everyone's Loss Of Liberty

11 September 2013

New DNA database will have profiles of 1,000 sex offenders

"THE new DNA database will contain profiles of over 1,000 sex offenders.

It will allow the Gardai to match a DNA profile from a persona to an unidentified DNA crime scene profile – and also to quickly eliminate other suspects.

The new DNA database will also include past and present samples from crime scenes – in a move which may help to resolve unsolved cases.

It will operate using software supplied by the FBI at the Forensic Science Laboratory – which is based in Garda Headquarters in the Phoenix Park.

Justice Minister Alan Shatter said that the database would include all those on the sex offenders register once the legislation came into effect. There are currently 1,280 people on the sex offenders register.

Gardai will be allowed to take mouth swabs or hair follicles from convicted criminals and criminal suspects so that DNA profiles can be created and entered onto the database to check for possible matches against crime scene samples.

As well as sex offenders, most of the samples taken will be from suspects arrested in connection with serious offences carrying sentences of five years or more."

The Field Of Risk Assessment Would Benefit From Routine Disclosure And Registration Of Research Studies

Wednesday, September 4, 2013

Risk assessment tools plagued by 'authorship bias,' study finds

"Reported predictive validity higher in studies by an instrument's designers than by independent researchers

The use of actuarial risk assessment instruments to predict violence is becoming more and more central to forensic psychology practice. And clinicians and courts rely on published data to establish that the tools live up to their claims of accurately separating high-risk from low-risk offenders.

But as it turns out, the predictive validity of risk assessment instruments such as the Static-99 and the VRAG depends in part on the researcher's connection to the instrument in question.

Publication bias in pharmaceutical research has been well documented

Published studies authored by tool designers reported predictive validity findings around two times higher than investigations by independent researchers, according to a systematic meta-analysis that included 30,165 participants in 104 samples from 83 independent studies."

http://forensicpsychologist.blogspot.co.uk/2013/09/risk-assessment-tools-plagued-by.html

Are Forensic Experts Biased by the Side That Retained Them?

"Abstract

How objective are forensic experts when they are retained by one of the opposing sides in an adversarial legal proceeding? Despite long-standing concerns from within the legal system, little is known about whether experts can provide opinions unbiased by the side that retained them. In this experiment, we paid 108 forensic psychologists and psychiatrists to review the same offender case files, but deceived some to believe that they were consulting for the defense and some to believe that they were consulting for the prosecution. Participants scored each offender on two commonly used, well-researched risk-assessment instruments. Those who believed they were working for the prosecution tended to assign higher risk scores to offenders, whereas those who believed they were working for the defense tended to assign lower risk scores to the same offenders; the effect sizes (d) ranged up to 0.85. The results provide strong evidence of an allegiance effect among some forensic experts in adversarial legal proceedings."

A view from… the police interview room

"My view from the Police Interview Room, by Tracey McMahon

I’ve always had an interest in law and the wheels of justice. I’ve watched crime dramas such as The Bill, Prime Suspect and a plethora of television programmes. I have commented on many forums reviewing such shows. I’ve read court reports, followed high profile cases and shouted with the rest of them when a case which raises hackles is presented to the public by the media. I can tell you first-hand that being on the wrong side of the law is nothing as it portrayed by drama serials.

I am known as an offender. This is the modern-day; politically correct term for a criminal. I’ve had my name in the press, on Twitter, on Facebook and well, I wouldn’t be surprised if my name doesn’t crop up on some people’s lips as they have their morning cup of tea. Particularly those who I have done harm to; my family.

I was never arrested as procedures have now changed. I was ‘invited’ to attend the police station on a voluntary basis. Had I not accepted this invitation then I would likely have been arrested and brought in for questioning. Off I marched at 10.00am on Monday 12 March to my police interview, dressed as if I was going to be sitting on the board of a global conglomerate."

Ask.fm: ‘Hannah sent hate notes to herself’

"David Smith and daughter Hannah David Smith says daughter Hannah was ‘desperate'.

THE website Ask.fm, on which Hannah Smith, 14, received hate messages before she was found hanged, has provoked further controversy by claiming she posted many of the comments herself.

Ask.fm executives are understood to have said privately that the company has analysed the profiles of the senders of the bullying messages and concluded that Hannah had set up most of the anonymous identities herself and sent the vast majority of the messages.

“With the Hannah case, the company have looked at every identity — the IP addresses are trackable. She posted the anonymous things herself. The police has all that data,” a source claimed.

In private briefings last week, the company said “98%” of the messages had come from the same IP address as Hannah’s, with about four posts that had not."

Child pornography trial collapse

"The trial of one of Scotland's most successful Highland Football League managers, who was charged with downloading child pornography, has collapsed.

GC went on trial at Aberdeen Sheriff Court facing three charges relating to child porn.

Mr C, 41, from Aberdeen, was accused of downloading more than 200 photographs of youngsters on computers at his city home. But the former football manager – who retired from Buckie Thistle last year – denied the offence.

Forensic experts admitted the images could have got on to his equipment without his knowledge and could not prove he had seen them."

The non-sense of prison psychology

"Anthony Boden uncovers the inconsistencies of a ‘pseudoscience’

I am a post-tariff IPP. Along with many others in the same position to say that I am frustrated by this sentence would be a gross understatement. My biggest complaint is the government-prescribed, psychological abuse delivered in the form of Offending Behaviour Programmes. There is no scientific basis behind OBPs, which are nothing more than psychological experiments. This country condemned the Nazi’s for conducting psychological experiments on prisoners during World War II, and yet we allow this travesty to continue upon our own shores and in our own prisons. Every intelligent being should ask themselves how this inexcusable position has arisen and what can be done to resolve the issue. I have already formulated my own theories, which I will explain with the help of some of the greatest minds in history.

It was Marie Curie who said, ‘Nothing in life is to be feared, only to be understood. Now is the time to understand more so that you may fear less ...’"

"As a forensic (though not prison) psychologist, I have a great deal of sympathy with Anthony's frustrations. However, quoting Feynman is a bit risky, partly because he wasn't a psychologist, and partly because his views must be somewhat out of date as he is somewhat dead (25 years ago this year). Also, he is somewhat wrong - for example, in stating that psychological experiments don't get repeated. Anyway, none of this actually bears on the scientific status (or otherwise) of present day UK risk assessment.

There has actually been some respectable scientific investigation of risk assessment techniques. For example, a couple of studies have recently investigated the SARN, and demonstrated that the allegedly "dynamic" factors assessed do not have any predictive power over and above that of the static factors of the Risk Matrix 2000. In other words, if someone is assessed using the SARN, this cannot tell us anything at all about his risk before "treatment", his risk after "treatment", or any improvement during it. Therefore, assessments of alleged "unmet treatment needs" which depend upon the SARN are scientifically invalid. I have seen such an assessment successfully challenged in a parole hearing (the man was released) and am astonished that no one has apparently challenged it in the High Court. This is even more astonishing, because studies have been available for as long as 15 years showing that certain "risk factors" routinely assessed in sex offenders are in fact not risk factors at all. A 2005 study concluded: “Many of the variables commonly addressed in sex offender treatment programs (e.g., psychological distress, denial of sex crime, victim empathy, stated motivation for treatment) had little or no relationship with sexual or violent recidivism.” Yet people carry on as if nothing had happened.

Another practice which has been scientifically investigated, and shown to be invalid, is the practice of "adjusting" static risk assessments in the light of clinical information. For example, saying something like "the Risk Matrix 2000 says this man is low risk, but in the light of XYZ I would estimate his risk as medium". A number of studies have shown that altering a static risk assessment in this way reduces its accuracy. Always. This is mathematically inevitable, because clinical estimation of risk has been scientifically demonstrated to be very poor, and mixing a poor predictor with a better one reduces the overall accuracy to the level of the poor one. Static risk predictors are not fantastic, but they are about 65 to 70% accurate, which may sound impressive until you realise that you can get 50% accuracy by tossing a coin. Still, they do better than chance.

What worries me is that those doing the risk assessment seem very often not to be aware of how limited it is. They should be."

Lie detector [sic] tests set to be introduced to monitor sex offenders

"Politicians expected to approve law allowing compulsory polygraph tests of sex offenders released into community [well, of course they are].

MPs are expected to clear the way for the introduction of compulsory lie detector tests to monitor convicted sex offenders across England and Wales from next January.

The national rollout of US-style mandatory polygraph tests for serious sex offenders who have been released into the community after serving their prison sentence follows a successful pilot scheme. The trial was carried out from 2009-11 in two Midlands probation areas and found that offenders taking such tests were twice as likely to tell probation staff they had contacted a victim, entered an exclusion zone or otherwise breached terms of their release licence.

Continuing concerns about the reliability of the tests and misinterpretation of the results mean they still cannot be used in any court in England and Wales.

But it is expected that the compulsory polygraph tests will be used to monitor the behaviour of 750 of the most serious sex offenders, all of whom have been released into the community after serving a sentence of at least 12 months in jail ..."

Sense About Lie Detectors

"Lie detectors have been around for nearly 100 years. Despite debates over their accuracy and the ethics and legality of their use, the public and professionals remain intrigued by them.

Lie detectors mainly consist of polygraphs, voice analysis or brain imaging. These technologies are different but three points are relevant to all:

>They are not accurate.
>They do not measure lies but rather something that could be a proxy for lies.
>They all rely on the deterrent effect (that is, fear of being caught lying)."

Jeopardy law rapist gets life

"Coward ... rapist WB

A MAN who raped an OAP 16 years ago was jailed for life yesterday — after the double jeopardy law was overturned.

WB, 56, beat and raped a mum of one, 66, in her home in Stratford, East London, in 1997.

He was cleared in 1999 after a judge ruled DNA evidence against him could not be used against him.

Back then, a person could not be tried a second time for the same crime and builder B thought he had got away with it.

But changes to the law in 2005, to allow those cleared of a serious offence to be put on trial for the crime again, meant B could be retried for the rape.

Jurors at London’s Old Bailey were told a one-in-a-billion DNA match linked the grandfather of six, of Walthamstow, to the attack.

Coward B refused to come up from the cells to be sentenced.

Ordering he serve a minimum 10½years, Judge Peter Rook said he had committed a crime of “extreme violence and depravity”.

B beat his victim so badly she was unrecognisable. She died in 2002. Her family said: “She never got over it.”"

Prosecutor's fallacy

"The prosecutor's fallacy is a fallacy of statistical reasoning, typically used by the prosecution to argue for the guilt of a defendant during a criminal trial. Although it is named after prosecutors it is not specific to them, and some variants of the fallacy can be utilized by defence lawyers arguing for the innocence of their client.

At its heart the fallacy involves assuming that the prior probability of a random match is equal to the probability that the defendant is innocent.

For instance, if a perpetrator is known to have the same blood type as a defendant and 10% of the population share that blood type; then to argue on that basis alone that the probability of the defendant being guilty is 90% makes the prosecutors's fallacy, in a very simple form.

The terms "prosecutor's fallacy" and "defense attorney's fallacy" were originated by William C. Thompson and Edward Schumann in the 1987 article Interpretation of Statistical Evidence in Criminal Trials, subtitled The Prosecutor's Fallacy and the Defense Attorney's Fallacy.

The fallacy can arise from multiple testing, such as when evidence is compared against a large database. The size of the database elevates the likelihood of finding a match by pure chance alone; i.e., DNA evidence is soundest when a match is found after a single directed comparison because the existence of matches against a large database where the test sample is of poor quality may be less unlikely by mere chance.

The basic fallacy results from misunderstanding conditional probability and neglecting the prior odds of a defendant being guilty before that evidence was introduced.

When a prosecutor has collected some evidence (for instance a DNA match) and has an expert testify that the probability of finding this evidence if the accused were innocent is tiny, the fallacy occurs if it is concluded that the probability of the accused being innocent must be comparably tiny.

If the DNA match is used to confirm guilt which is otherwise suspected then it is indeed strong evidence. However if the DNA evidence is the sole evidence against the accused and the accused was picked out of a large database of DNA profiles, the odds of the match being made at random may be reduced, and less damaging to the defendant.

The odds in this scenario do not relate to the odds of being guilty, they relate to the odds of being picked at random."

Inside the mind of a murderer: Forensic psychology expert reveals key tools to solving crime

"DR Kathy Charles explains how analysing what's going on in suspect's head gives psychologists vital clues in the approach to securing a conviction.

Dr Kathy Charles has studied hundreds of brutal cases

UNDERSTANDING what makes a person commit murder or a sex crime is never an easy task but forensic psychologist Dr Kathy Charles knows exactly how their minds work [hahahahaha].

She has worked alongside police to profile criminals and dedicates her time to helping young offenders understand the reasoning behind their actions.

Now Dr Charles, 34, from Edinburgh, is passing on her expert knowledge to Scotland’s next generation of forensic psychologists. She is set to host a series of fascinating lectures detailing her experiences on a number of cases.

She said: “I’ve always wanted to know why some people commit crimes and others don’t.

“It’s important to know how the mind works, especially if the focus of a police investigation is a serial killer, rapist or stalker.

“I worked on profiling Ipswich prostitute murderer Steve Wright and have profiled rapists and stalkers, too.

“Committing the offence is one thing but understanding why is completely different.

“That’s where logic [hahahahahahaha] comes in and I often say it’s like piecing a jigsaw together.

“In some cases there is no obvious suspect and that’s where profiling becomes useful.

“By looking at the type of crime, the way it happened and the timeline, you can profile the type of person likely [figures?] to be responsible.

“In many cases [and there lies the proof of your errors - mere chance], when the suspect is caught the profile is almost spot-on.”"

SpotOn NYC: Communication and the brain – Don’t Worry, It’s Science: There’s A Brain Scan

"When writing about anything pertaining to psychology or human nature, people love nothing more than a brain image lit up like a Christmas tree. These omnipresent images have been mockingly termed “brain porn”, defined by journalist Alissa Quart as a “willingness to accept seemingly neuroscientific explanations for nearly everything.”

According to a team of British scientists led by Cliodhna O’Connor, many popular science articles will include “logically irrelevant neuroscience information” intended to “imbue an argument with authoritative, scientific credibility” (McCabe & Castel, 2008; O’Connor et al., 2012). You might see scientists or science writers displaying neuroimaging data as proof that their claims are objective or real."

Brain scans predict which criminals are more likely to reoffend

"Neuroimaging 'biomarker' linked to rearrest after incarceration

Activity in a particular region of the cortex could tell whether a convict is likely to get in trouble again.

In a twist that evokes the dystopian science fiction of writer Philip K. Dick, neuroscientists have found a way to predict whether convicted felons are likely to commit crimes again from looking at their brain scans. Convicts showing low activity in a brain region associated with decision-making and action are more likely to be arrested again, and sooner."

Brain Scans Predict Which Criminals Are Most Likely to Reoffend

"Brain scans of convicted felons can predict which ones are most likely to get arrested after they get out of prison, scientists have found in a study of 96 male offenders.

“It’s the first time brain scans have been used to predict recidivism,” said neuroscientist Kent Kiehl of the Mind Research Network in Albuquerque, New Mexico, who led the new study. Even so, Kiehl and others caution that the method is nowhere near ready to be used in real-life decisions about sentencing or parole."
