When Careless And Unlucky, Hurting, Parents, Via Extreme Offenders, Challenge Already Bad Law

Very rarely, and very unfortunately, in a world of erring human beings, there is a coincidence of a number of circumstances, which leads to a terrible tragedy.

Sarah Payne, James Bulger, Madeleine McCann, April Jones etc, the list is relatively short, but very real. This is where parental responsibility has been lacking, even dangerously-lacking, but, paths have been crossed, with men in extreme mental states (usually), bent on carrying out unacceptable and, ultimately, devastating acts.

With these incredibly rare cases, comes the backlash, regret, grinding consciences, self and group recriminations, ill-informed, spineless and votemongering political populism, knee-jerk reactions and the dangerous input, of those with financial and other vested interests.

At these times, bad laws are created and regressed.

Suspended sentence for former Met police officer’s stack of child abuse images

"The way in which the new guidelines operate is still settling down (they were only ‘in force’ from 1 April 2014), however in relation to image offences it seems rather straightforward. There are 3 categories (formerly the courts used the COPINE scale which placed images into one of 5 categories) A, B and C. The guideline states:

In most cases the intrinsic character of the most serious of the offending images will initially determine the appropriate category. If, however, the most serious images are unrepresentative of the offender’s conduct a lower category may be appropriate.

That places L (almost unarguably) into category A. Not only are those the most serious, but also, the “justice” of the case is done by categorising this as a Cat A case as most of the images are at that level.

The starting point is therefore 12 months custody. Add in the aggravating features such as the use of police property, the fact he was a serving police officer and the number of images – not an extremely high number but it is clear that this is not a case of experimentation which was quickly desisted.

Take account of the mitigation, including the PTSD, the alcoholism and his previous character (serving in the army and the police etc.) and the guilty plea, a sentence of 12 months does not seem inappropriate."

"A woman who has suffered abuse at the hands of a family member says she does not feel safe to seek help because of the fear that her personal details will be released in court.

The teenager, who has refused to be named for fear of reprisals, said her life has been threatened if she speaks up. She said she is too scared to go to court to seek protection in case her address is revealed during those proceedings, or any subsequent appearances.

Her story emerges as a group of MPs demand that a "dangerous anomaly" in the court system, which Channel 4 News revealed in October is placing victims back in harm's way, be addressed."

New sentencing guideline gives greater focus to impact [when there are none?] of sex offences [sic] on victims [when there are none?]

"The Sentencing Council has published a new sentencing guideline for sexual offences [sic] which will help ensure appropriate and consistent sentences for sex offenders [sic] .

The guideline covers more than 50 offences including rape, child sex offences, indecent images of children [N.B. not the same], trafficking and voyeurism, and brings significant changes to how offences are considered by the courts.

It marks a step forward in how courts take into account the impact [when none?] of sex offences [sic] on victims. As well as physical harm, the new approach will reflect more fully the psychological and longer term effects on the victim, enabling courts to take into account the true extent of what the victim has been through [because this cannot be proven].

The guideline also takes an expanded approach to how courts assess offenders, looking at the full context of offending behaviour and motivation in committing any offence. This means giving more significant emphasis to important aspects like grooming activity by both individuals and gangs, the targeting of vulnerable victims such as those in care and offenders’ abuse of trust and positions of power or status so that these are clearly reflected in sentence levels.

The guideline makes it clear that victims are not responsible for what has happened to them. [not 'responsible in law', but, often, participatory] This is particularly emphasised in relation to offences committed against children. In the previous guideline there were child sex offences labelled as involving ‘ostensible consent’ – that is, where a child over 13 has apparently agreed [apparently?] to sexual activity. The Council believes that this is the wrong way of looking at these offences [you mean, as the truth? - BTW, who are you to decide what is 'wrong' or 'right', in this context?] as children do not consent to their own abuse [abuse - you mean pleasure? Of course, many (likely to be the majority) consent to their participation]. The new guideline therefore looks more at the offender’s actions and behaviour towards the victim.

The new guideline also brings increases in sentencing starting points and sentencing ranges for some offences. For example, in relation to rape, the new guideline allows top category sentences with a starting point of 15 years. The previous guideline only allowed sentences with this starting point for multiple rapes. Sentences of 20 years and above are also now recommended for campaigns of rape. In addition, the worst cases of assault by penetration can now receive the same sentences as rape.

The guideline simplifies the system for assessing indecent images of children which will make analysis of imagery much easier when evidence is being compiled against someone being prosecuted. The new guideline moves away from concentrating on just the number of images [which it never did] and gives more emphasis to what the offender is doing with the images – possessing, distributing or creating – to help assess the offending behaviour and appropriate sentence level.

The guideline also takes account the increased use of technology in offending since the previous guideline was issued in 2004. In relation to many of the offences, a new aggravating factor in the guideline is of recording the crime ['taking', yes? Not 'making'] as filming and photographing victims has become more common since the previous guideline was produced.

Due to the growth in online offending, the Council has ensured that guidelines, such as for sexual activity with a child, cover offending committed remotely such as via webcam. It also takes into account aspects like offenders lying about their age, grooming via social media or asking children to share indecent photos of themselves. Factors like the encryption of imagery and recording of an offence, which is increasingly common, will also increase sentence length.

While the guideline covers the ways these crimes are committed today, it remains flexible enough to deal with future technological evolution.

Public protection is central to the guideline which reinforces the importance of proper punishment and the prevention of reoffending, either through significant custodial sentences or rigorous treatment programmes that will address the offender’s behaviour.

This is the largest and most complex guideline the Council has produced and it was created after a very substantial period of consultation with criminal justice professionals and research with victims and judges. It was also subject to a public consultation, and responses were received from a very wide range of people including groups representing victims, judges, magistrates, lawyers, the police, NGOs, the Government, academics, medical practitioners as well as the wider public. The Council has made many changes to the guideline as a result of their views, for example, to the factors that should be considered in relation to harm and culpability, sentence levels and mitigating factors. Changes include:

>allowing proper consideration of the vulnerability of the victim such as through age or disability or a background of physical or emotional abuse;

>broadening the wording of various aggravating factors to ensure they cover the great range of offending, for example in relation to abuse of trust where an offender has abused the trust that may come with status or image;

>ensuring good character can now be an aggravating factor [what???!!!] when it has facilitated an offence – such as when it leads a child to trust the offender, makes it harder for them to report an offence or be believed; and

>adding various new aggravating factors. In relation to exploitation offences, ‘threats of exposure’ to family or others is now included to cover situations where this is used as a further means of controlling victims.

Chairman of the Sentencing Council, Lord Justice Treacy [Establishment Stooge] said:

“This guideline will make real changes to the way offenders are sentenced for these very serious, sensitive and complex offences. It will help judges and magistrates sentence in a way which protects our communities from this kind of offending and the suffering it causes.

“We have taken on board the views of victims, criminal justice professionals and the wider public to produce an approach to sentencing which people can understand and have confidence in. This approach will enable sentences that reflect what the victim has been through and take in a full profile of what the offender has done, such as grooming victims or abusing trust.

“No one wants more people falling victim to offenders who come before the courts, and public protection is central to this guideline, whether this is by jailing offenders or, where appropriate, imposing a rigorous treatment order and other restrictions to prevent reoffending.”

National Policing Lead for Violence and Public Protection Chief Constable David Whatton said:

“The new guidelines from the Sentencing Council show how well the Council listened during its consultation. The guidelines complement the new CPS and College of Policing guidance and are indicative of the move across the criminal justice system to ensure that police, prosecutors and judges take a victim-centred approach when dealing with sexual offences while still ensuring the integrity of the justice system.

“Across the justice system, changes have been made to ensure that the alleged offenders’ behaviour and the context and circumstances of the incident are scrutinised, rather than the credibility of the victim. These changes are intended to ensure that across the board our response to sexual offenders is robust and victims get the support they need. The new Sentencing Council guidelines will ensure offenders who are brought to justice are dealt with appropriately.”

Barnardo’s deputy director of strategy Alison Worsley, said:

“It is difficult to imagine the torment experienced by the vulnerable victims of crimes such as these. The publication of this new sentencing guideline will help to ensure the focus is on the perpetrator and not the victim.

"As the guideline emphasises, it is plain wrong to imply in any way that the experiences of sexually exploited children are something they bring on themselves. Barnardo’s Remember They are Children campaign showed that no child can ever truly agree to their own abuse. “If we are to turn the tide in the fight against these awful crimes it is vital that victims feel they will be taken seriously and dealt with sensitively at all levels of the justice system.”

The guideline will come into force in courts in England and Wales in April 2014 and replace existing guidance which was issued by the Sentencing Council’s predecessor body following the Sexual Offences Act 2003. Sentencing levels for sexual offences have been increasing since the Act, and existing sentencing guideline, came into force, and the new guideline reflects these increases. They do not include any reductions in sentences from current sentencing. [what a surprise, there is the unaccountable mission creep]

The new guideline covers 54 very varied offences and aims to ensure appropriate sentences are given for the wide spectrum of offending that takes place. However, where judges feel that they are dealing with an exceptional case, they can sentence outside the guideline ranges and up to the maximum permitted by law.

They will apply to all adult offenders, regardless of when offences took place, so while offenders will be subject to the law at the time of the offence, the guideline will bring a modern [regressive] and victim-focused [not rights-focused] approach to how historic offenders are dealt with by the courts."

Interview with the Attorney General

In this week's programme, the Attorney General for England and Wales Dominic Grieve speaks to Joshua Rozenberg in an extended interview.

To begin, they discuss the issue of sentencing and the attorney general's role as gatekeeper to the appeals court. How does he go about deciding whether a sentence is lenient or unduly lenient - and therefore worthy of an appeal? What are the factors he takes into consideration? And how can members of the public make an appeal to his office, to ask for a case to be reviewed?

The programme also speaks to Lord Justice Sir Colman Treacy, a senior member of the Sentencing Council, about the council's advisory role, asking whether he thinks sentencing is becoming more lenient.

The conversation moves on to international law, and the recent raids by US special forces in Libya and Somalia, in which a suspected leader of Al Qaeda was detained. Ex-solicitor general Vera Baird banned from driving

"Vera Baird Vera Baird represented Redcar from 2001 to May 2010.

The former solicitor general Vera Baird has been banned from driving for six months after travelling at nearly 100mph along the M4 motorway.

Magistrates in Pontypridd rejected the QC's arguments to keep her licence. She claimed it would cause her hardship winding up her parliamentary affairs.

Former MP Baird, of Crouch End, London, lost her Redcar seat in May's election.

She was given five penalty points, which added to those already on her licence gave her an automatic ban.

She was also fined £400.

Baird, 60, had previously been found guilty in her absence but the case was reopened when she explained she had never received a summons."

Speeding drivers targeted

"Speeding and inconsiderate drivers are being targeted in a crackdown on anti-social behaviour in the Alnwick area.

Officers have been working with community volunteers on a Speedwatch scheme as well as visiting local schools to reinforce safety messages to the drivers of the future.

The crackdown has the backing of the Northumbria Police and Crime Commissioner Vera Baird, who is encouraging anyone concerned about anti-social behaviour to get in touch so action can be taken.

Federal Judge Refuses Prison Sentence For Convicted Sex Offender

"For a second time, a Detroit federal judge has refused to send a man to prison for possessing thousands of images of child pornography.

A federal appeals court last year had ordered Judge Arthur Tarnow to sentence R again, saying a punishment with no prison didn’t reflect the seriousness of the crime. The images showed bondage and torture.

RR returned to court Thursday and was placed on probation for several more years. Prosecutors had asked for a three-year prison sentence.

WWJ Legal Analyst Charlie Langton noted there are several factors that come into play when a judge determines sentencing."

"In recent years British society has become increasingly litigious.

Both the government and the public increasingly turn to the law to resolve problems.

Prime Minister Gordon Brown has beaten even his predecessor's record, introducing 2,823 new laws during his first year in office. This is the highest record for law-making by anyone at Number 10, and 40% higher than the annual average created by Margaret Thatcher.

Meanwhile, disputes between neighbours, and often trivial harassment cases, are increasingly likely to come to court. This legalistic approach to social and political problems is causing disquiet, however. Critics question whether fines or imprisonment are always the answer to interpersonal problems.

Questions are being raised about the impact new laws are having on British justice, and the individuals' relationship to the state and to each other.

The use of the law for political ends is also said to be corrupting the criminal justice system, with the abolition of double jeopardy (so that the accused can now be tried twice), proposals to increase the detention without trial of terrorist suspects to 42 days and the rise of race and religious hate laws.

A drive to increase the conviction rate in cases such as rape, the increased prominence of the victim in harassment law and the trial process are also attracting criticism as well as support. Are we overburdening the law with social and political problems, and undermining it in the process?"

Hampton woman to be sentenced today for lying about sexual assault

"A Hampton woman who invented a sexual assault that sent an innocent man to prison is set to be sentenced today, clearing the way for the Virginia Court of Appeals to consider clearing his name.

A woman who falsely claimed she had been raped has been jailed for a year.

"Back in 2010, MT was found guilty of molesting a toddler and a schoolgirl, as well as amassing a library of 766 Indecent Images of Children, some being video clips.

At the time, the Judge sentenced him to a three year Supervision Order, a Youth Offending Programme and a residency and Sexual Offenses [sic] Prevention Order.

Basically he walked out of court, a free man.

Disgusting!"

Indecent Images of Children & the Unduly Lenient Sentencing Scheme - A Reply

"You have also asked about the unduly lenient sentencing scheme and why it applies only to certain offences. The scheme, whereby the Law Officers may refer sentences to the Court of Appeal to consider whether they are unduly lenient, is confined to those offences that are so serious that they must be tried at the Crown Court (‘indictable-only’ offences, such as rape or robbery), and to certain ‘either-way’ offences which, although they may be tried in the Crown Court or a magistrates’ court, are capable of being serious enough to justify a high maximum penalty."

"People who download or view images of child abuse [sic] could receive stiffer sentences as part of a fresh [sic] Government plan to tackle sexual exploitation [?], a minister announced.

The murders of Tia Sharpe and April Jones, who were both killed by men who had viewed child abuse images [sic] online [and your point is?], has led to moves to block illegal pornography on the internet.

But Justice Minister Damian Green has said the Government will also consider stiffer punishments for those caught viewing indecent images in a bid to stamp out abuse. [hahahahaha]

Severity and risk are not the same when it comes to indecent images of children

"In a forensic context, the term “risk” is used to describe the statistical and psychological likelihood that an individual will later commit a similar offence. For offenders convicted of child imagery offences though, the risk focus is not only the likelihood of reoffending but also the potential escalation to direct sexual abuse of a child.

To date, little is known about what makes people cross over from viewing images to committing child abuse. In fact, what little we do know indicates that, statistically, the risk of further offending or offence escalation appears to be low. One study compiled the reoffending rates of 2,630 offenders and found that 3.4% of people who committed an offence related to child images went on to commit another while 2% went on to commit a contact offence against children.

It may even be that an individual who views more serious images of child abuse might be at a lower risk of committing a direct contact offence than someone who develops sexual fantasies about innocent child imagery, which they may more frequently encounter in their daily activities.

There is also an assumption that all people viewing these images have a sexual interest in children and they are often described “paedophiles” in the press. Paedophilia is defined as “recurrent, intense and sexually arousing fantasies, urges, or behaviours involving sexual activities with a pre-pubescent child or children” (generally meaning aged 13 or younger).  [plus, a little more]

However, there is evidence that some users also gain satisfaction from the collection process rather than the actual content of the images, while others may use the images to foster online social contacts. Others use them as a way to escape their real-life problems or to shock themselves, similar to how some people view beheadings or car crashes online. [stimulation and catharsis]"

"Second, as Jacob Sullum wrote in a guest post here at The Watch earlier this year, there just isn’t much evidence to support the notion that consumption of child porn makes people go on to violate children.

"The USSC found, based on criminal records and additional information in presentencing reports, that one in three federal defendants sentenced for non-production offenses in the previous decade had known histories of “criminal sexually dangerous behavior” (including prior child pornography offenses). Tracking 610 defendants sentenced in fiscal years 1999 and 2000 for eight and a half years after they were released, the USSC found that 7 percent were arrested for a new sexual offense."

Even allowing for the fact that many cases of sexual abuse go unreported (as indicated by victim surveys), it seems clear that some consumers of child pornography never abuse children. “There does exist a distinct group of offenders who are Internet-only and do not present a significant risk for hands-on sex offending,” says Karl Hanson, a senior research officer at Public Safety Canada who has co-authored several recidivism studies.

Why would anyone look at this horrible stuff if he was not inclined to imitate it? Troy Stabenow put it this way in a 2009 interview with ABA Journal: “People who watch movies like Saw and Friday the 13th are being titillated by the act of torture and murder. That doesn’t mean that they’re going to go out and commit torture and murder.”

In fact, as Sullum points out, some consumers of child porn are themselves victims of sexual abuse who view photos and videos as a form of therapy. That appears to have been the case with Ryan Loskarn, the congressional staffer who killed himself after he was arrested for possession child porn earlier this year. There’s also some evidence that legal access to virtual child porn (images produced without exploiting real-life children) may help prevent pedophiles from acting on their urges outside of cyberspace."

Local child sex [sic] prosecutions at record rate 

"The people who look at child pornography, Skuthan said, are not like other criminals.

“A very large percentage of our child pornography clients and child solicitation clients (who try to meet children over the Internet) have no prior criminal record,” he said. “They’re in their home when they’re downloading the child pornography. In most cases, when the FBI or law enforcement knocks on the door, these clients are tremendously cooperative and admit what they’re doing. If they refused to cooperate, they might not be prosecuted.”

Alderman said agents here have investigated people from all walks of life. “I’ve seen blue-collar and I’ve seen white-collar just as well, and married folks as well as someone you might think would be the typical person, social misfit,” she said.

The one characteristic everyone agrees on is that the offenders overwhelmingly are male.

Skuthan said his clients, overwhelmingly, have been “genuinely remorseful for what they have done” and comply with all treatment mandates and court requirements.

“In my opinion,” he said, “most of these defendants will never get involved in illegal activity again.”

Psychologist Eric Imhof has worked with sex offenders for more than 20 years. He said he generally works for the state and prosecutors seeking to confine sexually violent predators. But when it comes to child pornography viewers, Imhof said, he often works with defense lawyers.

He agreed that those viewing child porn come from diverse backgrounds. “I’ve evaluated police officers, attorneys, welders, ditch diggers. It runs the whole gamut,” he said.

Research suggests that only about 60 percent of the people who view child pornography could be diagnosed as pedophiles.

“But what about the other 40 percent?” Imhof said.

Sometimes alcoholism or depression or other mental disorders play a role, but not always. And Imhof noted that most people with those problems do not turn to child pornography.

Most of the people who view child pornography don’t have antisocial characteristics seen in violent predators, Imhof said. This keeps them from taking the next step and committing contact offenses against children, he said. It also leads them to “spill their guts” when law enforcement comes calling, confessing in full."

A Matter of Low Self-Control? Exploring Differences Between Child Pornography Possessors and Child Pornography Producers/Distributers Using Self-Control Theory 

Abstract 

"This study examined the demographic and background characteristic differences between those arrested for child pornography (CP) possession (only), or CP production/distribution, or an attempted or completed sexual exploitation of a minor (SEM) that involved the Internet in some capacity within the context of self-control theory using data from the second wave of the National Juvenile Online Victimization Study (N-JOV2).

Results indicate few demographic similarities, which thereby suggest these are largely heterogeneous groupings of individuals.

Results also indicate CP producers/distributers engaged in a greater number of behaviors indicative of low self-control compared with CP possessors.

Specifically, offenders arrested for CP production/distribution were more likely to have (a) had problems with drugs/alcohol at the time of the crime and (b) been previously violent. In contrast, the only indicator of low self-control that reached statistical significance for CP possessors was the previous use of violence.

Moreover, in contrast to CP producers/distributers, full-time employment and marital status may be important factors to consider in the likelihood of arrest for CP possessors, which is congruent with the tenets of self-control theory."

"The latest research clearly disputes current misconceptions and shows that the recidivism rate for this type of crime is among the lowest of any criminal category. Studies by clinical psychologists indicate that the majority of men who view child pornography online do so for various reasons other than having a sexual attraction to young children or the desire for further sexual exploitation of minors: impulsiveness, poor parenting and home situations, childhood trauma, boredom, engaging in other delinquent or drug-addiction related activities, curiosity and simple lack of knowledge of what’s appropriate and illegal, etc. (Sarah Kliff ,“This Woman is Trying to Stop Juvenile Sex Offenders — by Helping Them,” www.vox.com/2014/12/5/7333765/elizabeth-letourneau-interview).

According to the U.S. Sentencing Commission Report on Child Pornography Sentencing (February 2010), this group of nonproduction child pornography offenses needs to be looked at differently from those involving the actual production of child pornography. Studies continue to indicate that any incarceration with hardened criminals for these nonproduction offenders does little to promote child safety. Instead of the “throw ’em in jail” mentality, a more effective strategy for first time, nonproduction CP offenders would focus on prevention, supervision and rehabilitation, rather than on the creation of thousands of lifelong criminals who have no hopes for rebuilding better futures. Attending mandatory counseling sessions to become more aware of the harm caused by these horrific acts that circulate over and over on the Internet would be more beneficial in promoting community safety."

'I found a million child porn pictures on my husband's computer - but it could happen to anyone'

Child Pornography and Child Molestation: One and the Same or Separate Crimes?


"Congressional findings underlying the Child Pornography Prevention Act of 1996 state that child sexual abusers often use child pornography to “stimulate and whet their own sexual appetites.”

Possession of child pornography and the act of child molestation are separate crimes; however, contemporary studies have highlighted a correlation [ah] between the principal behaviors of both.

Recent federal appellate court decisions have resulted in divergent holdings, some of which are inconsistent with these studies [how 'fortunate'].

These decisions affect the federal circuit courts by blurring the threshold used to determine when probable cause under the Fourth Amendment is established in cases involving evidence of child sexual exploitation crimes.

The Eighth Circuit held in United States v. Colbert that evidence of defendant’s attempt to entice a young girl supported probable cause to search defendant’s home for child pornography.

The court found that probable cause existed because “individuals sexually interested in children frequently utilize child pornography to reduce the inhibitions of their victims [which was false, of course] ”"

"In Eugene Ionesco's absurdist play "The Bald Soprano" a character talks about a husband and wife named Bobby and Bobby Watson whom no one could tell apart because they had the same name. In People v. Gillotti, the Court of Appeals has applied similar logic to hold that "victim" under the Sex Offender Registration Act (SORA) is identical to "victim" in tort cases where persons depicted in child pornography can seek damages from mere viewers.

Gillotti accordingly holds that anyone convicted of possessing multiple images of child pornography has multiple "victims" and therefore presents the same future risk to public safety as someone who has sexually assaulted multiple children. The majority sees no absurdity in this. Rather, it asserts that any other result would violate the "plain language" of SORA. But plain language interpretation does not mean that just because two things have the same name they cannot be told apart.

After Gillotti, more and more people will be classified as high-risk "sex offenders" based on less and less evidence. The resulting restrictions and stigma inflict needless misery on ex-offenders and their families, while the empirical data shows that these measures do nothing to promote public safety. One can only hope that someday a more enlightened view will prevail."
