Sexual Communication With A Child – New Offence In Force 03/04/17 

"Situations that will be covered by the offence include talking sexually to a child in an online chatroom, sexually explicit SMS text messages to a child along with inviting a child to communicate sexually (whether the invitation itself is sexual or not ).

The new offence is designed to ensure that it does not criminalise ordinary social or educational interactions between children and adults or communications between young people themselves in an ever increasing age of technology and mobile communication and improves the law substantially as prior to this new offence, sexualised communication with children that was text based was not actually a criminal offence on its own unless paired with an actual attempt to meet up with a child.

Case law confirms that the term “Sexual gratification” has a wide meaning stating that sexual gratification which is alleged may take any of the myriad forms which sexual pleasure or indulgence may take. The term is already used in context of offences at sections 11 and 12 of the Sexual Offences Act 2003 which prohibit engaging in sexual activity in the presence of a child and causing a child to watch a sexual act respectively."

​Paedophiles [sic] who groom children will face tougher penalties as part of law which launches April 3 

"Paedophiles [sic] who have any type of sexual communication with children will be prosecuted under a new law, which will come into force next month. Campaigners are rejoicing after it was revealed that people who groom children will face up to two years in prison and will automatically be placed on the sex offenders' register, in new measures which will be introduced on April 3.

The new offence will cover both online and offline communication, including through social media, email, and letters. Currently, adults cannot be arrested or prosecuted for sending sexual messages to children, the impact of which has been huge with the number of abusers meeting children after grooming more than tripling in five years.

Section 67 of the Serious Crime Act will make it illegal for an adult to send a sexual communication to a child and will be implemented next month.

Justice Secretary Liz Truss said: "In a world of mobile phones and social media, our children are ever more vulnerable to those who prey on their innocence and exploit their trust. This new offence will help us tackle the early stages of grooming, and nip in the bud those targeting children online or through text messages. My message is clear – any sexual communication with a child could see you behind bars."

The news has been welcomed by children's charity NSPCC, which accused the government of dragging its feet implementing the new law."

There are a lot of other fake numbers out there including some who are still reporting that “20% of kids have been approached by a predator.” That number is a misinterpretation of a 2000 study that found that a 5th of kids had received an unwanted sexual solicitation online but what the fear-mongers don’t tell you is that many of those solicitations come from other kids, most were non-aggressive and none resulted in actual contact.

And then there’s the panic over sexting. A flawed 2009 study claimed that 20% of kids had engaged in sextjng [sic] but a much more scientific study from the prestigious Crimes Against Children Research Center found that only 1.3% had sent or created an image of themselves that showed breasts, genitals or “someone’s bottom.” A somewhat higher number (2.5%) sent images where they were either nude, partially nude or in a sexy pose, even if fully clothed.” Studies by Pew Research and other reputable organizations have yielded similar results."

A 16-year-old Victoria girl has been charged with distributing child pornography for sending a picture of another girl by text message on her phone.

The trial of a Victoria-area teen who is facing child pornography charges for allegedly texting a nude picture of another girl without her consent will go ahead before a constitutional challenge, a judge has ruled.

The 16-year-old Saanich girl is facing charges of possession and distribution of child pornography and uttering threats after she allegedly distributed nude pictures of her boyfriend's ex-girlfriend.

Today, a provincial court judge ruled the trial will go ahead this fall, before a related constitutional challenge to the child pornography law will be heard.

The teen's lawyer Christopher Mackie says they are launching a constitutional challenge against Canada's child pornography laws as they apply to people under age, claiming the charges amount to age discrimination."

Social workers need more support in dealing with online abuse of children [sic]

"Social workers are in desperate need of specialist training in how to spot the warning signs that a child is being targeted for sexual abuse online, a survey by the British Association of Social Workers (BASW) and the NSPCC reveals.

Half of all social workers surveyed by BASW and the NSPCC said they felt concerned about dealing with online sexual abuse or behaviour. Over two thirds of social workers felt they needed more support with child protection cases involving online abuse.

Other findings from the survey included:

• Almost half (49%) of social workers said that 25% of their sexual abuse cases now involve some form of online abuse

• A third (34%) of social workers said they do not feel confident about understanding the language used by young people online

• 47% said they were not knowledgeable about how young people communicate via social networking sites

• 36% felt they did not know the right questions to ask to identify and assess online sexual abuse

• 30% said they did not feel confident dealing with child protection sexual abuse cases using the internet

• 50% say they don’t know what how to recognise the signs of the online sexual abuse of children

Three Virginia teens face child porn charges in “sexting” trial

"Case involves three teens who allegedly non-consensually filmed sex acts.

On Thursday, three northern Virginia teen boys will head to trial to face child pornography charges stemming from sexting-style videos made on their cellphones. If found guilty, each faces up to 20 years in prison and the sex offender label.

Fairfax County Commonwealth’s attorney Ray Morrogh told the Washington Post that there needs to be a balance in these situations between labeling teens with sex charges and considering the impact on victims of the distributed image.

“We try to resolve these cases wherever possible without going to the courts,” Morrogh said. “At the juvenile level, the goal is to rehabilitate the child.”

This case appears to be particularly egregious, though. The teens allegedly surreptitiously filmed themselves in sex acts with at least six teenage girls across 10 videos shot in December 2011."

"A landmark report by the NSPCC claims that children are safer from strangers playing out in the street or in the park than in their own bedrooms.

They say we need to change the way we teach children about 'stranger danger' to take into account emerging threats [sic] in today's society from dangers online such as sexting, cyber bullying and meeting people online in chat rooms.

Meanwhile the report, billed as the comprehensive study of risks to children in the UK, also warns only a small a fraction of abuse or neglect in the home is being detected.

The report overall shows a significant long-term decline in violence against children in comparison with previous decades, contrary to public perceptions, but major new threats emerging through the internet.

Child murder, for example, is down by 30 per cent since the early 1980s and serious assault involving children have also declined steadily as have child suicide rates in most of the country.

But with children as young as five spending up to six hours a week on the internet, a quarter of 11 and 12 year-olds now see something which worries them on the internet every day, it warns.

Online threats which our children are facing include cyber bullying and receiving sexually explicit messages, seeing sexually explicit images and meeting strangers on the internet.

Lisa Hawker, author of the report, said: “We are still trying to fully understand the scale of online harm but children are telling us that cyberbullying, sexting and seeing sexual images online are things that many of them are experiencing."

Study: Sexual activity is rare among young adolescents

"Contrary to popular belief [?], sexual activity among very young adolescents is not more prevalent today than in the past, says a report in Pediatrics magazine.

The study also finds that sex among the same group is frequently involuntary.
