Police blunder sees Oxford Mail and BBC identify wrong man as rapist

"The BBC and a regional newspaper illustrated a court case of a man pleading to rape and firearms charges with a photograph of the wrong man after it was supplied to them by the local police force.

Thames Valley police issued the photograph purporting to be DR of [redacted] Kidlington, Oxfordshire, following the hearing at Oxford Crown Court last week.

The BBC website and the Oxford Mail carried a report of the court case and illustrated it with the police-supplied photograph. However the man in the photograph was not the R involved in the case.

The image was of a man with a similar name from South Wales, not connected in any way with the rape or firearms charges."

Child images 'put on hacked sites'

"Dozens of websites are being hacked to host images of child sexual abuse [sic] which are being inadvertently viewed by internet users, a charity has warned.

The Internet Watch Foundation (IWF) said it had received 227 reports of hijacked websites in the last six weeks. The charity said legal pornographic sites had also been attacked to redirect visitors to the [potentially] illegal material.

Susie Hargreaves, chief executive of the IWF, told BBC Radio Five Live: "It means for the person who's accidentally stumbled across it, they're seeing the worst of the worst without any idea of how it actually happened."

NY counties struggle with homeless sex offenders

"UTICA, N.Y. — Since state and local laws about where they can live were tightened around a decade ago, sex offenders have become more likely to end up homeless.

That's caused problems for counties across the state, because they are required by law to find housing for anyone who needs shelter within their borders.

Different counties have cobbled together different strategies to deal with the thorny issue, but officials and homeless advocates from several counties said there is no easy answer.

"I don't know what the solution is," said Greta Guarton of the advocacy group Long Island Coalition for the Homeless. "We, of course, think everyone needs a place to live, but certainly understand the community's concerns.""

"MILWAUKEE (AP) — The state pays some landlords significantly higher rent than average to house some sex offenders, a practice that has prompted a legislative audit on the supervised released program.

The Department of Health Services, which runs the program, pays $1,500 a month for a 480-square-foot house in Manitowoc — about five times the going rate, according to WISN-TV in Milwaukee. The state is also paying $2,400 a month for a 1,100-square-foot home for two sex offenders in Milwaukee — about the same rent as a lakefront high-rise apartment."

Sheriff’s office: Suspect should not have been in sex offender registry

"KINGMAN — A man arrested last month in Mohave Valley for failure to register as a sex offender in Arizona should not have been listed as a sex offender in the Arizona Department of Public Safety’s database after his 2009 conviction had been overturned by a military court of criminal appeals.

That’s the conclusion of an investigation conducted by the Mohave County Sheriff’s Office following the April 22 arrest of 32-year-old MJ.P.

A timeline in the case was prepared by Lt. Randy McNally of the Mohave County Sheriff’s Office and provided to the Mohave Valley Daily News, which received information from P’s associates, friends and family members that indicated he should not have been charged with the sex offender violation because that criminal conviction had been removed from his record."

Child porn arrest spurs outreach to victims

"A meeting for parents of potential abuse victims [sic] was sparsely attended on Monday night, but Kenton County Commonwealth Attorney Rob Sanders saw it as a hopeful sign [yeah, right].

“Hopefully, it’s a good sign, meaning we don’t have the large number of children we thought that the suspect had access to [!]. Of course, I don’t know that,” Sanders said [!]. “I certainly believe that there are more children than we saw parents today.” [of course you do, do you? sure?]

The meeting was spurred by the arrest Saturday of TJ, 64, of Independence, on child pornography charges. On Monday, J, a foster parent, pleaded not guilty to five counts of distribution and another count of possession of sexually explicit material.

His arrest came after a month-long investigation by the Kentucky Attorney General’s office after a tip by internet provider AOL, which had flagged suspicious activity on J’s account. During the investigation, detectives had also discovered J was a foster parent and potentially had access to more children at a Boy Scout camp. The foster children have been removed from his home.

Sanders said his office has yet to find evidence of abuse [no shit, Sherlock], but the potential [sic] for more victims [more what?] was the reason for the unusual step of Monday’s meeting.

An official from the Northern Kentucky Children’s Advocacy Center instructed parents how to speak to their children about the case [oh, how nice]."

FBI mistakenly raid local couple for child porn

"A Mechanicsville couple was targeted by the FBI because federal investigators say child porn was being downloaded to computers using their internet service.

Trouble is, those computers did not belong to the couple. After a lengthy investigation and frightening moments for the husband and wife it was determined their neighbor was allegedly committing the crimes.

In a Mechanicsville neighborhood off of Pole Green Road, the only lawbreakers neighbors worry about are speeders, but that changed last month. The Feds arrested David Edward Sleezer and are charging him with five counts of receiving and distributing child porn."

"A TEENAGER was wrongly sentenced to two years imprisonment yesterday – by a judge who did not know what the charges against him were.

DD, 18, pleaded guilty to having sex with a 13-year-old girl, but was accidentally sentenced for a rape during a mix-up at Gloucester Crown Court."

Thousands Are 'Wrongly Branded Criminals'

"Around £1.9m is paid to thousands of people in Britain who were wrongly branded criminals, Big Brother Watch says.

Nearly 12,000 people have been wrongly branded as criminals over the past five years due to innacurate record checks.

According to the campaign group Big Brother Watch, the cost of redress stands at £1.9m.

In 3,519 cases, the wrong person's entry on the police national computer was disclosed, BB Watch said.

The figures were obtained from the Criminal Records Bureau (CRB), which recently merged with the Independent Safeguarding Authority to form the Disclosure and Barring Service (DBS).

According to the CRB's annual report in July, 4.1 million checks were carried out in 2011."

Teacher awarded €700,000 for sex abuse probe failings

"A FORMER secondary school teacher has been awarded €700,000 damages against the HSE over the manner in which it inquired into sexual abuse allegations against him.

Mr Justice Iarfhlaith O'Neill severy criticised the manner in which the investigation was conducted, saying the teacher was clearly targeted by the area health board and the HSE.

The judge said the actions of the HSE had the consequence of irreparably destroying the life of the teacher."

"The officers assigned to the case were part of Scotland Yard's specialist rape unit

A woman who made a rape complaint that was not properly investigated by police has reached an out-of-court settlement with Scotland Yard.

The woman reported the alleged attack aged 15, in 2005, but during the Met Police investigation evidence was lost.

The judge at the trial of her alleged attacker branded it a "disgrace". The defendant was later acquitted."

Inspectors give their verdict on conditions for sex offenders at HMP Bure in Norfolk

"The annual report into Norfolk’s prison for sex offenders has again highlighted “inappropriate” care and facilities for elderly and disabled prisoners.

For the third consecutive year, the issue has been flagged up in the Independent Monitoring Board (IMB) report about HMP Bure, which opened in 2009 at the former RAF Coltishall.

It also highlights “totally unacceptable” handling of prisoners with indefinite sentences. A “serious lack of opportunity to complete programmes” means they are held “far beyond a release date that they would otherwise have achieved”.

The IMB report clears the prison managers of any blame, and urges the government to suspend the sentencing exercise to allow a “more robust structure” to be put in place across the country.

The prison houses up to 523 category C male sex offenders, largely from the eastern region."

He told North: “In many years sitting on the bench it has been my misfortune to see disgusting images of abuse – and these are as bad as any I’ve seen.

“I tell you frankly, that if I had sentenced you before lunch, such was my anger, you would have had an immediate custodial sentence [good job you had a snack, so as to clear your mind, Richard].

“Sentence must not take place when the judge is angry; but it is anger I am happy to confess to, because any right-minded person would be angry at what those pictures showed [only the unright-minded person, would be unable to divorce, what the images appeared to show, from the case in hand].

“I suspect most people would have the same reaction as me and want to see you behind bars. [why, are they worryingly-emotional, too?]

“I have read a report which shows a different type of man to the disgusting creep [prejudicial and offensive] who accesses this sort of picture [evidence?].

“I want to stop you ever supplying [sic] this disgusting market [sic] by looking at such pictures [sic].

“The best way of doing that is to ensure you are subject to a programme in which, psychologically, you will have no hiding place [oh, please].”

MacShane calls for independent inquiry into sex grooming

ROTHERHAM MP Denis MacShane has welcomed re-assurances from South Yorkshire Police that they are to put extra resources into tackling allegations of child sex abuse in the town.

Rotherham has been at the centre of allegations in the national media this week of inaction over the grooming of young girls for sex by groups of older men.

South Yorkshire Police says it is taking the issue very seriously and has several live investigations under way.

And Dr MacShane says he has been heartened by the force’s reaction to the scandal."

Judge says child pornography is as serious as actual assault

"BRENTWOOD — When a Salem man argued he should receive a suspended sentence in exchange for pleading guilty to possession of child pornography, the judge responded by explaining why he views the crime more seriously than he once did.

ZG, 20, was sentenced 2 to 4 years in state prison Wednesday morning on two counts of attempted possession of child pornography. He pleaded guilty as part of a negotiated disposition.

Prosecutors focused their arguments on G’s criminal record, which included convictions for misdemeanor sexual assault and criminal threatening dating back to 2009.

Defense lawyer James Rosenberg argued that Gray was still a young man with a troubled past trying to turn around his life through a battery of counseling.

But Judge Kenneth McHugh said Gray’s case was more about deterring the public from committing similar crimes.

“I’m convinced this is as serious and sometimes a more serious crime than an actual sexual assault,” McHugh said while handing down the sentence.

His comments marked the second time in recent days that a Rockingham County judge said he believes child pornography needs to be taken more seriously by both the court and the public."

Lake County man gets prison in killing of neighbor he thought was child molester

"A Lake County man was sentenced Wednesday to 32-years-to-life in prison for killing a neighbor he mistook for a convicted child molester.

Ivan Oliver, 34, was convicted two weeks ago by a jury of first-degree murder for stabbing Michael Dodele 65 times at a Lakeport mobile home park.

He also was found guilty of a special allegation of using information from the Megan’s Law website to commit a felony. A confusing entry led Oliver to believe Dodele was a convicted child molester. Dodele, 67, was listed for being a serial rapist of adult women. He’d served more than 20 years in prison for his crimes and had been released just a month before he was killed.

Oliver had previously been convicted of stabbing a security guard who confronted him after he and some friends left a restaurant without paying.

At trial, Oliver testified he killed Dodele in self-defense. Oliver said he believed Dodele may have touched his son [which he will not see grow up] and that Dodele tried to stab him after he confronted him."

Indiana sex offender list violates due process: court

"A federal appeals court said Indiana's sex and violent offender registry unconstitutionally violated the due process rights of thousands of registrants because it did not give them a chance to fix mistakes.

The 7th U.S. Circuit Court of Appeals in Chicago rejected arguments by the Indiana Department of Correction that it was not directly responsible for errors in the registry, which contains about 24,000 names, and that registrants had other procedures to challenge mistakes.

Concluding that erroneous labeling as a "sexually violent predator" implicated a liberty interest protected by the Due Process Clause, the 7th Circuit noted that Indiana had recently begun letting current prisoners challenge pending registry listings, but gave other registrants no such opportunity.

"The policy provides no process whatsoever to an entire class of registrants -- those who are not incarcerated," and is therefore "constitutionally insufficient," Circuit Judge Diane Wood wrote for a unanimous three-judge panel."

Detective Chief Inspector Debra Towns, of Richmond police, will talk with the CPS branch crown prosecutor about the acquittal of 24-year-old JB."

Council sent sex offender’s details to Southwick family ‘in error’

"A YOUNG family sent the details of a convicted paedophile [sic] by mistake have been left wondering if their information is in safe hands.

Stephen and Claire Slark were shocked to find notification of a supervision order, giving the personal information of a sex offender, including name, date of birth and list of offences, in among paperwork sent to them by West Sussex County Council.

Claire, of Locks Court, Southwick, said the couple were now deeply concerned information about her three children could now be in the hands of a paedophile [sic]."
