Data Protection Act, Journalism and the PCC Code

"Are there any other rules on obtaining personal information?

The DPA also regulates the lawful disclosure of information. This note does not deal with how that might be relevant to disclosure to the media, or how journalists might use DPA information rights, or the DPA’s inter-relation with the Freedom of Information Act 2000, for which the Information Commissioner also has responsibility.

However, it is important for journalists to understand that in addition to the Act’s requirements about the way that personal data can be used, the rights of data subjects and the exemptions to them, it contains some other controls and prohibitions on the way that information can be obtained and disclosed.

There is a specific criminal offence of unlawful obtaining of personal data. A person must not knowingly or recklessly, without the consent of the data controller, obtain or disclose personal data or the information that it contains, or procure the disclosure to another person of the information contained in personal data.

Both individuals and companies can be prosecuted at the instigation of the Information Commissioner or the Director of Public Prosecutions. It is also an offence to sell or offer to sell information that has been obtained without consent."

Crime boss’s pledge on child sex abuse after Norfolk officer found hanged on day he was to be charged with offences

"Norfolk’s police and crime commissioner has today underlined the force’s determination to protect victims of child sex abuse after it emerged an officer hanged himself on the day he was due to be charged with a series of serious sexual offences.

Police yesterday revealed GG had been dismissed for gross misconduct after being arrested on suspicion of a total of nine serious sexual offences.

It followed an investigation by the force’s Professional Standards Department into allegations received in April that he was suspected of being involved in online child sexual abuse offences involving victims from outside the UK."

Elected Officials (This Time, 'Police Commissioners') Guarantees That The Paedocard Will Be Played, Again And Again

3:51pm Monday 23rd September 2013 in News

Police commissioner pledges to crack down on online abuse in wake of [BS] paedophile [sic] report

"BOLTON’S police and crime commissioner is urging parents and agencies to work harder to protect children online.

It follows a report from the Child Exploitation and Online Protection Centre (Ceop), which found that paedophiles are using blackmail to force hundreds of young people to perform sexual acts online, turning them into little more than sex slaves.

Ceop also revealed that seven children targeted by abusers in this way had killed themselves.

Tony Lloyd is now seeking a meeting with Ceop bosses to see what practical steps can be taken to protect our young people.

He said: “This report is shocking [if only it were all true]. The idea that children are being driven to suicide because they are being taken advantage of online should send a chill down our spines. But it’s also welcome that Ceop is highlighting the issue [as it is all so 'secret' and all]."

Judge joins forces [independent?] with Vera Baird over sex offenders' jail sentences

"A top judge is backing police commissioner Vera Baird in her fight to get tougher [why tough, Vera?] prison sentences for convicted sex offenders.

A top judge has joined forces with police commissioner Vera Baird in a bid to stop convicted sex offenders walking free [sic].

Vera Baird believes there is a ‘loophole’ [hahahaha] in sentencing laws [no, they are clear] which means offenders convicted of crimes such as downloading or making images of child abuse are sometimes given non-custodial sentences so that they can be put on Sex Offender Treatment Programmes quickly.

Northumbria’s Police and Crime Commissioner said, under current guidelines, a custodial sentence of two years or more is needed for those convicted of such crimes to undergo an accredited 39-week sex offender treatment programme in prison."

Ex-solicitor general Vera Baird banned from driving

"Vera Baird Vera Baird represented Redcar from 2001 to May 2010.

The former solicitor general Vera Baird has been banned from driving for six months after travelling at nearly 100mph along the M4 motorway.

Magistrates in Pontypridd rejected the QC's arguments to keep her licence. She claimed it would cause her hardship winding up her parliamentary affairs.

Former MP Baird, of Crouch End, London, lost her Redcar seat in May's election.

She was given five penalty points, which added to those already on her licence gave her an automatic ban.

She was also fined £400.

Baird, 60, had previously been found guilty in her absence but the case was reopened when she explained she had never received a summons."

Speeding drivers targeted

"Speeding and inconsiderate drivers are being targeted in a crackdown on anti-social behaviour in the Alnwick area.

Officers have been working with community volunteers on a Speedwatch scheme as well as visiting local schools to reinforce safety messages to the drivers of the future.

The crackdown has the backing of the Northumbria Police and Crime Commissioner Vera Baird, who is encouraging anyone concerned about anti-social behaviour to get in touch so action can be taken.

Neighbourhood Inspector Paul Truscott said: “Residents and local councillors at public forums have raised the issue of motorists driving at speed on rural roads causing a danger."

Every Relationship (For All Intents And Purposes) Is A Balance Of Power, Whatever The Relative Ages

Monday 24 June 2013 16.38 BST

JF: child protection experts warn against romanticising case

"NSPCC says media must be careful [sic] of presenting relationship between teacher and pupil as love story [which is exactly what it is]

JF, who was jailed for five and a half years after starting a sexual relationship with a child.

To glance at some headlines, a reader might think this was a conventional love story: "I still love him"; "He's wonderful, I'll fight for him". But this was, child protection professionals agree, a relationship built around abuse [sic].

JF, a maths teacher who turns 31 on Tuesday, was jailed for five and a half years last week for beginning a sexual relationship with a pupil shortly after her 15th birthday and escaping to France with the girl when their connection was discovered.

Post-verdict coverage has shone a spotlight on the many ethical and regulatory difficulties of such cases. While newspapers have remained condemnatory of F himself, interviews with the girl, now 16 [legal age], and with F's family, traced a distinctly romantic narrative, with talk of her visiting her ex-teacher in prison, sticking by him and even future marriage.

Beyond the unequal basis of their relationship, the court heard that the girl, who cannot be named for legal reasons, is psychologically vulnerable [sic] and from a difficult background [sic]. Her decision to side with F and his family has seen her cut contact altogether with her own mother.

Stories, primarily in the Sun and Mail titles, detailing her feelings for F, including reprints of emotionally charged letters, were "a concern", said Jon Brown, who leads on child protection issues [sic] for the NSPCC charity. "There's an awful lot of work that still needs to be done with the media in explaining [lying to] and, in a sense, educating [brainwashing] journalists so they do have a better understanding [sic] of the reality [sic] of these relationships," he said.""

The NSPCC – Suppressing the Truth

"They are deeply upset.

Journalists need re-programming ’educating’, so that they don’t report what people say to them.

Reporting factual statements is unhelpful to the NSPCCs agenda.

This morning they are waving clause 6 of the PCC code, not to mention clause 16, in front of the terrified journalists and warning of the direst consequences. The Guardian is so upset on their behalf that they are providing links to both the Daily Mail and The Sun (unheard of!) so that their readers can see exactly what such irresponsible journalism looks like without the Guardian having to sully itself by printing similar off-message words.

What could have been said to provoke the NSPCC so? Has Harriet the Harridan been advocating paedophilia again? Did David Cameron issue a statement saying the NSPCC were a waste of space? Is Chanel 4 making a new version of ‘I’m a celebrity, get me out of here’ from Lewes prison? Is Haley the only male actor left in Coronation Street? Nothing so minor unfortunately.

A young woman has declared her love for the man in her life. He has been sent to prison and she has stated that she will stand by him, wait for him.

And those dastardly right wing journalists have reported that she said that! Shock horror! This, in the NSPCCs view is reprehensible. It is ‘romanticising’ what could have been a donation winning situation for the NSPCC. It’s, it’s, unethical, that’s what it is, it’s unethical, they splutter…in fact they go so far as to claim that these journalists are only reporting fact – in an effort to sell newspapers. Who-da-thought-it?

“But then there’s an ethical issue which is broader than the code: are papers talking about this in a responsible way?”

Ideally, the NSPCC would have liked to see the young woman, an adult, illustrated by a pixilated image of an eight year old child in a winsomely too long nightdress clutching a teddy bear. JF, for it is he, illustrated by ‘picture posed by an actor’ – preferably a stern faced older man with a slight leer exposing yellow teeth, in mortar and gown, brandishing a cane. If only the regulation existed that they are calling for, they would have supplied the prose, written by a computer programmed to insert the words ‘child abuse’ into every sentence, and liberally sprinkled with keywords like ‘authoritarian figure’ and ‘vulnerable child’.

Unfortunately for them, the regulation does not yet exist, nor is Ms Mega Speech-Impediment (apologies to the young woman, not very PC but it is PCC) minded to go along with their charade."

POLICE WELFARE CALL

"The police claim that because some random stranger (not my doctor or a relative) called them and claimed that I had threatened to commit suicide on my twitter feed… and despite the fact that this was not supported by any actual evidence …this entitled them to ignore all established protocol and remove my rights as a valid and credible person in my own right… and treat me like I was a dangerous mental health patient.

Me and my family are currently grieving a suicide, but we are not suicidal… nor would I ever consider leaving my family in such a way… nor would I post about such a subject in that way on twitter! Have you lost your senses? What right do you have to assume I have lost mine.

The police had no rights to undermine my mental health credibility in such an abusive appallingly prejudice and aggressive way (certainly not on an unsupported hoax call) they had no right to force me to ‘bring in’ two adults to speak for me … what if I could not find two adults to speak for me that night?"

Why The PCC Is Soon To Be Defunct (Thankfully)

2:11PM GMT 26 Mar 2013

Julie Burchill entitled to 'offend' transsexuals, press watchdog rules

"Julie Burchill was entitled to write a controversial article about transsexuals because she was expressing her opinion, the Press Complaints Commission has ruled.

Burchill, pictured, launched the attack in defence of her friend and fellow writer Suzanne Moore.

The newspaper watchdog rejected claims that the columnist's description of transgender people as "d**** in chicks' clothing" and “a bunch of bed-wetters in bad wigs” was inaccurate or misleading.

It was “clear” from the tone of the article that Miss Burchill was using the phrases to voice her views, the regulator said, adding that the comments were "clearly distinguished from fact"

The article did not breach the PCC’s rules on discrimination because Miss Burchill did not single out any individuals, but referred “to transgender people generally", a ruling by the watchdog said."

http://www.telegraph.co.uk/news/uknews/9954733/Julie-Burchill-entitled-to-offend-transsexuals-press-watchdog-rules.html

Comment:

Few support freedom of speech, as much as we do, but, it is such inconsistencies, in logic, interpretation and decision (this stems from the PCC's media-protecting 'Code of Practice'), which has led to their downfall.

In doing so, due to their past ineffectiveness (in particular, against bullying, corrupt, lying and dangerous 'journalists'), this has led to the post-Leveson cull, which the media are now whining about; the PCC is, predominantly, the media and their associates.

Get them out, as soon as is possible, so that a consistent, agreed and evidenced-based approach may be adopted.

New police system will keep check on sex offenders [sic]

"SEX offenders in York and North Yorkshire are to have their computers monitored by a new police search system.

Julia Mulligan, the region’s new Police and Crime Commissioner, has approved the purchase of a system called Triage, which will be able to carry out remote checks of PCs owned by registered sex offenders and send a warning to officers if they type certain key words.

North Yorkshire Police said the system would be used by the force’s eight public protection officers, who manage more than 500,000 sex offenders in the region [lordy !!! ;)].

They currently visit them twice a year, but police chiefs said this did not always allow enough time to assess their lifestyle and whether they may be committing further crimes. A report by Assistant Chief Constable Iain Spittal said reoffenders may only be caught during a police operation and, by that time, they may have been offending for some time.

It also said computer technology was developing at a rate which made it “impossible” to keep training officers to carry out manual “invasive” computer checks, meaning there was a need for Triage.

The report said if the Triage search suggests the sex offender’s behaviour online is not as it should be, this will allow police to arrest them. The new system will cost £11,534 and will be bought in early next year."

Newspaper declines to apologise for terminology in intersex story

"The People newspaper has said there is no difference between the term “hermaphrodite” and “intersex” – and therefore has not apologised for its substitution of the h-word in a story last month.

“Fair and accurate reporting standards in both journalism and psychology stress the importance of referring to people using the gender and sex-related terms they use about themselves. While people should be free to identify as they wish, imposing pathologising or sensationalist terminology like ‘hermaphrodite’ or ‘DSD’ on people compounds the societal stigma and discrimination they often face.

“Responsible journalism means keeping up with current standards. Journalistic ethics require that authors and editors take care not to reinforce societal inequities through discriminatory reporting.”"
