Dutch suspect cleared of grooming ‘teenager’

"Netherlands court says appeal failed because ‘boy’ was an undercover officer

‘Grooming’ became a criminal offence in the Netherlands in January 2010

A court of appeal in the Netherlands has cleared a 38-year-old suspected paedophile [sic] of grooming a 13-year-old boy for sex – because the “teenager” who agreed over the internet to meet him was in fact an undercover police officer.

Legal commentators said last night that the decision – which confirms the ruling of a lower court – could bring to an end the use of adult “decoys” in paedophilia [sic] investigations because it establishes that they effectively undermine the legal basis of any prosecution.

“Grooming” became a criminal offence in the Netherlands in January 2010 after it changed its legislation to ratify the Treaty of Lanzarote, which criminalises the use of “new technologies”, particularly the internet, to sexually abuse or harm children."

"Under Article 248e of the Dutch Criminal Code, a suspect may be prosecuted for grooming – which carries a two-year maximum prison sentence – once he or she makes a proposal over the internet to meet a child under 16 for sex.

However, in yesterday’s ruling the judges in The Hague said that the accused could not be convicted of grooming a child for sex because, in actual fact, he had made an appointment to meet a grown man and not a child – and it was not an offence to proposition any person over 16 for sex."

""Making an appointment for sex with someone over the age of 16 is never an offence, even if the suspect thinks he is dealing with a juvenile,” the court said in its published ruling. “In this sense, the suspect’s intentions are not decisive here.”"

"They said it followed that for the crime of grooming to take place within the meaning of the law it was “necessary” that the intended victim should be under 16 – a crucial decision for future police investigations."

'My life is not worth living'

"‘MY life has been a complete nightmare, it has been ruined,’

DM says he has contemplated killing himself after friendships and family relations crumbled and received death threats, when he was arrested on suspicion of sexual grooming following the posting of a video on social networking site Facebook.

The 41-year-old now speaks exclusively to the Mail on how his life has been turned upside down after the video went viral."

"He now lives out of the area, frightened to return, and says very few people speak to him anymore, but wants to put across his side of the story claiming his social networking sites were hacked and he believed he was meeting up with an 18-year-old.

“I was on a website called Badoo for over 18s. It is not an explicit site or anything of that nature.

“An 18-year-old girl looking for guys over 28, messaged me saying hello and I replied hello. The next message I got was a mobile asking to text so it moved to text message. She later asked me to meet, I said I didn’t want to but she was saying I had no intention of meeting. I had no intention of having a relationship.”

In the video, Mr M is told he was talking to a 14-year-old girl but denies he knew she was 14 and believes his internet profiles had been hacked. In the video, he says he knew she was 14 and had simply gone to meet her to advise her against meeting people she didn’t know online.

He said: “I was confronted by three men, two were quite stocky with tattoos and it was very dark so I couldn’t see them clearly. I was shown a message on a tablet that implied I was chatting to a minor and made me look as guilty as hell, I would have said the Pope was yellow with pink spots to get away unharmed.

“Their cars had blocked me in on a very rough estate. I was scared and feared for my wellbeing."

Indiana Court of Appeals Rules in RC’s Favor

"The Indiana Court of Appeals reviewed the case to decide whether or not C took a substantial step in attempting child seduction as charged. The court found that C did not take a substantial step in committing attempted child seduction. Because his requests to engage in sexual behavior were Internet-based and did not require an immediate act, the court concluded that C’s Internet-based solicitations did not constitute a substantial step toward the crime of child seduction.

The Appellate Court reversed the Starke Circuit Court’s decision to dismiss the charges."

Dutch, Indonesian, Korean national police forces join Virtual Global Taskforce at European Cybercrime Centre

"The VGT now consists of 12 international law enforcement agencies, and 11 private sector partners. Earlier this year, Kids Internet Safety Alliance (KINSA) and NetClean joined the VGT as new private sector partners.

“The Korea National Police Agency (KNPA) is honored to join the renowned VGT as a new member,” said Kim Jae-kyu, director of the Cyber Terror Response Center for the KNPA. “With Korea’s new government placing an extra emphasis on the safety of children, the KNPA will actively engage in VGT projects and cooperate with members to save vulnerable children and to bring perpetrators to justice. The KNPA hopes our joint effort will lay the foundation for a safer world which children deserve to live in.”

“We would like to extend our appreciation for being a part of the VGT,” said Police Brigadier General Arief Sulistyanto, director of commercial crime for the Indonesian National Police. “This is an important opportunity to strengthen our efforts to combat crime, in particular online child pornography.”

"The Dutch National Police is looking forward to working with these important international partners that are united in the VGT,” said DNP representative Miriam Barendse, chief constable. “Only by means of a collective international approach, we will be able to combat the online sexual exploitation of children effectively. I am proud to be part of this effort".

The other nine VGT law enforcement member agencies are: HSI; the Australian Federal Police; the United Kingdom’s Child Exploitation and Online Protection Centre; the National Child Exploitation Coordination Centre, a division of the Canadian Police Centre for Missing and Exploited Children, Royal Canadian Mounted Police; the Italian Postal and Communication Police Service; New Zealand Police; INTERPOL; Europol; and the Ministry of Interior for the United Arab Emirates.

The other VGT private partners are: End Child Prostitution, Child Pornography and Trafficking of Children for Sexual Purposes network (ECPAT International), International Association of Internet Hotlines (INHOPE), the National Center for Missing & Exploited Children (NCMEC), International Centre for Missing and Exploited Children (ICMEC), PayPal, Microsoft Digital Crimes Unit, World Vision Australia, Research In Motion and The Code.

There Is No Threat Of Social Disruption

Apr. 2, 2013, 11:34 AM

Dutch Court Says Pedophile Club [!] Cannot Be Outlawed

"A Dutch court has ruled that the pedophile club Martijn cannot be outlawed, Michael van Poppel of BNO news reports.

Martijn is a Dutch association that advocates the social acceptance of pedophilia and the legalization of sexual relationships between adults and children.

In June 2012 a Dutch court deemed the group to be illegal and ordered it to disband immediately. Prosecutors had successfully argued that the club's work and ideas were contrary to public order and morality — especially since the harmful effects of child sexual abuse infringe upon the rights and interests of children.

On Tuesday the court found, on appeal, that "the activities of the association are contrary to public policy, but that there is no threat of social disruption."

The ruling echoes a June 2011 decision that the club's activities were not illegal under Dutch law because even though men associated with the club — including its former chairman — have been charged with possessing child pornography, the crimes weren't committed in connection with the club.

Tuesdya's ruling noted that the club does not provide any "tips and tricks" for adults to have sex with children."

Public prosecutor to challenge lifting of ban on pro-paedophile group

"The public prosecution department is to appeal to the high court over a lower court decision to overturn a ban on pro-paedophile lobby group Stichting Martijn.

Last week, the appeal court in Leeuwarden ruled the foundation, which campaigns for legalised sex between children and adults, cannot be banned because its existence does not threaten to cause social disruption.

A civil court in Assen last year banned group Stichting Martijn, saying what the foundation does and says about sexual contact between adults and children contravenes the accepted norms and values in Dutch society.

The public prosecution department said on Monday evening it would take the matter to the high court. It says the existence of the foundation does cause social disruption and should therefore be banned.

Meanwhile, political parties CDA and ChristenUnie are preparing draft legislation which would have the foundation banned by law."

The Limits of Sex Advocacy

"The Daily Beast reports a fascinating story from the Netherlands. It goes to the heart of a freedom of expression issue that remains incredibly controversial. Can – and should – you be free to advocate paedophilia? [sic] Or rather ‘inter-generational sex’ [IGS including minors, actually]? It is a question that a Dutch court answered affirmatively this week.

At the heart of the case was a Dutch campaign group called Vereniging Martijn."

Dutch judiciary accidentally 'spread child porn' [sic]

"The Dutch judiciary was on Friday itself facing possible criminal prosecution after it emerged that it had for years inadvertently left the filenames of child pornography on its website.

The scandal erupted after state broadcaster NOS on Thursday reported that some court judgements had not been properly redacted before being published on the rechtspraak.nl website, leaving distinctive filenames visible.

The actual photo and film files could then easily be found [sic] on the Internet using a search engine.

NOS informed the judiciary before the report was broadcast and they "decided to review all published judgements", or around 250,000, Council for the Judiciary spokesman Michiel Boer told AFP.

The overarching Council for the Judiciary is part of the judiciary and its responsibilities include the rechtspraak.nl website.

"We found in total around 80 judgements containing filenames, notably with the extensions .jpg, .mpg or .avi," Boer said, adding that all judgements had now been properly redacted.

Redacting "is a job carried out by people, so these are human errors," Boer said.

The Netherlands judiciary publishes its judgements online since 1999 and the redaction of file names related to child pornography was made mandatory in 2008."

Amsterdam to create 'scum villages'

"Amsterdam is to create "Scum villages" where nuisance neighbours and anti-social tenants will be exiled from the city and rehoused in caravans or containers with "minimal services" under constant police supervision.

The plan echoes a proposal from Geert Wilders, the leader of a populist Dutch Right-wing party

Holland's capital already has a special hit squad of municipal officials to identify the worst offenders for a compulsory six month course in how to behave.

Social housing problem families or tenants who do not show an improvement or refuse to go to the special units face eviction and homelessness."

Sex criminal register does not work as a deterrent: report

"Setting up an official register of sex offenders, as happens in the US and Britain, does not reduce the re-offending rate, a report for the Dutch justice ministry said on Monday.

Nor is there any evidence that updating locals on the presence of sex offenders stops further crimes, the report says.

In fact, notifying locals that someone convicted of sex crimes has moved to their neighbourhood can have a negative effect by isolating the offender from society. This could make it more likely that he will re-offend, the report says.

Trials

The report coincides with an experiment currently under way in 50 local authority areas in the Netherlands. The experiment, based on British practices, involves informing police and mayors when sex offenders are released from jail and settle in their locality.

Sex offenders in the Netherlands can be kept under official supervision for up to nine years.

If the experiment proves successful, it will be expanded nationwide."

Citing hunt for pedophiles, Dutch government to make refusing to help decrypt computer a crime

"AMSTERDAM - The Dutch government says it is planning to make it a crime for a suspect in a child sex abuse or terrorism case to refuse to help decrypt a computer when ordered to do so by prosecutors.

In February, a U.S. appeals court found that forcing a suspect to surrender access to his computer can violate his constitutional rights not to incriminate himself.

Justice Minister Ivo Opstelten said Wednesday the real issue is obstruction of justice, and he said comparable laws exist in England and Sweden."

'Virtual child porn could reduce child abuse'

"Paedophiles could be given ‘virtual child pornography’ in order to reduce instances of child abuse and the market for child porn, two sexologists say in Monday’s Trouw.

Erik van Beek and Rik van Lunsen, who treat men with paedophile tendancies [sic], say allowing paedophiles access to material which did not involve children being abused would give such men an outlet.

‘Hopefully, this would mean real child pornography involving child abuse would become less popular,’ Van Beek is quoted as saying."
