A 16-year-old Victoria girl has been charged with distributing child pornography for sending a picture of another girl by text message on her phone.
The trial of a Victoria-area teen who is facing child pornography charges for allegedly texting a nude picture of another girl without her consent will go ahead before a constitutional challenge, a judge has ruled.
The 16-year-old Saanich girl is facing charges of possession and distribution of child pornography and uttering threats after she allegedly distributed nude pictures of her boyfriend's ex-girlfriend.
Today, a provincial court judge ruled the trial will go ahead this fall, before a related constitutional challenge to the child pornography law will be heard.
The teen's lawyer Christopher Mackie says they are launching a constitutional challenge against Canada's child pornography laws as they apply to people under age, claiming the charges amount to age discrimination."

"School bans skirts for 'unladylike' girls aged nine.
The school in question said some its female pupils looked ‘unladylike’ in skirts.
A school has banned girls as young as nine from wearing skirts.
Walkwood Church of England Middle School is introducing a trousers-only rule from September.
And from 2014 the school in Redditch, Worcestershire, will require girls to wear shirts instead of blouses – meaning their dress will be the same as that of male pupils.
Headteacher David Doubtfire said the ban was necessary because pupils were wearing skirts that were far too short, making them appear ‘unladylike’.
He added: ‘Some of the older girls were beginning to wear extremely short skirts.
‘It was becoming difficult, especially when it came to them sitting down in the school hall. It was very unladylike." [wink]
‘We would ask them to make their skirts longer, but they would just roll them up again when we turned away.’"

"SALT LAKE CITY — The Utah Legislature took a step toward regulating sexually explicit images, acknowledging that such images may cause long-term harm to unsuspecting viewers.
The Senate Health and Human Services Committee approved a joint resolution on the matter Monday that "recognizes the strong negative impact of gateway pornography on brain development in children, and urges parents and concerned citizens to consider ways to mitigate its effects," according to the proposed legislation.
A Utah mom brought the issue to lawmakers after spending years poring over varous scholarly journal articles and other materials regarding the perceived effects pornography might have on the developing minds of young children."

A High Court judge has rejected calls from the father of a troubled 13-year-old to force Facebook to forbid her from accessing her account in a case which highlights the difficulties some parents face in stopping children accessing inappropriate content online.
The father, who cannot be named for legal reasons, wanted judges to force Facebook to take “any steps necessary” in stopping the girl accessing the website after she used it to post a series of sexually suggestive pictures and have “sexualised contact” with older men."
