"ABSTRACT

The legal and psychological research surrounding online Child Sexual Exploitation Material (CSEM) is focused on visual depictions of children, either as still images or movies.

Narrative CSEM (N-CSEM) describes an under-researched area, resulting from difficulties surrounding its conceptualisation, both legally as well as concerning the function for its users.

The current study describes an initial attempt in defining N-CSEM in comparison to visual material, based on interviews with users of CSEM and N-CSEM and professionals working with this user group.

Thematic Analysis resulted in three super-ordinate themes. All themes were analysed and enriched from the perspectives of user- and service-representatives.

The study provides insight into N-CSEM as a separate entity from visual CSEM, challenging and informing legal decision-making and assessment and treatment providers for users of CSEM.

"We live in ever more hateful times. This ongoing prosecution, in which a suspended policeman is charged with the newly invented crime of reading erotic short stories, pushes the envelope of feminist sex-hostility another notch forward and inspired the following essay from me.

When words are criminal, so are thoughts. Whether thoughts are written down or not makes no moral difference, and any words that sexualize a minor are criminal. My opinions on "child" sexuality (referring to anyone under 18) are fundamentally criminal, and only technical and resource limitations (mind reading technology is not there yet) prevents the state from convicting and imprisoning me. Notice that the law covers every medium of thought currently accessible to the police, and if they could read our thoughts directly, they would surely do so and base their prosecution on it."

"Those who insist that porn should be censored or regulated claim that it sexualises children and promotes immoral behaviour. Others are happy to live with ‘healthy’ adult porn but want to ban porn which degrades women or celebrates sexual violence. Some are comfortable with all sorts of obscenity but feel that child porn must be criminalised.

As someone who takes freedom of speech and of expression seriously, I reject any form of censorship – including of obscene material. The right to have access to ideas and information regardless of their social or moral worth is a fundamental one. Those who, like me, believe the world would be a better place if we didn’t have the industrialisation of porn should counter this phenomenon by challenging the culture that underpins it, not through censorship."

Violent pornography can add ‘fuel to the fire:’ Psychology expert testifies at trial of Quebec gore filmmaker

"Special effects makeup artist Remy Couture, shows one of his creations at his studio in his home in Montreal on Thursday, October 14, 2010. Couture pleaded not guilty to charges of moral corruption and distribution of obscene material for his short films.

MONTREAL — It is not uncommon for gruesome photos and videos to be exhibited in criminal trials, but usually the author of the violence does not claim credit.

In one 10-minute film played in Quebec Superior Court Wednesday, however, the accused’s name was proudly displayed in the closing credits as director, special-effects artist and “psychopath.”

The director and star, Rémy Couture, is not charged with physically harming anyone in the films and photos that have been shown to the jury. He is a special-effects artist and the images, which he posted online, were a kind of calling card to show off his talents.

"But the fictional violence inflicted by Mr. Couture’s “psychopath” – the torture, mutilation and sexual abuse of naked women – appears so brutal, the Crown is arguing the material is illegal."

"Prof. Malamuth testified Wednesday violent pornography “can add fuel to the fire” when viewed by men who are predisposed to being sexually aggressive toward women.

In a report entered into evidence, he said he has viewed Mr. Couture’s two films, Inner Depravity 1 and 2, as well as many of the hundreds of photos shown to the jury.

“These materials often portray sexual images and acts embedded within or merged with extreme acts of violence, including murder, mutilation and body dismemberment,” he wrote.

The images “portray the man as looking very powerful while completely controlling helpless, suffering, viciously tortured and dismembered women,” he added.

Research “strongly suggests that these types of materials may have negative or harmful effects on consumers,” he concluded. The effects include “greater acceptance of violence against women, emotional desensitization to aggression and increased proclivity to aggress, particularly sexually aggress.”

Prof. Malamuth said the violence depicted by Mr. Couture is more extreme than that found in the pornography he has used in his research."

You could be committing a criminal offence next time you discuss your deepest fantasies with someone online. Alarmist? Only slightly.

A ruling slipped out quietly by the Appeal Court earlier this year, and lurking in the background while the substantive case to which it applied came to court, makes it plain: the act of publishing as defined within the Obscene Publications Act can take place with an audience of just one individual.

That means it is therefore perfectly possible for the content of online chat, should a jury decide that it is capable of "depraving or corrupting", to be judged "obscene" - and as such for one or both participants in that conversation to be guilty of a criminal offence that carries a sentence of up to five years in prison, and a stint on the sex offenders' register.

This is legal dynamite - and in one single judgment catapults the UK to the back of the queue on a range of international indices on freedom of speech."

Time to Scrap Obscenity Laws?

"We now have laws specifically designed to tackle extreme pornography, and they have their root not in notions of obscenity or corrupting the consumer, but in the desire to protect the helpless victims of those whose images are portrayed [sic]. We are all universally agreed [no] that this is a good thing. But we do still have a law of obscenity. I wonder if it's now time to say goodbye the 'deprave and corrupt' test and simply say that anything goes unless we have specifically banned it. If Professor Lajeunesse is right, there is, it turns out, nothing that consenting adults can do to each other in front of a camera not involving violence that is even capable of depraving or corrupting us. That being the case, I think on balance a 'banned list' approach would be far more sensible."
