New Powers for Tighter Restrictions on Sex Offenders

"Measures to give greater powers for the police to protect the vulnerable from sexual predators [sic] were announced today by Policing and Criminal Justice Minister Damian Green.

The proposals, tabled in the Antisocial Behaviour, Crime and Policing Bill, will strengthen existing powers by making it easier to restrict the movement and activities of anyone who poses a risk of sexual harm to children and adults – not just people who have been convicted of sexual offences. They also build on Nicola Blackwood MP’s amendment to the Bill.

The two new orders will replace existing powers and the threshold for risk will be lowered to cover any case of sexual harm [sic], not just cases of serious sexual harm.

The new orders are:

Sexual Harm Prevention Orders can be applied to anyone convicted or cautioned for a sexual [sic] or violent offence, including where offences are committed overseas. They will replace Sexual Offences Prevention Orders and Foreign Travel Orders;

and

Sexual Risk Orders can be applied to any individual who poses a risk of sexual harm in the UK or abroad, even if they have never been convicted. They will replace the Risk of Sexual Harm Order.

Both powers can place a range of restrictions on individuals depending on the nature of the case, such as limiting their internet use, preventing them from being alone with a child under 16, or preventing travel abroad.

The new Sexual Harm Prevention Order can be made by a court on conviction, or if the police or National Crime Agency (NCA) apply to a Magistrates’ Court. The order lasts a minimum of five years and has no maximum duration. The new Sexual Risk Order can be made if the police or NCA apply to a Magistrates’ Court regarding a person who poses a risk of sexual harm [sic]. It lasts a minimum of two years and has no maximum duration.

The government’s measures take into account the findings of an Association of Chief Police Officers-commissioned report into the use and effectiveness of civil orders, and following consultation with front-line professionals including the police, the courts, and the Child Exploitation and Online Protection Centre [defunct].

Policing and Criminal Justice Minister Damian Green said:

“The UK has some [sic] of the toughest powers [most draconian] in the world to deal with sex offenders [sic].

“Today, we are going even further by giving police and National Crime Agency officers the power to place greater restrictions on any person they judge to be a risk. Our proposals support the Childhood Lost campaign to tighten the law on sex offenders [sic] and make it easier for police to monitor them.

“This is part of ongoing work by the Home Office led National Group to look at how the police and other agencies can better identify and deal with sexual offending [sic], ensuring victims are at the heart of the criminal justice system.”

Other measures in the Bill include provisions on anti-social behaviour, extradition, forced marriage, firearms and dangerous dogs."

"'Very worrying'

Richard Atkinson, who chairs the criminal law committee of the Law Society, told BBC Radio 4's PM programme he was concerned about the move.

"Of course, a great deal of stigma is attached to anyone who has such an order made and if the process of obtaining these orders is less than that is needed for a conviction then that's a very worrying departure from our normal standards," he said."

MPs approve measures to prevent child sexual abuse

"The government has lent its support to a campaign led by backbenchers to introduce new powers to prevent the sexual abuse of children.

Before the main debate on the Anti-social Behaviour, Crime and Policing Bill got underway, several objections were raised to the timetabling of the bill. Labour forced a division on the programme motion, but lost the vote 227 to 294 .

An amendment was tabled at report stage of the bill on 14 October 2013 to enable courts to issue a "child sexual abuse prevention order"."

"A 22-YEAR-OLD man has been handed a five-year risk of sexual harm order by Bodmin magistrates to restrict his contact with female children.

MDP, 22, of no fixed abode, appeared before the court on August 30 when he was handed the order after an application by Devon and Cornwall Constabulary.

Under the terms of the order, P must not:

Have any contact or communication of any kind with any female child under 16 other than inadvertently and when it is not reasonably avoidable in the course of lawful daily life or with the consent of the child's parent or guardian (who has seen a copy of the order) and with the express approval of social services.

Live in the same household as any female child under 16 without social services approval.

Seek, obtain or engage in any employment, whether for payment or otherwise, which would bring him into contact with female children under 16 as a normal part of that employment or activity.

Loiter within a radius of 100 metres in the area of educational establishments, including nursery, junior and secondary schools, and all associated land and property.

P was ordered to pay £200 costs to Devon and Cornwall Constabulary."

Prevention order for Harpenden sex offender

"A 62-year-old man from Harpenden who was convicted of having a sexual relationship with a child in 2004 was made the subject of a sexual offences prevention order on Friday.

The order was handed to MA by St Albans Magistrates’ Court and has placed the sex offender under a number of restrictions including preventing him from accessing internet chat rooms ..." 

 " ... which also stops him from going on websites relating to the care and nurture of children, to be made after they raised concerns Angell was likely to reoffend because of his concerning behaviour.."

This comes after the court heard A was convicted in 2004 of engaging in sexual activity with a 12-year-old girl whom he met over the internet."

Warning after sexual offences against children double over a year

"Parliament: Government urged to improve [sic] legislation.

Legislation designed to protect young people from sexual offences is "clearly not working", the Scottish Conservatives have said.

The party is calling for reform after statistics revealed offences against young children have doubled in the past year.

Just 14 Risk of Sexual Harm Orders (RSHOs) have been issued since they were introduced in 2005. And in five cases these orders have been breached [and your point is?].

The Protection of Children and the Prevention of Sexual Offences (Scotland) Act 2005 brought in the orders to protect children from those who display inappropriate behaviour towards them.

The orders are applied to those who are deemed a risk to children through behaviour which falls short of criminal activity."
