Trends of indecent images of children and child sexual offences between 2005/2006 and 2012/2013 within the United Kingdom

"Little is known about the trends of indecent images of children (IIOC) offences, as UK criminal justice figures are unavailable within official crime data.

This study aims to explore the rates of conviction and the relationship between IIOC offences and child sexual abuse offences from 2005/2006 to 2012/2013.

The results indicated a continuing increase in offences of take, permit, distribute IIOC, rape of a child under 13, sexual activity of child under 16 and abuse of children through prostitution or pornography.

Six out of a possible 17 correlations were significant, with the strongest correlation found between take, make, distribute IIOC and rape of a female under 13.

Explanations for the findings are discussed and the utility of comprehensive prevalence figures for different stakeholders involved in addressing this crime issue."

"Conclusions 

The results of this paper found that IIOC offences have been increasing between 2005/2006 and 2012/2013 for the IIOC offence of take, make, distribute, but not for possession of IIOC. In addition, there was a continued increase for child sexual offences of rape of a child under 13, all child sexual activity and abuse of a child through prostitution or pornography, with other child sexual offences indicating a fluctuating pattern across the 8-year time period.

When exploring the relationship between IIOC offences and child sexual abuse, significant positive relationships were found for the offence of take, make and distribute IIOC with child sexual abuse offences of rape of a child under 13 (for both males and females), all child sexual activity, particularly sexual activity with a child under 16, and abuse of a child through prostitution or pornography. All other comparisons were non-significant.

Potential explanations for these finding could be attributed in two key ways: first, due to the increased awareness and reporting of IIOC and child sexual abuse offences, along with increased success of child protection and law enforcement agencies. The development of specialist collaborative agencies such as Child Exploitation Online Centre, Virtual Global Task Force and most recently the European Cybercrime Centre have no doubt contributed to public awareness and increased detection of these offenders (CEOP, 2012).

Alternatively, these findings could be due to an increase in people actually engaging in these particular offences. Although a causal relationship cannot be inferred, whilst IIOC offences of take, make and distribute IIOC offences have increased, so have certain child sexual abuse offences. Further work is required to understand this relationship and whether the increase in IIOC has resulted in more child sexual abuse offences, or vice versa. These results are informative to law enforcement agencies and key stakeholders involved in criminal justice and child protection."

140 police officers were involved in dawn raids in March and the nine men were arrested and charged with 25 counts, including rape.

The CPS has had to defend its record in rape cases.

Conviction rates for rape and domestic violence cases have risen to an all time high, the director of public prosecutions (DPP) has revealed, amid criticism that too few cases are being brought to court.

Figures released by the Crown Prosecution Service show that the conviction rate for rape prosecutions has increased to the highest on record, from 58% in 2007/8 to 63% in 2012/13. The CPS figures on rape are expressed as a percentage of cases where charges were brought and "flagged" as involving rape. In raw figures, there were 3,692 prosecutions for rape last year, resulting in 2,333 convictions."

A mother who falsely accused a taxi driver of raping her has been jailed for 20 months at Mold Crown Court.

Angela England, 42, who was living in Conwy county at the time, admitted perverting the course of justice on 30 May last year.

She claimed the taxi driver had raped her near her home, but his vehicle was fitted with a tracking device which proved she was lying, the court heard.

He was cleared in 1999 after a judge ruled DNA evidence against him could not be used against him.

Back then, a person could not be tried a second time for the same crime and builder B thought he had got away with it.

But changes to the law in 2005, to allow those cleared of a serious offence to be put on trial for the crime again, meant B could be retried for the rape.

Jurors at London’s Old Bailey were told a one-in-a-billion DNA match linked the grandfather of six, of Walthamstow, to the attack.

Coward B refused to come up from the cells to be sentenced.

Ordering he serve a minimum 10½years, Judge Peter Rook said he had committed a crime of “extreme violence and depravity”.

B beat his victim so badly she was unrecognisable. She died in 2002. Her family said: “She never got over it.”"

Prosecutor's fallacy

"The prosecutor's fallacy is a fallacy of statistical reasoning, typically used by the prosecution to argue for the guilt of a defendant during a criminal trial. Although it is named after prosecutors it is not specific to them, and some variants of the fallacy can be utilized by defence lawyers arguing for the innocence of their client.

At its heart the fallacy involves assuming that the prior probability of a random match is equal to the probability that the defendant is innocent.

For instance, if a perpetrator is known to have the same blood type as a defendant and 10% of the population share that blood type; then to argue on that basis alone that the probability of the defendant being guilty is 90% makes the prosecutors's fallacy, in a very simple form.

The terms "prosecutor's fallacy" and "defense attorney's fallacy" were originated by William C. Thompson and Edward Schumann in the 1987 article Interpretation of Statistical Evidence in Criminal Trials, subtitled The Prosecutor's Fallacy and the Defense Attorney's Fallacy.

The fallacy can arise from multiple testing, such as when evidence is compared against a large database. The size of the database elevates the likelihood of finding a match by pure chance alone; i.e., DNA evidence is soundest when a match is found after a single directed comparison because the existence of matches against a large database where the test sample is of poor quality may be less unlikely by mere chance.

The basic fallacy results from misunderstanding conditional probability and neglecting the prior odds of a defendant being guilty before that evidence was introduced.

When a prosecutor has collected some evidence (for instance a DNA match) and has an expert testify that the probability of finding this evidence if the accused were innocent is tiny, the fallacy occurs if it is concluded that the probability of the accused being innocent must be comparably tiny.

If the DNA match is used to confirm guilt which is otherwise suspected then it is indeed strong evidence. However if the DNA evidence is the sole evidence against the accused and the accused was picked out of a large database of DNA profiles, the odds of the match being made at random may be reduced, and less damaging to the defendant.

The odds in this scenario do not relate to the odds of being guilty, they relate to the odds of being picked at random."

Crime victims seek new laws on legal options

"Recalling painful memories of crimes that occurred years ago, survivors and their family members asked lawmakers to do away with the statute of limitations for child sexual abuse and to increase penalties for certain types of rape.

“I think it’s my fault because I didn’t scream or yell for help. I had Lifeline and I didn’t push the button. I was frozen, numb. I couldn’t speak. Why didn’t I yell? What could I have done to stop him? Why did it hurt so much?” Lisa Flint, of North Attleborough, a woman whose speech and movements are limited by cerebral palsy and who was raped in college, told lawmakers. She said, “This is what my world has been like since May 15, 2000. I ache for some kind of peace within. I have something he wasn’t powerful enough to take and that is hope. I hope someday I can make a difference for someone else.”

Accompanying Flint before the Joint Committee on the Judiciary, Rep. Elizabeth Poirier (R-North Attleborough) said she has known Flint since she was a child and said her rapist was sentenced to 20 years, making him eligible for release after 15. Poirier and Flint support legislation (H 1568) that would allow for life sentences for those convicted of raping people with disabilities.

“It is an aggravating circumstance, and should be recognized as such under the law,” Poirier said.

Others testified that they were victims of rape at a young age, and their lives since then have been akin to prison sentences, with no possibility of release.

“There are days when I look up at the sky and I say how much longer,” said Kelly Quinn, who runs the organization Strong and Supported. Quinn’s voice quavered as she testified that the violent rape she experienced as a child had “destroyed every facet of my life.” She said, “I ask, ‘How much longer do I have to endure this existence?”

The Judiciary Committee also heard testimony from those seeking to extend or do away with the statute of limitations for child sex abuse, laws that prevent people from bringing criminal charges or civil lawsuits after a certain period of time."

False rape claims 'devastating' say wrongly accused

"Two people a month are being prosecuted for making false allegations of rape and wasting police time, new figures show.

It's the first time details for England and Wales have been compiled, showing how common the problem is.

The Crown Prosecution Service (CPS) looked at a period of 17 months finding that in that time 35 people were charged.

Keir Starmer QC, head of the CPS, called the cases "serious but rare"."

Judge accidentally sentences teen DD for rape

"A TEENAGER was wrongly sentenced to two years imprisonment yesterday – by a judge who did not know what the charges against him were.

DD, 18, pleaded guilty to having sex with a 13-year-old girl, but was accidentally sentenced for a rape during a mix-up at Gloucester Crown Court."

How big is the gap between the number of rape cases and convictions? 

"While all the figures quoted in the Independent infographic are taken from the official data held by the Ministry of Justice, it doesn't account for the subtlety needed to properly understand them.

The 95,000 rape cases identified by the paper is the upper boundary to an estimate that includes attempted rapes, while the figures given for prosecutions and convictions refer to individual offenders, rather than the cases they are associated with, and therefore aren't directly comparable to the 95,000 figure."
