What Harm? What Blame?

January 22nd, 2014 2:27 pm

Argument recap: Sorting out the blame

"Analysis

"The Supreme Court left no doubt on Wednesday that it is willing to do its part to make sure that victims of child pornography get paid money to offset the harm done to them. But it also found itself very much in doubt about just what that part would be. The answer in the case of Paroline v. United States may depend upon how the Court understands two words: “apportion” and “contribution.”"

Charges for 106 in Huge Fraud Over Disability

"The retired New York City police officers and firefighters showed up for their psychiatric exams disheveled and disoriented, most following a nearly identical script.

They had been coached on how to fail memory tests, feign panic attacks and, if they had worked during the Sept. 11, 2001, terrorist attacks, to talk about their fear of airplanes and entering skyscrapers, prosecutors said. And they were told to make it clear they could not leave the house, much less find a job.

But their Facebook pages told investigators a starkly different story, according to an indictment and other court papers."

Child Trauma Expert [a biased expert is no worthy expert at all]: Pro-Pedophilia [sic] Groups Are ‘Grooming’ Public to Accept Adult-Child Sex

"Pedophilia advocacy groups, including the tax-exempt B4U-ACT founded by a convicted sex offender, are trying to “groom the public” into accepting adult-child sexual relationships, child trauma expert [sic] Dr. Joyanna Silberg told CNSNews.com.

“There is no legitimate scientific work that could justify the action of an adult with a child in a sexual relationship, because by definition [there is your mistake of circular reasoning] a child cannot consent,” [sic] said Silberg, executive vice president of the Leadership Council on Child Abuse and Interpersonal Violence.

“If you look at their backchannel communications [?],” Silberg continued, “they have clearly stated... that the B4U-ACT public persona is to kind of seduce [?] or groom the public into their way of thinking so that they can act. But they don’t say that on their public websites.”

Silberg, whose organization has debunked studies [where?, is that the totality of your 'debunking'? - you want a debunking of your 'debunking'?, see below.] claiming that sexual relations with adults do not harm children, added that “there is zero likelihood of [B4U-ACT] having an impact” on the sixth edition of the American Psychological Association’s (APA) Diagnostic and Statistical Manual of Mental Disorders (DSM), which declassified homosexuality as a mental disorder in 1973, and called any comparisons between the two as “completely ridiculous. [care to say why?]”

Rind And Tromovitch

"A study published in The Scientific Review of Mental Health Practice attempted to replicate the Rind study, correcting for methodological and statistical problems identified by Dallam and others.

It supported some of the Rind findings, both with respect to the percentage of variance in later psychological outcomes accounted for by sexual abuse and in relation to the finding that there was a gender difference in the experience of child sexual abuse, such that females reported more negative effects [of what, though?].

However it also acknowledged the limitations of the findings (college student sample, self-report data [same as for most 'victim' studies), and did not endorse Rind's recommendation to abandon the use of the term 'child sexual abuse' in cases of apparent consent in favor of the term 'adult-child sex'. [we prefer MSAc/CSAc - Minor Sexual Activity/Child Sexual Activity]

In their conclusion, the authors address the objection that Rind's work and their own would give support to those who deny that child sexual abuse can cause harm [from what, though?]: "The authors of the current research would hesitate to support such a general statement.

Instead, our results, and the results of the Rind et al. meta-analysis, can be interpreted as providing a hopeful and positive message to therapists, parents, and children. Child sexual abuse does not necessarily lead to long-term harm."[44]"

Mother sues 200+ 'pedophiles' who viewed child porn featuring her children

"Annapolis, MD. - An Annapolis woman has filed a lawsuit in federal court against more than 200 people attorneys are calling pedophiles [sic]. Attorneys claim the men included in the lawsuit viewed child pornography featuring the woman's children."

"The family is asking for $8-million in compensatory damages and $24-million in punitive damages from each defendant. Kelly says the goal is to stop the trade of this kind of porn, saying, "Curb the demand for this stuff by making the price of paying to play, paying to be involved, so high, that people will be discouraged from doing it." [oh dear, oh dear]

"The lawsuit claims invasion of privacy, intentional infliction of emotional distress and other charges. It's based, according to Kelly, upon a federal statute known as "Masha's Law." The statute was enacted in 2009 as a way to break down the growing market for child porn by imposing civil penalties on those who create, trade and view it. [that worked, then - not]"

FBI Distributes Child Porn as Part of Unusual [sic] Sting to Identify Users in Washington State

"The FBI has disseminated child porn as part of a controversial, unorthodox [hardly, they do it all the time, and have done so, for years] sting in western Washington state.

After seizing a child pornography service last year, Nebraska-based agents decided to continue operating the service to catch users, the Seattle Post Intelligencer reports.

According to the newspaper, the bureau kept the service open for about two weeks in hopes of nabbing more than 5,000 customers who distribute the images of child being raped and abused.

It’s unclear whether the FBI has ever dealt child pornography as part of an investigation [oh, they will have - at the very least, they have downloaded and viewed it].

The investigation is in its infancy and has not yet resulted in an arrest, the Intelligencer reported.

“This remains an ongoing investigation, and local court rules and Department of Justice policy prohibit me from providing more information at this time,” said Sandy Breault, spokeswoman for the FBI Omaha Division. “As in any given matter, if charges are filed, they will eventually become a matter of public record. [good]”"

FBI shared child porn to nab pedophiles [sic]; Washington home raided

"The FBI seized and ran a child pornography service [sic] late last year as investigators worked to identify its customers [sic], one Western Washington man allegedly among them."

"Images endure despite prosecutions

In what has become a disturbing legal cliché, federal prosecutors often assert that each time an image of rape or molestation is shared, the child [sic] is abused again [sic, the 'child' no longer exists].

That was among the arguments offered by Special Assistant [in a 'Special' way] U.S. Attorney Marci Ellsworth last year when she sent a Seattle child molester to federal prison for child pornography crimes unrelated to the Nebraska investigation.

Ellsworth opined [incorrectly] that Pinson’s crimes were not, as the child pornography consumers [sic] sometimes argue, “victimless.” [see the charge sheets]

“Distributing of child pornography – images [indeed] and videos [indeed] of real children [you see, that is where it all falls down] experiencing the worst moments of their young lives [sic] – is not a ‘victimless’ crime [see the charge sheets], and the heinous nature [sic] of this offense should never be diminished by referring to it as ‘just pictures,’ [which is exactly what they are]” Ellsworth told the court. “The children portrayed … suffer real and permanent damage [do they - evidence, please, Marci], for the rest of their lives [ditto], each and every time their exploitation is shared over the Internet [the absolutely, faulty logic and reality, behind this claim, is too ridiculous to even bother counteracting].”

One of those children [sic] – a girl [that will be the adult female 'Vicky', one the FBI's two 'poster girls', who they and others seem to love to exploit] whose father shared images of her being abused that has since become widely shared online – put it more bluntly in a statement to the court filed last year.

“I wish I could feel completely safe, but as long as these images are out there, I never will,” she said in a victim impact statement. [which, merely confirms, that the woman - if she truly believes it - is suffering from severe cognitive distortion, at the very least]

“Every time they are downloaded, I am exploited again [even by the FBI, 'Vicky'?], my privacy is breached [hahahahah, bless], and my life feels less and less safe,” she continued. “I will never be able to have control over who sees me raped as a child [they are not seeing 'you', the images were never 'you' and never will be]. It’s all out there for the world to see and it can never be removed from the internet. [well, not exactly true, but OK - why are your images so different, from millions of other, quite legal, but disturbing - to some, images?]” [as we say, severe cognitive distortion, at the very least, of which those who continue to exploit 'Vicky', and feed her distortions, should be thoroughly ashamed]

Efforts to interview a Seattle attorney representing her were unsuccessful prior to the holiday weekend. Staff at the National Center for Missing & Exploited Children was also unavailable to discuss the issues surrounding the investigation [is it nice weather, over there?]."

‘I am a real victim of child pornography and it affects me every day and everywhere I go’

"‘Amy’ was a victim of sexual abuse by her uncle as a child. He uploaded images of the abuse on to the internet, they became known as the ‘Misty Series’. These images have been globally trafficked since the late 1990s and are the most widely viewed in the child pornography world, according to the New York Times.

Amy is now 24; she gets notifications through the US Justice Department every time someone views the ‘Misty Series’ video. So far she has 1800 notifications and the video has already featured in 3200 criminal cases. Next month in a landmark case, the US Supreme Court will decide how much a child porn victim can demand from the people who viewed a video of her being abused."

Victim: Viewing child porn isn’t harmless

"But for those who look at child pornography in the privacy of their homes, Reynolds says, they should know better.

“Shame on you,” she said.”

For victims, she said, “it’s psychologically damaging. It’s not fair. People think victims of child pornography are not touched. It’s not like rape. It’s just overlooked. … They don’t realize what we’re doing when we have to send those pictures. We’re doing it ourselves. We’re forced to. ... We could not say no.”

Reynolds said the people who look at the pictures “are dads and brothers and sons.” She wants to tell them, “This could be your sister.”

They are creating the demand, the marketplace that is being catered to by the child pornography producers and extortionists.

“You’re contributing to it. You can’t be a law-abiding citizen if you’re contributing to extortion,” Reynolds said. “People send out those pictures and make them public because of people who view them.”"

Why Aren't We Doing More To Stop Child Pornography Before It Starts?

"This weekend's New York Times Magazine cover on restitution for victims of child pornograpy

Talk about emotional whiplash. Two weeks ago in The New Yorker, Rachel Aviv wrote about John, a socially awkward veteran who was ensnared in an Internet child-sex sting in the late 1990s. He was convicted of persuading a child to have sex with him (although no sex happened—the supposed child was really a cop) as well as possession of child pornography. After his release, he landed back in jail on another child porn charge. Nearing completion of that sentence, despite a lack of evidence that he had ever molested a child himself, he was subject to a legal procedure known as civil commitment, which allows sex offenders to be detained beyond their prison terms on the grounds that they’re likely to harm again. Aviv never suggests that child pornography is a victimless crime, but you’re left with the feeling that John doesn’t quite deserve to be jailed indefinitely."

The Price of a Stolen Childhood

"When Nicole ['Nicole'] was a child, her father took pornographic pictures of her that still circulate on the internet.

The detective spread out the photographs on the kitchen table, in front of Nicole, on a December morning in 2006. She was 17, but in the pictures, she saw the face of her 10-year-old self, a half-grown girl wearing make-up. The bodies in the images were broken up by pixelation, but Nicole could see the outline of her father, forcing himself on her. Her mother, sitting next to her, burst into sobs."

For damages, child porn victims must show cause, U.S. court says

"Two women who are seeking restitution from a man who viewed pornographic images taken of them when they were children must show that the defendant helped circulate the images, a federal appeals court ruled on Wednesday.

The 7th U.S. Circuit Court of Appeals, in Chicago, said the two victims must prove a causal link between their losses and a defendant's crime of possessing the images.

The issue, which has divided federal courts, could determine the extent to which victims of child pornography can recover money for medical costs, therapy and lost income from the people convicted of viewing their images.

The case centers on Christopher Laraneta, who pleaded guilty to possessing child pornography and was sentenced to 30 years in prison in February. He was also required to pay restitution to two women, identified in court documents as "Amy" and "Vicky," photographs of whom, taken when they were children, were found in his possession.

The court awarded Amy all of her losses, calculated at more than $3.3 million, even though she had already recovered around half that amount from other defendants. It awarded Vicky more than $900,000 in restitution.

On appeal, Laraneta argued that he was not responsible for the victims' monetary losses. Although the images were found on his computer, he was only one of a number of viewers, he argued.

But an attorney for the two women argued that they did not have to prove that Laraneta was responsible for the bulk of their losses. Federal law requires a defendant to pay a victim the "full amount of losses," including medical services, therapy costs, lost income and "any other losses suffered by the victim as a proximate result of the offense."

The phrase "proximate result" only applies to the last category - "any other losses" - and not to the other listed costs, such as medical and therapy expenses, the victims' attorney argued.

The 7th Circuit rejected that argument on Wednesday, finding that the "proximate result" requirement applies to all of a victim's claimed losses."

Child porn victims can get restitution, court says

"Child pornography victims can recover money from people convicted of viewing their abuse without having to show a link between the crime and their injuries [sic], a federal appeals court ruled Monday.

The 5th U.S. Circuit Court of Appeals ruled that a woman, identified as "Amy" in court documents, was entitled to restitution from Texas resident Doyle Randall Paroline and New Orleans resident Michael Wright, both of whom pleaded guilty in separate cases to possessing child pornography that included images of Amy.

The decision conflicts with rulings by several other federal circuits, possibly setting the stage for a Supreme Court challenge.

Amy sought more than $3.3 million from Paroline to cover the cost of her lost income, attorneys' fees and psychological care. [sic] A federal judge rejected her request."

"Amy also sought more than $3.3 million from Wright, who had images of Amy and at least 20 other identifiable children stored on his computer. A federal judge ruled Wright owed Amy more than $500,000.

Wright argued he didn't owe Amy any restitution because he didn't obtain the images until years after she was abused. He also said there wasn't any evidence that she knew he personally viewed the images."

"In at least 174 cases, Amy has been awarded restitution in amounts ranging from $100 to more than $3.5 million. James Marsh, one of her attorneys, said in January that she had collected more than $1.5 million."

Victim in child porn videos now seeking justice

"We don't know much about the woman known as Vicky - her age, or where she lives. But she is a presence in courtrooms across the country, trying to make the people who download her images pay her back

Seattle attorney Carol Hepburn reads the words of Vicky

"I'm living every day with the knowledge everyday someone is watching the most horrifying moments of my life and taking grotesque pleasure in them,” she reads.

In 300 federal criminal cases across the nation, men are accused of trading video's of Vicky -- who was 10 years old at the time -- being brutally raped by her father.

"I'm told by law enforcement that her videos are among the most widely traded in the world," said Hepburn.

In Seattle Federal Court on Friday, government attorneys argued that Josh Kennedy should pay restitution -- money to pay for Vicky's therapy -- for 48 images of Vicky found on his computer in 2007."

"Unlike other forms of exploitation, this one is never-ending." - Kylie.
"Really frightening her to death." - Lawyer.

Kylie is the FBI/DHS 'poster child', wheeled in and exploited, whenever she is needed, to share her (more likely to be those who have advised her) cognitive distortions.
