Working with sex offenders and paedophiles

"The typical client is dealing with intense shame regarding their behaviour, the shattering impact of police officers arriving at the door early in the morning with a search warrant, the distress of their family and friends and the threat of losing their job. So initially I work with these issues and I describe the experiences of other clients, whilst of course maintaining strict confidentiality. This helps them understand that they are not unique. I also look at the triggers for their offending behaviour, as this awareness helps them change their behaviour to avoid being triggered.

Viewing indecent child images is not a victimless crime – others have directly abused children in order to feed the offender’s appetite.

Unless the offender is able to acknowledge this harm then therapy will not succeed. I am aware that the quality of my work will influence whether the offender recovers or continues to harm others, including children. This pressure is particularly intense when dealing with offenders who have harmed children directly."

In this week's programme, the Attorney General for England and Wales Dominic Grieve speaks to Joshua Rozenberg in an extended interview.

To begin, they discuss the issue of sentencing and the attorney general's role as gatekeeper to the appeals court. How does he go about deciding whether a sentence is lenient or unduly lenient - and therefore worthy of an appeal? What are the factors he takes into consideration? And how can members of the public make an appeal to his office, to ask for a case to be reviewed?

The programme also speaks to Lord Justice Sir Colman Treacy, a senior member of the Sentencing Council, about the council's advisory role, asking whether he thinks sentencing is becoming more lenient.

The conversation moves on to international law, and the recent raids by US special forces in Libya and Somalia, in which a suspected leader of Al Qaeda was detained. Did the United States break international law by taking such action? And what about the British government's decision to push for military action in Syria - would it have been legal?

Finally, many voices within the Conservative Party want to restrict the influence of the European Court of Human Rights. But does Dominic Grieve agree with his cabinet colleagues? He warns of the potential cost to the UK's reputation and to the promotion of human rights around the world.

"My purgatory was to last for nine months. A week after I was interviewed by the police, I received a phone call from the WPC who had interviewed me. She requested that I sign a form authorising the police to make further enquiries. If this turned out as I had relayed the story in my statement, then there would be what is known as, an NFA (No further action) I arranged to go into the police station the following week to sign the form.

Here’s the thing. As any conscious offender will tell you, I use the word ‘conscious’ for a reason. This is because I was now beginning to wrestle with my conscience. One of the allegations was false, of this there was no doubt. (It’s a long shot asking people to believe me, I mean come on – I’m a criminal right?) The other allegation was true. I made sure the sand was keeping my ears warm for sure. I was planning my wedding and nothing was going to stop that, least of all a criminal charge. Here’s a picture of my rings. Beautiful eh?

After signing the form at the police station, life moved on and as I watched my phone each and every day and shook every time it rang, I began to relax as the weeks went by and I heard nothing from the police.

On the 27th August, I was hanging out the laundry as the postman walked into the garden and handed me that day’s mail. I saw this envelope and it was then, call it a sixth sense, I knew what was inside the envelope. The Crown Prosecution Service was charging me. I was summonsed to appear before the local Magistrate Court to answer the charges put before me. I had never been formally arrested. There’s no need for that in today’s modern-day provision of ‘services’"

Rape conviction rate at an all-time high

"CPS statistics reveal conviction rate is currently at 63% as prosecutors respond to claims too few cases appear in court

The CPS has had to defend its record in rape cases.

Conviction rates for rape and domestic violence cases have risen to an all time high, the director of public prosecutions (DPP) has revealed, amid criticism that too few cases are being brought to court.

Figures released by the Crown Prosecution Service show that the conviction rate for rape prosecutions has increased to the highest on record, from 58% in 2007/8 to 63% in 2012/13. The CPS figures on rape are expressed as a percentage of cases where charges were brought and "flagged" as involving rape. In raw figures, there were 3,692 prosecutions for rape last year, resulting in 2,333 convictions."

CA's naked children phone photos 'generally innocent'

"A man who had almost 500 photographs of naked children on his phone has been given a community-based sentence.

CA, aged 41, from Perth, was given the non-custodial punishment after the sheriff said the pictures were "generally innocent".

The photographs included children running across a beach or in naturist or nudist surroundings.

A admitted [there was your mistake, friend] two charges relating to the possession of indecent images when he appeared at Perth Sheriff Court.

Sheriff Lindsay Foulis ruled that A had indirectly abused the children."

A Cautionary Tale Of 'Justice'

What they don’t tell you when you give evidence

"A cautionary tale from a witness for the defence

“I swear by Almighty God that the evidence I shall give shall be the truth, the whole truth and nothing but the truth.”

Little did I know that by giving evidence in the trial of my husband I was putting my job and entire career in jeopardy. For 3 months I tried to make a statement to the police when my husband was arrested, but they were not forthcoming in taking it, so I had to look at alternatives. The solution was found by my husband’s Solicitor – I made a statement to her. The police have not offered any explanation for not taking my statement.

The evidence I gave in both my statement and the trial in my opinion was the truth from my eyes. To be able to reach an accurate conclusion the Jury needed to know the facts. My time on the stand lasted just under 3 hours and I was exhausted by the end. Throughout, I was grilled by the prosecution, who believed I was supporting my husband, when in fact I tried to keep an open mind. In hindsight if I had given my statement to the police I might have been perceived differently. I answered factual questions and was asked for my opinion on several incidents related to the allegations.

A few weeks later I was called to a meeting by my employer. A Trade Union Representative accompanied me. I work in the Public Sector. Unbeknown to me my employer had acquired a copy of the transcript of my evidence from the trial and I was cross-examined on the answers I gave. I had to justify my previous answers, particularly those that were opinion based. It became obvious that it was felt some of my opinions were not appropriate according to my profession and Professional Standards. It was at this point I considered a link between the high proportion of opinion questions and the fact my employer had a copy of the transcript – they were not present in court and had no direct interest ..."
