Jimmy Savile 'not protected' from arrest, West Yorkshire Police say

"Jimmy Savile West Yorkshire Police said there was "no evidence" Savile was protected by the force

A West Yorkshire Police report has found "no evidence" Jimmy Savile was protected from arrest or prosecution by his relationship with the force.

But the review found there was an "over-reliance on personal friendships" between Savile and some officers. [ ... and this was rare, how? Ask Mark]

Hundreds of allegations of abuse by the former BBC entertainer emerged after his death in October 2011.

The police said the report would be passed to the Independent Police Complaints Commission.

The West Yorkshire Police review, named Operation Newgreen, comes after a report by Her Majesty's Inspectorate of Constabulary (HMIC) highlighted failings by forces across Britain."

Reaction to West Yorkshire Police report on Savile

"Police say Savile 'not protected'

The report into West Yorkshire Police's relationship with Jimmy Savile has shown how he "ran rings around" officers who were taken in by his fame, leading figures have said.

The force said it was currently dealing with 76 crimes, involving 68 victims, committed in the West Yorkshire area, but the report claims none of these were reported to the force before his death.

Criminologist Mark Williams Thomas told the BBC he believed the report was "very very poor", describing it as "probably one of the worst reports I've seen"."

Top barrister Barbara Hewson has claimed the age of consent should be lowered to 13 to protect older men in the wake of the Jimmy Savile sex scandal

The age of consent for sex should be lowered to 13-years-old in a bid to end the 'persecution of old men' in the wake of the Savile sex abuse scandal, a top female barrister has argued.

Lawyer Barbara Hewson described the arrests of celebrities such as Rolf Harris, Dave Lee Travis, Jim Davidson and PR guru Max Clifford under Operation Yewtree as a 'grotesque spectacle' adding it had 'nothing to do with justice or the public interest'.

Ms Hewson, a barrister at Hardwicke chambers in London, described the crimes committed by disgraced broadcaster Stuart Hall as 'low level misdemeanours' which would not normally be prosecuted.

In an article for online magazine Spiked, Ms Hewson, who specialises in reproductive rights, also calls for the end of anonymity for complainants.

Children’s charity the National Society for the Prevention of Cruelty to Children (NSPCC) said to hear such 'outdated and simply ill-informed' views from a highly-experienced barrister 'beggars belief'.

Her comments come as Scotland Yard runs Operation Yewtree, an investigation split into three inquiries into allegations involving deceased presenter Jimmy Savile, involving Savile and others and those involving just others.

A number of high-profile figures have been arrested under Yewtree such as entertainer Rolf Harris, former pop star Gary Glitter, DJ Dave Lee Travis, comedian Jim Davidson and PR guru Max Clifford. All deny any wrongdoing.

Ms Hewson argues that 'the post-Savile witch-hunting of ageing celebs echoes the Soviet Union' and says that it is not difficult to see why some elderly defendants 'conclude that resistance is useless'."

Yewtree is destroying the rule of law

"Every Yewtree arrest generates anti-celeb sneering. But an arrest does not equal guilt, at least not in civilised societies.

Following the arrest of Jimmy Tarbuck on 26 April, it is clear that Operation Yewtree, the operation established to investigate historical allegations of sexual offending against Jimmy Savile and ‘others’, has the potential to be more far reaching than first thought.

The operation was initially established to investigate allegations in three categories: allegations against Savile acting alone; allegations against Savile acting with others; and allegations against ‘others’. This third category has led to the arrest of six individuals since November 2011. These have included William De’Ath, a former BBC producer, although the police have since announced that no further charges will be brought against him. On 19 April, it was revealed that last year Rolf Harris had been arrested and interviewed in relation to the third category of offending. Operation Yewtree has led to the arrest of 13 men in all. Two have been charged: PR agent Max Clifford, and ex-BBC driver David Smith."

What has sparked his censure of this respected barrister?

She has long been pointing out the dangers present in our Family courts which have adopted a ‘therapeutic jurisprudence’ approach, resulting in the restriction of the right to due process, the right to be presumed innocent until proved guilty, the right to be tried in public, the right to confront one’s accusers, and the right to ‘equality of arms’ (that is, not to be tried under significantly less advantageous conditions that those enjoyed by one’s opponent). Other protections, such as restrictions on the use of hearsay evidence, the right to consult the expert of one’s choice, and even the right to communicate in confidence with one’s lawyers or one’s MP, have been placed in second place to the sense that ‘neutral professionals’ were working in the best interests of the child and should not be hampered by outdated technicalities.

Those who have seen their families rent asunder, new born babies snatched from their Mother’s arms following allegations by those ‘neutral professionals’ made in secret courts, or seen loved ones secretly deprived of their liberty by the Court of Protection, have long hailed her a heroine. She is an expert in the field. Yesterday she penned a cogent and well argued article pointing out that this therapeutic jurisprudence was being applied to the field of historic sex abuse. She criticised the methods that those involved with the current Yewtree investigation – which of course includes Mark Williams-Thomas, are using. She pointed out the inherent dangers to our legal system.

Within hours the Press Officer for the NSPCC was demanding that her article be either reworded or removed. They threatened to ‘approach news desks’ (what with, we know not!). Other commenters were more graphic, calling for her ‘to be raped’ and ‘hunted into obscurity’. It is heretical to call into question the methods by which the modern moral crusaders attempt to define abuse. Williams-Thomas himself called for her professional body to intervene – because she called for debate on where this new mode of justice is taking us?

I am reminded for some reason of Henry VIII. He was hugely critical of the Catholic church when they refused to reform themselves in line with his demands. He because hysterical with those who criticised him, denouncing them as heretics, demanding their heads roll, or sacking their homes and churches, as he rebuilt a ‘new’ church of which he was head, that developed new beliefs and rules and regulations.

However, it would be unfair to draw a comparison between the majestic figure of Henry VIII and Williams-Thomas; after all, he was but a pathological egotist whose only interest was in having his own way, achieving his own ends. He had no empathy with those whose lives he ruined along the way."

Hail, an improbable age of consent heroine!

"Heroes, or heroines, do not come much more improbable than lawyer Barbara Hewson. Who would have thought that this champion of women’s rights, with a reputation to protect as a successful, high-profile advocate in leading cases, would suddenly throw caution to the winds and call very publicly for the age of consent to be lowered to 13, as she has done this week?

It’s a British story, and it has been all over the media here, replete with predictable reactions, including “shock” at the large London law firm where she is one of many barristers, who are all self-employed members of the “chambers”, or law practice team. "As far as I am aware there is no longer a classification of "misdemeanour" in English law. The term is current in the American legal system. Therefore I use the word in its colloquial sense, "any minor offence or transgression" "

Comment:

Indeed, we have provided, what 'we' (at least, Ms Hewson, as a barrister) mean, by the term, today.

In the 'colloquial sense' (almost always dangerous and misleading), such actions are 'minor offences or transgressions', in the scheme of things, as evidenced by legality and sentencing.

Remember, that such actions have to be objectively-decided, as 'sexual' (SOA 2003), and sometimes they will not be, thus, not even against the law.

"The alleged historic sex crimes currently being "investigated" do not fall into that category, for all manner of reasons. To begin with, the current investigations are not evidence led but trawls; when people are invited to come forward and make allegations against either named individuals or a specific class of person, they have a tendency to do just that, all the more so when they will be guaranteed anonymity, may be rewarded with tea and sympathy, not to mention the prospect of cash payouts further down the line and maybe the chance of selling their stories to a Sunday tabloid for a five figure sum.

With no corroboration required and no sanctions applied for those who simply make things up, some individuals may see this as a win-win situation, they get to drag someone's name through the mud, someone to whom they may have taken a dislike for whatever trivial reason - perhaps failing to reply to a fan letter.

To the above must be added the most dangerous accusers of all, delusional people, largely but not exclusively women. This is one of those taboo subjects, but talk to an experienced detective or a specialist solicitor/barrister off the record and you will be told what only the very brave or the very foolish will admit openly, that for whatever reason, some people fantasise about being sexually attacked, and that with the passage of time these confabulations become real memories."

Wilfred De'Ath, who has always denied any wrongdoing, was arrested last year in Cambridgeshire over an allegation of indecent assault on a girl in the 60s. But the complainant has since withdrawn her statement, said Alison Saunders, chief crown prosecutor for CPS London.

He told the Today programme's John Humphrys that he believed the police were over-compensating now because they failed to get Savile at the time and said that the investigation, codenamed Operation Yewtree, was "getting silly"."

"So the first of the Yewtree branches has crashed to the ground, a sound virtually unheard in the forest of bad news today.

The ‘famous actress’ (I had to look her up such a household name was she…) (we are not allowed to mention her name – her publicist must be devastated) who alleged that Wilfred De’Ath (I definitely had to look him up) might have fondled her when she might have been a teenager in it might have been a cinema, has decided to withdraw her allegation. She still maintains it is true, but feels that she will be lonely in court, since no one else has come forward with similar allegations about the same man. She only came forward to Yewtree, she says, in the hope that it might give others the courage to come forward.

She is of course, an employee of ITV, the company which paid Mark Williams-Thomas to make the ‘Exposure’ programme, on which Wilfred De’Ath was such a willing witness against the ‘disgusting behaviour’ of Jimmy Savile."

Former children's TV presenter arrested by Savile sex probe detectives 'spends Christmas at psychiatric clinic'

A TV star questioned by police investigating the Jimmy Savile scandal spent Christmas in hospital amid fears for his mental health.

The man, in his 80s, was admitted to a Priory clinic for treatment for acute stress after being told of the allegations against him.

The children’s TV presenter, who cannot be named for legal reasons, was interviewed last month under caution as part of Scotland Yard’s Operation Yewtree."

Max Clifford, one of the UK's leading public relations experts, has been arrested by detectives investigating historic sex offences.

The BBC understands that Mr Clifford was arrested by Metropolitan Police officers working on Operation Yewtree.

Scotland Yard said officers had arrested a man in his 60s "on suspicion of sexual offences" and had taken him to a central London police station.

The arrest is not connected to allegations made against Jimmy Savile."

Max Clifford charged with 11 indecent assaults

"PR guru Max Clifford has been charged with 11 indecent assaults allegedly committed between 1966 and 1985.

The alleged offences relate to seven different women and girls ranging in age from 14 to 19 years old.

Mr Clifford, 70, from Hersham, Surrey says the claims are "completely false"; he will appear in court next month.

He was arrested in Operation Yewtree - set up following allegations about Jimmy Savile - although his arrest was unrelated to the former BBC DJ.

Operation Yewtree has three strands. One concerns Savile's crimes exclusively, while another relates to allegations against Savile and others.

The third strand, under which Mr Clifford was arrested, concentrates on accusations unconnected to the Savile investigations but which emerged as a result of the publicity surrounding Savile.

Mr Clifford was not charged over three further allegations as there was "insufficient evidence to authorise charges", the Crown Prosecution Service said.

Mr Clifford denied the allegations against him."

As the Jimmy Savile affair rumbles on, the question of whether so called “historic” offences should be subject to some form of Statute of Limitation has again been raised, not just because police, the CPS, courts and politicians seem to be applying today’s modern thinking to life as it was 40 years ago but also because the authorities are successfully bringing prosecutions that were not pursued at the time based on little or no evidence.

This week saw another “historic” case end with the jailing for 11 years of a 78 year old man for sex offences alleged to have taken place some 63 years ago from 1949-1973; the longest delay ever in bringing charges before a British court.

TheOpinionSite.org should point out that the recent sudden surge of accusers from the past is no accident either. The police and the CPS are openly inviting anyone who “thinks they may have been abused, no matter how long ago” to come forward and make a complaint, regardless of whether or not there is any evidence.

In other words, police are using the high profile Savile case in order to “trawl” for cases that they know full well will end in easy convictions."

"I see yesterday that Scotland Yard commander Peter Spindler has jumped ship from the appalling Yewtree ‘investigation that never was’. ‘Spindler’s List’ of 12 arrests, one charge so far, has become an embarrassment to the nation.

The police involvement in the whine-managers dark arts will take a long time to live down. The justice system is damaged, perhaps irreparably.

The spirit of Torquemada lives on, where debate is driven by prejudice and supposition, by fear not fact; the media preferring to give air time to the unhinged armchair moralists screeching ‘cover-up’ whenever their chosen celebrity unaccountably fails to make the ‘arrested’ list than to the likes of Karren Brady.

All I can say is God bless Karren Brady for convincing me that the entire septic isle hasn’t gone stark raving bonkers."

Police chief Peter Spindler quits Operation Yewtree celebrity sex abuse inquiry for watchdog role

"The Scotland Yard commander had overseen a string of high-profile arrests, including Freddie Starr, Jim Davidson, and Max Clifford.

Scotland Yard commander Peter Spindler has dramatically quit in the middle of the high-profile investigation into Jimmy Savile and other celebrities, the Sunday People reports.

The decision has surprised insiders who expected Spindler to see Operation Yewtree through to the finish.

He had overseen a string of high-profile arrests, including Freddie Starr, 70, Jim Davidson, 59, and Max Clifford, 70.

But last week Spindler began a two-year secondment to the police watchdog Her Majesty’s Inspectorate of Constabulary, the investigative website Exaro and the Sunday People have learned."
